WEEKLY CASE SUMMARY
10/13/2008 Asmir Telbiz appeared for an Arraignment on the charge of Attempted Burglary in the 2nd Degree. His PTC is set for November 13, 2008, at 1:45 PM in Room 204 and the TD is set for December 14, 2008, at 9 AM in Room 204.

Michael Carpenter, FE221527, appeared for sentencing on the charge of Criminal Mischief 2nd, a Class D Felony. The State recommended a suspended sentence with probation and the defense recommended a deferred judgment. The defendant received a deferred judgment and was placed on probation for 2 years. The defendant was also required to obtain a substance abuse and anger management evaluation and abide by all recommended treatment.

Dustin Miller, FE220923, pleaded guilty to the crime of Willful Injury Causing Bodily Injury, a Class D felony. The sentencing is set for November 24, 2008, and at such time the State and defense will be free to argue any legal disposition.

On August 26th, 2008, Jeffrey L. Steenhoek, SRCR220527, pled guilty to possession of a controlled substance-marijuana, third offense, as alleged in the TriaI Information, in violation of Iowa Code Section 124.401(5), a Class D Felony without the habitual offender enhancement. On October 13th, 2008, he came before the Court for sentencing. The Court granted him a 5 year suspended sentence and probation with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/14/2008 Kurt Sather was sentenced Polk County Criminal Number FECR221775 to an indeterminate term of incarceration not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver - MDMA (Ecstasy), to an indeterminate term of incarceration not to exceed 5 years for the crime of Failure to Possess a Tax Stamp, and to an indeterminate term of incarceration not to exceed 5 years for the crime of Possession of a Controlled Substance with Intent to Deliver - Marijuana. The Court granted Kurt Sather a suspended sentence and placed him on probation for a period of 2 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/16/2008 James Magneson plead guilty to and was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony and Possession of Anhydrous Ammonia With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony in case FECR220793. He was sentenced to a maximum indeterminate term of twenty (20) years and will be required to serve a mandatory minimum term of one-third of the first ten (10) year sentence before he is eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/17/2008 Chanda Amy Johnson, FECR221745, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. The defendant waived time and notice, and waived the right to file a motion in arrest of judgment and to have the use of a PSI report and requested immediate sentencing. The Court granted her a deferred judgment and probation with the applicable civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Deandre Smith was sentenced for the crime of Delivery of a Controlled Substance, a Class C felony, in case FECR219335. He was sentenced to a maximum indeterminate term of ten (10) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
