Darnell Ramey II was sentenced for his involvement in the Wells Fargo Arena robbery that occurred during the Coldplay concert on June 12, 2009, as well as his role in robberies at local Git-n-Go convenience stores. The defendant previously pled guilty to two counts of Robbery in the Second Degree and Conspiracy to Commit a Felony in Polk County Criminal case number FECR229645. He was sentenced to serve an indeterminate term in prison of not less than fifteen years and will not be eligible for parole for seven years.

James Shadden pled guilty in Polk County Criminal Number FECR227248 to the crime of Possession of a Controlled Substance with Intent to Deliver and in Polk County Criminal Number SRCR236114 to the crime of Escape. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Carl West pled guilty in Polk County Criminal Number FECR235380 to the crime of Delivery of a Controlled Substance. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 19, 2010, Richard Anthony Bolden, FECR234934, pled guilty to Possession of a Controlled Substance with Intent to Deliver-Marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On June 1, 2010, he came before the Court for sentencing and received a 5 year prison sentence. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Dylan Culbertson appeared in Polk County District Court in criminal number FE 21764. Culbertson’s earlier granted suspended sentences and probation were revoked and he was sentenced to serve a term of imprisonment not to exceed ten years for the crime of Possession of a Controlled Substance With Intent to Deliver (cocaine) and up to five years in prison for the crime of Identity Theft. The sentences must be served consecutively to each other and Culbertson must serve a mandatory one-third of his ten year sentence before he is eligible for parole. Culbertson was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Linda Kay Bailey appeared before the court for a probation violation hearing in case number CR231011. The defendant stipulated to violating her probation by not meeting with her probation officer as ordered. The court revoked her deferred judgment and ordered her to remain in jail until space is available for her at the women’s residential correctional facility here in Des Moines.

On February 2, 2010, Defendant Jonathan W. Sharp entered a plea of guilty to the charges of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, and Failure to Possess a Tax Stamp as alleged in Count III of the Trial Information in violation of Iowa Code Section(s) 124.401(1)(d), 453B.3, and 453B.12, Class D Felonies. On June 1, 2010, Defendant Jonathan W. Sharp was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, and 5 years respectively for the charge of: Failure to Possess a Tax Stamp in violation of Iowa Code Section (s) 124.401(1)(d), 453B.3, and 453B.12. These sentences are to run consecutive to one another for a total period of 10 years. In addition, these sentences are suspended and the defendant is placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Jonathan W. Sharp was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 7, 2010, the jury returned a verdict of guilty as to the Defendant of the crimes of Count I Possession of a Controlled Substance, to wit: marijuana, in violation of Iowa Code sections 124.401(5) a serious misdemeanor and Count II Failure to Possess a Tax Stamp, in violation of Iowa Code Sections 453B.3 and 453B,12, a Class D Felony and Count III Operating a Motor Vehicle While Under the Influence of Alcohol, in violation of Iowa Code Sections 321J.2(1), a Serious Misdemeanor. On June 2, 2010, Robert Allan Wright, III, FECR232973, came before the Court on a motion for new trial and for sentencing. The Court denied the Defendant’s motion for a new trial and proceeded directly to sentencing. On count I the State of Iowa argued for 180 days in prison, on count II 5 years in prison and count III 365 days in prison. The State argued that all three counts should run consecutive to each other for a total period of incarceration not to exceed 6.5 years. The Defendant argued for 60 days in jail on count I; a deferred judgment on count II and a one year suspended sentence and probation in count III. The Court sentenced him to 90 days in prison on count I, 5 years in prison on count II and 48 hours in prison on Count III with a $1,250.00 fine which was not suspended. The Court ran all three sentences concurrent to each other for a total period of incarceration not to exceed 5 years. The Court set an appeal bond at $5,000.00 cash only. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Shandy Campbell was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE234384. She was sentenced to a maximum indeterminate term of ten (10) years in prison, but this sentence was suspended and she was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

David Stoner was sentenced for the crimes of Conspiracy to Manufacture a Controlled Substance, a Class C felony, and Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, in case number FE232072. He was sentenced to a maximum indeterminate term of ten (10) years and five (5) years in prison, consecutive, but this sentence was suspended and he was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Patrick Crandall was sentenced to prison in Polk County Criminal Number FECR235097 for a period not to exceed 25 years for the crime of Possession of a Controlled Susbtance with Intent to Deliver and for a period not to exceed 5 years for the crime of Failure to Possess a Tax Stamp. The Court ordered the sentences to be served consecutively for a total of 30 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

David Carmenatte appeared in Polk County District Court in criminal number FE 235810. Carmenatte pleaded guilty to Conspiracy to Deliver a Controlled Substance (methamphetamine). Carmenatte will be sentenced in July. Carmenatte is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Eloise Young Woods appeared in Polk County District Court in criminal number FE 234444. Woods pleaded guilty to Delivery of a Controlled Substance (cocaine base “crack”). Woods will be sentenced in July. Woods is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Ryan Gile – FECR219957 – This defendant appeared for a disposition of a probation violation having earlier stipulated that he violated the terms and conditions of his probation. The defendant’s probation was revoked and the original sentence was imposed. The defendant was sentenced to a period of imprisonment not to exceed 25 years and will be transported to the Iowa Medical and Classification Center at Oakdale.

State of Iowa v. Joel Miller – FECR236989 – This defendant pled guilty to Forgery, a Class D Felony, for using the credit card of his father without permission. The defendant made unauthorized charges totaling over $3,000 and admitted to his role in that crime. The defendant asked to be sentenced immediately and by joint recommendation of the parties he was sentenced to a term of incarceration not to exceed five years. He was immediately taken into custody by the Iowa Department of Corrections and transferred to the Iowa Medical and Classification Center in Oakdale.

State of Iowa v. Sang Nguyen – AGCR228504 and SRCR228573 – A probation hearing was held in this matter at which time the defendant stipulated to the violations as reported by the Department of Corrections. The court entered disposition revoking the defendant’s probation and imposing the original sentence entered on June 2, 2009. The defendant was taken into custody by the Iowa Department of Corrections and transferred to the Iowa Medical and Classification Center to serve a term of imprisonment not to exceed ten years.

State of Iowa v. Michelle Timm-Koch – FECR233975 – The defendant pled guilty to two counts of Theft in the Second Degree, both Class D Felonies, for her role in depositing insufficient checks and several banks and withdrawing funds that were not available. She admitted to the thefts and agreed to participate in a pre-sentence investigation report and sentencing was set for July 26, 2010, at 10:00 a.m. in room 204. At the time of sentencing the parties are expected to make a joint recommendation for a ten year suspended sentence, probation, full restitution.

The Fifth Judicial District Intensive Supervision Drug Court held its graduation over the noon hour in Courtroom 302 of the Polk County Courthouse. Drug Court is a comprehensive program which addresses all aspects of an addicts life. Restrictions on residence, employment and contact with family members is typical. The ultimate goal is long term life changes. The format of the program forces a participant to examine personal issues and participate in any treatment or counseling to fully address those issues.

Among those graduating are James Hobbs, David Blodgett, Richard Dameron, Melissa Parish, Rock Browning, Jason Cowman and Amanda Kleuskens. Arthur Lee, scheduled to graduate, was revoked from Drug Court May 28 after being arrested on a new charge of OWI and admitting that he had been drinking the night prior to his early morning arrest. Robert Taylor was also scheduled to graduate but was arrested on new charges of domestic violence on June 2, 2010.

James Hobbs was admitted to Drug Court on a reconsideration of his sentence in FE172148. He will be transferred to general supervision probation for a term of supervision of two (2) years. David Blodgett was admitted to Drug Court on a probation violation in FE210443. He will be transferred to general supervision probation for a term of at least six (6) additional months.

Richard Dameron pled guilty prior to entering Drug Court in FE217615 (Burglary 3rd Degree) and FE213600(Failure to Appear, 2 counts). He has successfully completed all requirements in Drug Court and was sentenced June 3, 2010 to a suspended ten (10) year sentence. He will be transferred to general supervision probation for a term of at least six (6) additional months.

Melissa Parish, Jason Cowman and Rock Browning all entered Drug Court prior to pleading guilty. As a condition of successful completion of the program, they each entered a plea of guilty June 3, 2010 to unrelated charges of possession of a controlled substance 3rd offense. In addition, Rock Browning and Melissa Parish stipulated they had previously been convicted of two prior felonies, which enhanced their sentences as habitual offenders. In FE219911 and FE220573, Jason Cowman pled guilty to two offenses of possession 3rd offense. He was sentenced to two five year terms of incarceration, consecutive, but suspended. In FE219373 Melissa Parish was sentenced and in FE221282 Rock Browning was sentenced each to a term of incarceration not to exceed fifteen (15) years with a mandatory minimum three (3) years if they are imprisoned. The Court suspended all sentences and placed each of the three on probation, pursuant to plea agreement. They will each be required to submit to the Department of Corrections supervision for a period of at least an additional six (6) months.

Amanda Kleuskens was sentenced in FE211038 on the charge of failure to affix a tax stamp. In FE213604 she entered a plea of guilty to Burglary 2nd Degree and was sentenced. Amanda was granted a suspended ten (10) year sentence and will supervised on probation for an additional term of at least six (6) months.

Each graduate of Drug Court is required to complete a rigorous period of intensive supervision and intensive substance abuse treatment. The term of the program is at least 16 months. The average participation length of successful graduates in over 20 months. Each graduate must have completed at least 75 hours of community service work, gotten financially responsible with child support, taxes, victim restitution and any other court ordered financial obligations. They must demonstrate an understanding of the 12-steps of recovery. They must have and maintain a sponsor throughout the course of the program. Each participant must have obtained his/her GED or completed high school. Many begin taking college courses while in the program. Each must become legally eligible to drive a motor vehicle, obtain his/her license and show proof of insurance. Each must have full-time and consistent employment. The program requires attendance at 12-step meetings at least every other day. Many participants obtain spiritual mentors and become reconnected with the church of their choice. Those who are graduating June 4, 2010 have maintained sobriety and abstinence from any illegal substance for at least 12 months. Several have been sober for over two years. All have provided urine analysis on a regular basis. Among this group of graduates there has been only one baby born, and she was born healthy and continues to be healthy.

On March 19, 2010, Jonathan Merryfield, FE233835, pled guilty to Possession of a Controlled Substance-Methamphetamine, third offense, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(5), a Class D Felony. On June 4, 2010, he came before the Court for sentencing and received a 5 year suspended sentence and probation with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Steven Shade, Jr. was sentenced in Polk County Criminal Number FECR235047 for the crime of Possession of a Controlled Substance with Intent to Deliver. Over the State’s objection, the Court granted Steven Shade, Jr. a deferred judgment and placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Michael Delateur FECR233149 was sentenced to probation for Theft in the 1st Degree. He was ordered to undergo a substance abuse evaluation and successfully complete all recommended treatment. The Court ordered that he have No Contact with the victim.

Waylon Trusdale pled guilty to two counts of Theft in the Third Degree in Polk County Criminal Case number FECR233440. The Court deferred judgment and placed the defendant on probation for two years. As a condition of probation, the defendant will be required to reimburse his victims for his thefts.

David Ullensvang pled guilty to Theft in the First Degree in Polk County Criminal case number FECR234356. The Court imposed a prison sentence of ten years, suspended the sentence and placed the defendant on probation for two years. As a condition of probation, the defendant was ordered to reside at the Residential Treatment Facility in Sheldon, Iowa and reimburse his victim for his theft.

On March 31, 2010, the jury returned a guilty verdict against Defendant Duvalmetrise Brown on the charges of: Possession of a Controlled Substance With Intent Deliver as alleged the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(c)(3). On June 4, 2010, Defendant Duvalmetrise Brown was sentenced to a period of incarceration not to exceed 30 years for the charges of: Possession of a Controlled Substance With Intent Second and Subsequent Offender, and a Habitual Offender as alleged in the Trial Information, in violation of Iowa Code Section (s) 124.401(1)(c)(3), 124.411, and 902.8. The defendant shall be committed to the custody of the Director of the Iowa Department of Corrections. Duvalmetrise Brown, was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
