On December 11, 2009, Anthony Phillip Mitchell, FECR232114, pled guilty to possession
of a controlled substance with intent to deliver-marijuana, as alleged in Count
I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class
D Felony, without the firearm enhancement. On March 31, 2010, he came before the
Court for sentencing. Both sides recommended a 5 year prison sentence. The Court
accepted the agreement of the parties and sentenced the defendant to prison for
5 years. This case was prosecuted by the Polk County Attorney’s Office Drug and
Gang Bureau.
Kirby Small was sentenced after pleading guilty to two counts of Dependent Adult
Abuse after stealing over $43,000 from his elderly parents. The Court deferred judgment
and placed the defendant on probation for two years.
Jeffrey Baase pled guilty to Burglary in the Third Degree. The Court ordered a presentence
investigation and set sentencing for a later date.
Defendant Aenoy Prathane appeared for hearing on question of whether his probation
should be revoked for violating the terms and conditions of his probation. The defendant
did stipulate that he violated his probation and the court revoked his deferred
judgment and adjudged him guilty of Criminal Mischief in the Second Degree and Malicious
Prosecution. The defendant was continued on probation for five years and ordered
to comply with the Department of Corrections Intermediate Criminal Sanctions Program.
Defendant Spencer Virden appeared for sentencing. The records show the defendant
plead guilty on the 29th day of January, 2010, to the crimes of Burglary in the
Second Degree; Burglary in the Third Degree; Theft in the Fourth Degree and Possession
of Paraphernalia. He also plead guilty to Theft in the Third Degree. The defendant
was sentenced to a term of incarceration not to exceed ten years on all counts.
Defendant Nicholas Clausi appeared in court to determine whether or not he violated
the terms and conditions of his probation. The court determined that the defendant
did violate the terms and conditions of his probation and his probation was revoked.
The defendant was adjudged guilty of Theft in the Second Degree and sentenced to
a period of incarceration not to exceed five years.
Defendant Corey Moore appeared in court for a probation violation hearing. The defendant
stipulated that he did violate the terms of his probation and he was ordered to
reside at the Fort Des Moines Correctional Facility until maximum benefits are received.
