Weekly Case Summary
3/15/2010

Michael J. Kilpatrick appeared on Polk County District Court in criminal number FE 231618. Kilpatrick had earlier been granted suspended five year prison sentences for the crimes of Theft in the Second Degree and Burglary in the Third Degree. Based on new charges filed against Kilpatrick he stipulated that he’d violated his probation and the probations were revoked. Kilpatrick was sentenced to two terms in prison not to exceed five years each and the sentences were ordered to be served consecutively to each other. Kilpatrick was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Melanie Stout was sentenced on the charge of Conspiracy to Commit a Forcible Felony, in violation of Iowa Code Section 706.1 and 706.3. The charges arose as a result of a March 27, 2008 incident when Melanie Stout entered into a plan with Kenneth Jimmerson and Callie Schneider. The plan included that Melanie Stout would call a pizza place and order a pizza and have it delivered to an apartment across the street. The plan was that Jimmerson would be there to rob the pizza delivery person, which he did.

The robbery went bad, however, when the victim of the robbery, the pizza delivery man, pulled his own firearm and shot Kenneth Jimmerson in self defense. Melanie Stout was sentenced to 10 years in prison for her role in the robbery.

On January 29, 2010, Defendant Nick J. Cipale, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. On March 15, 2010, Defendant Nick J. Cipale, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section (s) 124.401(5). This sentence shall run consecutive to the sentence in FECR190248, for a total period of incarceration not to exceed 20 years. The defendant was committed to the custody of the Director of the Iowa Department of Corrections. Nick J. Cipale was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

James Jennings Jr. pled guilty to Carrying Weapons and Possession of a Controlled Substance (Third Offense) in Polk County Criminal Case number FECR230569. The Court ordered that a pre-sentence investigation be prepared and set sentencing for April 26, 2010.

On January 27, 2010, Cyrone Eugene Wilson, FECR233076, pled guilty to possession of a controlled substance with intent to deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On March 16, 2010, he came before the Court for sentencing and received a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Bernard Davis was sentenced for the crime of Failure to Comply with Sex Offender Registery-2nd Offense, a Class D Felony. Davis was sentenced to prison for and indeterminate term of incarceration not to exceed 5 years.

Robert R. Seeman Sr. was sentenced for the crime of Theft in the 2nd Degree, a Class D Felony. The defendant received a suspended sentence and was placed on probation for 5 years. As a condition of probation the defendant must participate in a Victim Offender Reconciliation Program (VORP) and must pay full restitution to the victim of the crime.

Daniel Robben stipulated to the violations of probation as reported. The defendant’s probation was extended, with the consent of the defendant, until March 10, 2011. As conditions of probation the defendant shall comply with his payment plan and maintain fulltime employment.

Melvin Langston stipulated to the violations as reported and his probation was revoke and his original sentences were imposed. The defendant had been placed at the Fort Des Moines Residential Facility but was removed for non compliance. Langston will serve an indeterminate term of incarceration not to exceed 5 years.

Dionte Jabari Green plead guilty to Robbery in the Second Degree, in violation of Iowa Code Section 711.1 and 711.3. The charge in this case arose on February 22, 2009, when the defendant, Dionte Jabari Green and his accomplice Stephen Kalu Cobb, robbed a man across the street from Roosevelt High School as he was walking in the area. Dionte Jabari Green and Stephen Kalu Cobb were apprehended a short time after the robbery after having been seen getting in a van by the victim. The victim lead the police to the van where the defendant Dionte Jabari Green and his accomplice were apprehended.

Sentencing in Dionte Jabari Green’s case is set for April 26, 2010 at 8:30 a.m. in courtroom 209A of the Polk County Courthouse. At sentencing, the defendant is expected to be sentenced to the mandatory term of 10 years in prison.

His accomplice, Stephen Kalu Cobb, Polk County Case No. FECR226764, previously plead guilty to his part in the robbery and has previously been sentenced.

Gracie Byrd was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE233287. She was sentenced to a maximum indeterminate sentence of ten (10) years, but this sentence was suspended and she was placed on probation for five years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Russell Thompson appeared for disposition hearing regarding his probation. The defendant was found in contempt of court and ordered to serve 10 days in the Polk County Jail. He was further ordered to maintain full time employment and make regular payments pursuant to the payment plan.

Sergio Marrero-Ramirez was sentenced to prison in Polk County Criminal Number FECR234127 for a period not to exceed 45 years for the crime of Conspiracy to Deliver a Controlled Substance as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

The defendant in this case, Kristina Murrow, plead guilty to Conspiracy to Commit a Robbery on January 26, 2010. Her plea of guilty was a result of her involvement in a robbery in which Christopher Lee Sheets robbed an employee of Southridge Auto Sales during a test drive of a vehicle. During the test drive, Christopher Lee Sheets pointed what appeared to be handgun at the Southridge Auto Sales employee and took the car from him. (The gun was later determined to be a non functioning BB gun).

The defendant in this case, Kristina Murrow, plead guilty to conspiring with Christopher Sheets to commit that robbery.

Kristina Murrow was sentenced on March 18, 2010. She was granted a deferred judgment and placed on probation for five years. She was ordered to reside at the Women’s Facility, or other transitional housing, if recommended by her probation officer.

Myron Tomar Powell, plead guilty to Operating a Motor Vehicle Without the Owner’s Consent – Count I, Eluding a Pursing Law Enforcement Vehicle – Count II and Operating a Motor Vehicle While Under the Influence of Alcohol – First Offense – Count III.

The charges arose on September 5, 2009, when the defendant took the Des Moines Police Department on a high speed chase in Des Moines. At the time of the chase, the defendant was driving a motor vehicle he had taken from people in Davenport, Iowa. Also at the time of the chase, the defendant was operating the motor vehicle while under the influence of alcohol and marijuana.

Following his plea of guilty, the defendant was sentenced to two years on count I, five years on count II and one year on count III. Those sentences were ordered to be served consecutively for a total of eight years incarceration.

On January 25, 2010, Joel Mathias Johnson, FECR232555, pled guilty to possession of a controlled substance with intent to deliver-marijuana, as alleged in the trial information, in violation of Iowa Code Section 124.401(1)(d), a class D felony. On March 19, 2010, he appeared before the court for sentencing and received a 5 year suspended sentence and 5 years of probation with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Nicholas Charlson CR232186 was sentenced to prison for a term not to exceed 10 years for Neglect of a Dependent Person. He had previously been on probation for 2 Counts of Child Endangerment.

Amy Charlson CR232193 was granted a deferred judgment and probation for Child Endangerment. She will have to successfully complete any recommended mental health treatment and or other programming or education program recommended by probation officer or Department of Human Services.

Johnette Lomay CR233686 was granted probation for Child Endangerment. The defendant was ordered to follow all programming recommendations of her probation officer and DHS and shall not ingest alcohol or unprescribed controlled substances.
