Weekly Case Summary
3/29/2010

Oscar Rich was sentenced to prison in Polk County Criminal Number FECR231465 for a period not to exceed 30 years for the crime of Possession of a Controlled Substance with Intent to Deliver, as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On February 11th, 2010, the jury found Linda Elizabeth McGree guilty of Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation or Subterfuge, as alleged in the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(8), 155A.24 and 155A.23, a Class C Felony. On March 29th, 2010, this case came before the Court for sentencing. The State of Iowa argued for a 10 year suspended sentence and probation with the applicable $1,000.00 fine. The State did not recommend a deferred judgment, even though the defendant did not have a prior criminal history, because she was offered a deferred judgment prior to trial and turned down that offer and pointed the finger at someone else as the person who committed the offense. The Defense argued for a deferred judgment and probation based of her lack of criminal history and the fact she passed a polygraph examination by an examiner they selected and paid for out of the State of Nebraska. The Court granted the defendant a deferred judgment, even though she never admitted she committed the offense in her pre-sentence interview. She wrote down the same story that she presented to the jury during trial. The pre-sentence investigator happened to be a friend of the defendant’s and even showed up for her sentencing to show her support. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

Macon Grunsted stipulated that he had violated the conditions of his probation in case number FE228558. He was previously granted probation for the crime of Possession of a Simulated Controlled Substance With Intent to Deliver, a Class C felony. The Court will determine the appropriate disposition of this probation violation on April 8, 2010 at 10:00 a.m. in courtroom 207. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Peggy Karabatsolis was sentenced to two years probation after pleading guilty to Theft in the Third Degree with regard to her misappropriation of money from her elderly and dependent mother.

3/31/2010

On December 11, 2009, Anthony Phillip Mitchell, FECR232114, pled guilty to possession of a controlled substance with intent to deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony, without the firearm enhancement. On March 31, 2010, he came before the Court for sentencing. Both sides recommended a 5 year prison sentence. The Court accepted the agreement of the parties and sentenced the defendant to prison for 5 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Kirby Small was sentenced after pleading guilty to two counts of Dependent Adult Abuse after stealing over $43,000 from his elderly parents. The Court deferred judgment and placed the defendant on probation for two years.

Jeffrey Baase pled guilty to Burglary in the Third Degree. The Court ordered a presentence investigation and set sentencing for a later date.

Defendant Aenoy Prathane appeared for hearing on question of whether his probation should be revoked for violating the terms and conditions of his probation. The defendant did stipulate that he violated his probation and the court revoked his deferred judgment and adjudged him guilty of Criminal Mischief in the Second Degree and Malicious Prosecution. The defendant was continued on probation for five years and ordered to comply with the Department of Corrections Intermediate Criminal Sanctions Program.

Defendant Spencer Virden appeared for sentencing. The records show the defendant plead guilty on the 29th day of January, 2010, to the crimes of Burglary in the Second Degree; Burglary in the Third Degree; Theft in the Fourth Degree and Possession of Paraphernalia. He also plead guilty to Theft in the Third Degree. The defendant was sentenced to a term of incarceration not to exceed ten years on all counts.

Defendant Nicholas Clausi appeared in court to determine whether or not he violated the terms and conditions of his probation. The court determined that the defendant did violate the terms and conditions of his probation and his probation was revoked. The defendant was adjudged guilty of Theft in the Second Degree and sentenced to a period of incarceration not to exceed five years.

Defendant Corey Moore appeared in court for a probation violation hearing. The defendant stipulated that he did violate the terms of his probation and he was ordered to reside at the Fort Des Moines Correctional Facility until maximum benefits are received.

Andrea Torres was sentenced in Polk County Criminal Number FECR232928 for the crimes of Conspiracy to Manufacture a Controlled Substance and Possession of Ephedrine or Pseudoephedrine with Intent it be Used to Manufacture a Controlled Substance. Over the State’s objection, the Court granted Torres a deferred judgment and placed her on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Kenneth Neighbors was sentenced to five years probation after pleading guilty to Theft in the First Degree. The defendant stole over $10,000 from his elderly mother.

Ronald Wolfe was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE233162. Judgment was deferred in his case and he was placed on probation for five years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Derek White, FECR230290. Mr. White is on probation for Failure to Comply with the Sex Offender Registry – Second Offense and was before the court on April 1, 2010, for the matter of a probation violation. The defendant stipulated that he violated the terms and conditions of his probation and agreed that the original sentence be imposed. The defendant was sentenced to a period of imprisonment not to exceed five years.

State of Iowa v. Eleazar Villanova, FECR234452 and FECR234093. This defendant plead guilty to two counts of Forgery both Class D felonies and was ordered to complete the Iowa Residential Treatment Center in Mt. Pleasant until maximum benefits are obtained. The defendant will remain in the custody of the Polk County Jail until a bed is available in Mt. Pleasant at which time he will be transferred there. If the defendant successfully completes the treatment program at Mt. Pleasant, he may receive probation for the sentence.

State of Iowa v. Sone Ford, CR232697, CR233659, CR233661, and CR234355. This defendant was sentenced after previously pleading guilty to two counts of Unauthorized Use of a Credit Card, both aggravated misdemeanors. The defendant received a deferred judgment and was placed on one year of formal probation with all the terms and conditions that apply, including restitution for all the cases including those that were dismissed.
