Chad Ebelheiser was sentenced for the crimes of Delivery of a Controlled Substance, methamphetamine, Class C felonies, two counts, in case FECR215107. He was sentenced to a maximum indeterminate term of ten (10) years on each count ad these sentences were ordered to be served consecutively. These sentences were suspended and the defendant was placed on probation for two years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Nathaniel Potter was sentenced today based on his plea to one count of Theft in the Second Degree, a Class D felony. He was sentenced to serve 5 years in prison, the sentence was suspended and he was placed on probation for 2 years. The defendant was accused of purchasing stolen motorcycles.
On May 21st, 2008, Sarah Beth Duberstein, FECR217891, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On July 7th, 2008, she received a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On or about May 21st, 2008, Zacharia Garwick, FECR217890, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On July 7th, 2008, he came before the Court for sentencing. The State argued for a 5 year suspended sentence and probation. The Defendant argued for a deferred judgment. The Court granted him the deferred judgment and placed him on probation for two years with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On or about May 16th, 2008, Ramon Barraza, FECR218921, pled guilty to Possession of a Controlled Substance with Intent to Deliver-cocaine salt hydrochloride, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(2)(b) and 124.401(1)( c )(2)(d), a Class C Felony. On July 7th, 2008, he received from the Court a deferred judgment and probation with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Raymond Hines plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, cocaine base “crack”, With Intent to Deliver, a Class C felony, in case FECR217842. He was sentenced to a maximum indeterminate term of ten (10) years and must serve a mandatory minimum term of one-third before he is eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Shayla Ousley received a Deferred Judgment for the crime of Possession of a Controlled Substance with Intent to Deliver, in violation of Iowa Code Section 124.401(1)(c)(3), a Class C Felony and Failure to Possess a Tax Stamp, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. Ousley pled guilty on May 20, 2008 and has completed substance abuse treatment prior to sentencing. Ousley was prosecuted by the Drug and Gang Bureau.
Melissa Anderson was sentenced for the crimes of Possession of a Controlled Substance with Intent to Deliver, in violation of Iowa Code Section 124.401(1)(c)(3), a Class C Felony and Failure to Possess a Tax Stamp, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. Anderson pled guilty on May 13, 2008. Anderson was placed on Intensive Supervision Probation with the added condition she reside at the Women’s Correctional Facility if required by her probation officer. Anderson was prosecuted by the Drug and Gang Bureau.

On April 23, 2008, Adam Patrick Cline, FECR218367, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony and Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. On July 8th, 2008, this case came before the Court for sentencing. The State argued for a 5 year prison sentence on Count I and Count II. The Defendant argued for a 5 year suspended sentence and probation on Count I and Count II. The Court sentenced him to 5 years in prison on Count I and Count II, but ran them concurrent to each other for a total period of incarceration not to exceed 5 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Emma Jean McAllister FECR218721 was sentenced on Child Endangerment. She had bitten a child that was in her custody and control. The Court rejected the defendant’s request for a deferred judgment and placed her on probation with a suspended sentence. Ms. McAllister was ordered to complete anger management classes, complete mental health treatment and have no contact with any minors until anger management classes are completed and the probation officer approves of the no contact order modification.
Anthony Rhodd was sentenced to a term of prison for his conviction on Burglary in the First Degree and Sexual Abuse in the Second Degree stemming from a break in and rape at a south side Des Moines apartment. Rhodd, a previously convicted felon on other burglary charges, will have to serve at least 70% of 25 years before he is eligible for parole. Additionally, he will be on the Sex Offender Registry and under the supervision of the Department of Corrections for life.
