7/6/2010

Ramiro Dominquez Torres pled guilty to Forgery as an aggravated misdemeanor in FE236873 for being in possession of a forged permanent resident alien card. The Defendant was granted with the expectation that he would be deported on the ICE hold current in place.

Justin Bensley pled guilty to Burglary 3rd Degree after breaking into Rusty’s Lounge when it was closed with the intent to steal liquor. Sentencing was set out until August 19, 2010 to allow the Department of Corrections to complete a Pre-Sentence Investigation Report. At sentencing, the parties are expected to request the Court grant Bensley a Deferred Judgment.

Dustin Bean was sentenced this date to reside at the Honors Program at the Fort Des Moines Facility. The Defendant pled guilty to Possession of Burglary Tools and stipulated to violating the terms and conditions of his probation. Bean successfully complete a residential treatment program and will begin employment and aftercare upon his transfer to the Honors Program.

Marcus Alan Johnson pled guilty and was sentenced in FE236292 on the charge of Willful Injury causing Bodily Injury, a lesser offense of that originally charged for his role in a stabbing assault of Ralph Bullard. The Defendant waived further time and requested immediate sentence. The Court sentenced the Defendant to a period of incarceration not to exceed five (5) years.

Amanda Dawn Logan pled guilty to Theft 2nd Degree for presenting a forged check to her bank for deposit and then drawing money on the account. Sentencing was set out to August 17, 2010 to allow the Department of Corrections to complete a Pre-Sentence Investigation Report. At the time of sentencing, the parties will recommend Logan receive a Deferred Judgment.

Clifford Rice, Jr. was sentenced to prison in Polk County Criminal Number FECR2335567 for a period not to exceed 15 years for the crime of Conspiracy to Manufacture a Controlled Substance – Methamphetamine as a Habitual Offender; for a period not to exceed 5 years for the crime of Possession of Ephedrine or Pseudoephedrine with Intent it be Used to Manufacture a Controlled Substance; and for a period not to exceed 5 years for the crime of Possession of Lithium with Intent it be Used to Manufacture a Controlled Substance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Michelle Mireles a/k/a Lewis was sentenced in Polk County Criminal Number FECR235406 for the crime of Possession of a Controlled Substance with Intent to Deliver - Cocaine Salt Hyrdochloride. The Court granted Michelle Mireles a/k/a Lewis a deferred judgment and placed her on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Melissa Corbin pled guilty in Polk County Criminal Number FECR234147 to the crimes of Conspiracy to Deliver a Controlled Substance, Possession of a Controlled Susbtance with Intent to Deliver, and Failure to Possess a Tax Stamp. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 6, 2010, Robert Clarey pled guilty to Domestic Abuse Assault. Clarey received a deferred judgment and was assessed a $65.00 civil penalty. Clarey was placed on probation for 1 year and required to obtain a substance abuse evaluation and complete the 24 week Batterer's Education Program.

On July 6, 2010, Sydney Elise Anderson pled guilty to Assault. Anderson was placed on probation for 1 year and fined $65.00. Anderson was required to participate in the Assaultive Behavior Class, obtain a substance abuse evaluation, and abide by a 5 year No-Contact Order.

On July 6, 2010, William Julius Miller, Sr. pled guilty to Domestic Abuse Assault with Intent to Inflict Serious Injury and False Imprisonment. Miller was ordered to serve 29 days in jail and then placed on probation for 2 years. Miller was fined $940.00 and required to obtain a psychological evaluation and complete the 24 week Batterer's Education Program.

On July 6, 2010, Allen James Bush pled guilty to Domestic Abuse Assault Causing Bodily Injury. Bush received a deferred judgment and was assessed a $315.00 civil penalty. Bush was placed on probation for 1 year and required to complete 40 hours of community service. Bush was required to complete the 24 week Batterer's Education Program and abide by a 5 year No-Contact Order.

Carlos Guevara was sentenced to prison in Polk County Criminal Number FECR236003 for a period not to exceed 25 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

James Moulton pled guilty in Polk County Criminal Number FECR235955 to Possession of a Controlled Substance with Intent to Deliver – Marijuana. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On February 18, 2010, Allan Dale Fattig, FECR234134, pled guilty to Delivery of a Controlled Substance, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony, Possession of a Controlled Substance with Intent to Deliver, as alleged in Count III of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony and Possession of Lithium with Intent it be used to Manufacture a Controlled Substance, as alleged in Count IV of the Trial Information, in violation of Iowa Code Section 124.401(4), a Class D Felony. On July 7, 2010, he came before the Court for sentencing and received a 10 year prison sentence on Counts I and III and a 5 year prison sentence on Count IV. The Court ran Counts I and III consecutive to each other for a 20 year prison sentence. Count IV ran concurrent with Counts I and III. All fines were suspended due to the defendant’s incarceration. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Pedro Olmos stipulated to violating the terms and conditions of his probation in FE229174. Olmos had been sentenced to prison for Conspiracy to Commit a Forcible Felony for a term of incarceration not to exceed ten (10) years. The Court granted a reconsideration of his sentence. While on probation, Olmos missed curfew, drank, was arrested on new charges of supplying alcohol to a minor and failed to have any employment. Disposition will be held July 26, 2010.

Stephen Lee Vaughn was revoked from his probation after stipulating he violated the terms and conditions of his probation by absconding supervision for 10 months. Vaughn requested placement at the Fort Des Moines Facility rather than prison. The Court imposed the original sentences for a total period of incarceration not to exceed nine (9) years and six (6) months.

Jared Piper stipulated he violated the terms and conditions of his probation by failing to cooperate with certain requirements in a timely manner and by having photographs he was not allowed to have. The Court ordered his probation extended and ordered him to have full time employment within 30 days of the order.

Frederick Bell pled guilty in FE236579 to Criminal Mischief 2nd Degree for driving his car into a Red Roof Inn. Disposition was set out to August 13, 2010. Bell is on parole for other matters as well.

Amber Foland stipulated to being in violation of the terms and conditions of her probation by using marijuana. She agreed to placement at the House of Mercy and continued probation.

Charles Rutan pled guilty and agreed to be sentenced to prison in FE235683 and FE236009. He pled guilty to two counts of Forgery and one count of Theft 2nd Degree. The State agreed to dismiss a number of charges, though Rutan will be responsible for restitution on all matters. The Defendant was sentenced to a term of incarceration not to exceed five (5) years on each offense, consecutive, for a total term of imprisonment of 15 years.

On July 7, 2010, Frank King Renfro pled guilty to Domestic Abuse Assault Causing Bodily Injury. Renfro received a deferred judgment and was assessed a $315.00 civil penalty. Renfro was placed on probation for 1 year and required to participate in the 24 Batterer's Education Program and abide by a 5 year No-Contact Order.

State of Iowa v. Jeff Massey – FECR228011 – The defendant stipulated that he violated the terms and conditions of his probation as alleged in the Report of Violations for leaving the state of Iowa and losing contact with his probation officer for approximately seven months. The defendant’s probation was revoked and he was ordered to serve the original sentence of five years in prison.

State of Iowa v. David Brinson – FECR222177; AGCR217939; SRCR235770 – The defendant stipulated that he violated the terms and conditions of his probation by committing a new offense of Theft in the Fourth Degree. He was ordered to serve 60 days contempt in the Polk County Jail and taken into custody immediately. All but four of those contempt days are suspended and when the defendant is released he is to complete 100 hours of community service by December 16, 2010. If the defendant fails to complete the additional community service he will have to serve the remaining 56 days of contempt time.

Jessica Millsap pled guilty in FE236470 to the charge of Fraudulent Practice 3rd Degree and AG234896 to the charge of Driving while Barred. She was granted a 2 year suspended sentence. The Court ordered her to pay a fine of $625 plus 35% surcharge, complete 25 hours of community service work, attend a life skills class and make restitution. Pursuant to the plea agreement, the State dismissed two traffic offenses and a driving while barred charge.

Joshua Farrell pled guilty to Fraudulent Practice 2nd Degree in FE234211. Farrell admitted he asked a friend to all in his unemployment claim while Farrell was in jail so Farrell could receive money he then used to make his car payments. The Court was reluctant to grant probation without the use of a pre-sentence investigation report. Sentencing is set for August 23, 2010.

Brenda Jones failed to appear for a pre-trial conference on July 8, 2010 on the charge of Fraudulent Practice 2nd Degree. A warrant was issued for her arrest.

Renee Lehman appeared in Polk County District Court in criminal number FE 23076. Lehman pleaded guilty to Conspiracy to Manufacture a Controlled Substance (methamphetamine). Lehman will appear in August for sentencing. Lehman is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Laura Hodson appeared in Polk County District Court in criminal number FE 235018. Hodson was sentenced on a charge of Possession of a Controlled Substance with Intent to Deliver (methamphetamine). Hodson was granted a suspended sentence and placed on probation. She was fined $1000.00 and must complete substance abuse treatment. Hodson was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 8, 2010, Ryan Ray Gist stipulated to willfully violating a No Contact Order on June 19, 2010. Gist was found in contempt and sentenced to 30 days in jail.

On July 8, 2010, Travis Colton Williamson stipulated to violating the terms of probation. Williamson was found in contempt and ordered to serve 10 days in jail and then continue with the original terms of probation.

On July 8, 2010, Munchelo Dock stipulated to willfully violating a No Contact Order on June 23, 2010. Dock was found in contempt and ordered to serve 180 days in jail.

Jeffory Davis was sentenced in Polk County Criminal Number FECR231944 to an indeterminate term of incarceration not to exceed 10 years for the crime of Conspiracy to Manufacture a Controlled Substance and for a period not to exceed 5 years for the crime of Burglary in 3rd Degree. The Court granted Jeffory Davis a suspended sentence and placed him on probation for a period of 5 years after he successfully completed a residential substance abuse treatment program sponsored by the Polk County Jail. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Kevin Dwight Underwood stipulated to violating his probation and was sentenced to up to seven years in prison.

Sergio Retana, Jr. stipulated to violating his probation and was sentenced to up to five years in prison.

Shawn Guhl was sentenced to up to 10 years in prison for two counts of Interference with Official Acts with a Weapon.

Jane Darlene Morgan was arraigned and pled guilty to Theft in the First Degree. Sentencing is set for August 27th at 10 a.m.

Brooks Ennis was continued on probation after successfully finding a job.

Abdur Kashif was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, as a habitual offender and a second or subsequent offender in case number FE231758. He was sentenced to a maximum indeterminate term of twenty-five (25) years with a mandatory one-third term which he must serve prior to becoming eligible for parole, but this sentence was suspended and he was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Francisco Marquez and Juan Anchondo plead guilty and were sentenced for the crime of Conspiracy to Deliver a Controlled Substance, a Class B felony, in case numbers FE235761 and FE235753. These defendants admitted that they conspired to deliver over three hundred (300) pounds of marijuana. Each was sentenced to a maximum indeterminate term of twenty-five (25) years. These defendants were prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Jermaine Trio Jackson FECR218495 The defendant in this case, Jermaine Trio Jackson, plead guilty to Serious Injury by Vehicle by Reckless Driving, Count I and Operating a Motor Vehicle While Under the Influence of Alcohol or Drug, Count II on July 9, 2010. The Court accepted the defendant’s pleas of guilty and set sentencing for August 25, 2010, at 10:30 a.m. The defendant faces a maximum penalty of five years in prison on Count I and one year in prison on Count II. The defendant will be eligible for a suspended sentence at sentencing. The charges arose on November 18, 2007, when the defendant, Jermaine Trio Jackson, who was the driver of a vehicle, traveling eastbound on Hickman Road just west of Martin Luther King when his car struck a second motor vehicle that was trying to turn left. The accident resulted in serious injuries to a passenger in the defendant’s car and two of the occupants in the other car.

On July 9, 2010, Preston Daniel Owen pled guilty to Harassment 3rd Degree and Trespass Causing Damage. Owen was placed on probation for 1 year and fined $315.00. Owen was required to abide by a 1 year No-Contact Order.
