WEEKLY CASE SUMMARY
09/15/2008 Jonathon Green was sentenced in Polk County Criminal Number FECR220257 to an indeterminate term of incarceration not to exceed 10 years for the crime of Conspiracy to Deliver a Controlled Substance - Cocaine Base "Crack," to an indeterminate term of incarceration not to exceed 5 years for the crime of Failure to Possess a Tax Stamp, and to an indeterminate term of incarceration not to exceed 5 years for the crime of Conspiracy to Deliver a Controlled Substance - Marijuana. The Court granted Jonathon Green a suspended sentence and placed him on probation for a period of 2 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Nathan Farrar was sentenced in Polk County Criminal Number FECR220334 to an indeterminate term of incarceration not to exceed 5 years for the crime of Possession of a Controlled Substance (Third Offense). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Larry John Austin, FECR218643, pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation or Subterfuge, as alleged in Count I, in violation of Iowa Code Sections 124.401(1)(c)(8), 155A.23 and 155A.24, a Class C Felony. The defendant waived time and notice and agreed to immediate sentencing. The Court granted him a deferred judgment and placed him on probation for two years with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jason Greteman was sentenced in Polk County Criminal Number FE 219791. Greteman earlier pleaded guilty to Conspiracy to Deliver a Controlled Substance (methamphetamine) and Failure to Possess a Tax Stamp. Greteman was ordered to prison for a term not to exceed ten years on the conspiracy charge and five years on the tax stamp charge. The sentences are to be served consecutively to each other and Greteman must serve a mandatory minimum one-third of the ten year sentence before he is eligible for parole. Greteman was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Alisha Haley entered a plea of guilty to the charge o Burglary in the Third Degree. She was sentenced to a term of incarceration not to exceed five (5) years. That sentence was run consecutively to a prior sentence.

Joshua Gustafson stipulated that he violated the terms and conditions of his probation. His probation was revoked and he was adjudged guilty of Willful Injury Causing Bodily Injury and Driving While Barred. He was ordered to be imprisoned for a period not to exceed five (5) years on the Willful Injury charge and two (2) years on the Driving While Barred charge.

Raymond Newton, Jr. stipulated that he violated the terms and conditions of his probation. The court continued the defendant’s probation but ordered that he serve 20 days in the Polk County jail for Contempt of Court.

09/16/2008 James Odegaard, FE211392, OM63786, appeared for a probation violation hearing. Def stipulated to the report of violations and was ordered to be monitored for alcohol consumption by VICAP and be evaluated for out patient treatment and continue on probation.

Zagory Harris, FE221092, appeared for a guilty plea and sentencing. Def pleaded to Robb 2 and two counts of conspiracy to commit a forcible felony. By joint agreement of the parties the defendant was sentenced to 10 years on Robb 2 and ten years on each of the remaining counts. Defendant received a 10 year prison sentence with a minimum of 7 years before being eligible for parole.

Phillip Tooth, FE214401, appeared for a probation hearing (Theft 1st and conspiracy to commit a forcible felony) and stipulated to the violations and by agreement of the parties was ordered to serve 27 days contempt and then reside at the men’s residential facility until maximum benefits are achieved.

Jason Royce plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class B felony, in case FECR216325. He was sentenced to a maximum indeterminate term of twenty-five (25) years in prison and must serve a mandatory one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jason Palmer plead guilty to and was sentenced for the crimes of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, in case FECR216324. He was sentenced to maximum indeterminate terms of incarceration of ten (10) years and five (5) years which were run consecutive to each other for a total of fifteen (15) years. He must serve a mandatory one-third of the ten (10) year sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

09/17/2008 On July 31st, 2008, Kurt Thomas Adamson, FECR216229, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On September 17th, 2008, he came before the Court for sentencing. The State argued for a 5 year suspended sentence and probation. The Defense argued for a deferred judgment and probation. The Court granted him a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Marshall Newman was sentenced to prison in Polk County Criminal Number FECR206337 for a period not to exceed 10 years for the crime of Delivery of a Controlled Substance as a Second or Subsequent Offender. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

William Ruano was sentenced to prison in Polk County Criminal Number FECR221301 for a period not to exceed 10 years for the crime of Intimidation with a Dangerous Weapon and for a period not to exceed 5 years for the crime of Criminal Gang Participation. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

09/18/2008 Jamie Horner was sentenced for the crime of Conspiracy to Deliver a Controlled Substance, cocaine, a Class B felony, in case FECR219818. Judgment was deferred in his case and he was placed on probation for a two year term. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 23rd, 2008, Steven W. Russell, FECR219237, pled guilty to Failure to Possess a Tax Stamp without enhancement, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. On September 18th, 2008, he came before the Court for sentencing. Both parties recommended that he be incarcerated for 5 years. The Court sentenced him to prison for 5 years and ordered said sentence run consecutive to his outstanding parole. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
