Iowa D N R assumes responsibility for RICE NESHAP

The Iowa Department of Natural Resources (DNR) adoption of the 2010 and 2013 RICE NESHAP amendments became effective today, October 23, 2013.  This means that DNR, rather than EPA, is now the primary authority for RICE implementation in Iowa. RICE NESHAP is the acronym for National Emission Standards for Hazardous Air Pollutants (NESHAP) for Stationary Reciprocating Internal Combustion Engines (RICE) (40 Code of Federal Regulations (CFR) Part 63, Subpart ZZZZ).

 

DNR has posted a document on the Air Toxics-NESHAP page that explains how the transfer of responsibilities from EPA to DNR and to the Polk and Linn County air agencies is being handled. The document addresses logistical questions such as where RICE notifications and reports should be sent, and which agency will review stack testing being conducted in late 2013.

 

Compliance assistance tools posted on DNR’s website

DNR has also created several compliance assistance tools for facilities subject to the RICE NESHAP.  These tools, along with information about other regulations that affect engines, are posted on the DNR Air Toxics-NESHAP website or at http://www.iowadnr.gov/InsideDNR/RegulatoryAir/AirToxics-NESHAP.aspx - scroll down to “Reciprocating Internal Combustion Engines (RICE)”. Construction permit amnesty for engines

The DNR and Polk and Linn County air agencies want to assist facilities in complying with all applicable regulations, including air quality construction permit requirements. For facilities that do not have the required permits for engines that have been installed or modified, or that have not submitted required permit-related notifications or registrations, the DNR and Polk and Linn County air agencies are providing an opportunity to comply with these requirements without enforcement actions and penalties.
