WEEKLY CASE SUMMARY
10/20/2008 Joshua Mason was sentenced before Judge Carla Schemmel. Mason pled guilty on April 9, 2008 to the charges of Possession with Intent to Deliver a Controlled Substance, Conspiracy to Deliver a Controlled Substance and Failure to Possess a Tax Stamp. Mason completed the In Jail Treatment Program and received a suspended sentence and probation. As a condition of probation Mason must remain in custody until there is a bed available at the Fort Des Moines Residential Facility. Mason was prosecuted by the Drug and Gang Bureau.

Gregory A. Brown appeared before the Honorable Carla T. Schemmel for purposes of a probation violation hearing. The defendant, who was placed on probation for Conspiracy to Manufacture a Controlled Substance – Methamphetamine and Possession of Ephedrine or Pseudoephedrine with the Intent it be Used to Manufacture a Controlled Substance, admitted he violated the terms and conditions of his probation by continuing to use methamphetamine. Over the State’s objection and notwithstanding the fact that the defendant had previously been sent to prison, had been granted a reconsideration of sentence, had previously received substance abuse treatment on two prior occasions, and had spent considerable time at a halfway house, the Court continued the defendant on probation and ordered him to complete a third substance abuse program and return to another halfway house. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Daniel Petrie was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, as a second or subsequent offender in case FECR220065. He was sentenced to a maximum indeterminate term of thirty-five (35) years and must serve a mandatory minimum term of one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Philip Norris was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case FECR220510. He was sentenced to a maximum indeterminate term of ten (10) years, but this sentence was suspended and he was placed on probation for a term of two years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Tammy Tyler was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case FECR210760. Judgment was deferred and she was placed on probation for a term of two years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/21/2008 Maria Barbosa-Quinones and Felipe Rodriguez-Santiago were convicted at a jury trial of Forgery, a Class D felony, in case numbers FECR221881 and FECR221890. Each was found in possession of a forged social security card during the execution of a search warrant at their residence. Each defendant was sentenced to a maximum indeterminate term of five (5) years, this sentence was suspended and each was placed on probation for a term of two (2) years. These defendants were prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Cesar Zamora a/k/a "Creeper" was sentenced to prison in Polk County Criminal Number FECR221300 for a period not to exceed 10 years for the crime of Intimidation with a Dangerous Weapon and for a period not to exceed 5 years for the crime of Criminal Gang Participation. The case stemmed from a drive by shooting between rival gang members on the south east side of Des Moines. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Justan Shipley pled guilty to Possession of a Controlled Substance with Intent to Deliver in Polk County Criminal case number FECR220940. The Court sentenced the defendant to a five year prison term, suspended that sentence and placed the defendant on probation although he was already on probation for a prior felony drug charge. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.



On May 30, 2008, Douglas Schuessler was charged with Possession of a Controlled Substance (Third or Subsequent Offense), to wit: Methamphetamine, in Polk County Criminal Case number FE220618. On June 9, 2008, the defendant was ordered to have a substance abuse evaluation as a condition of his release.

The defendant had previously been granted a deferred judgment for Possession of a Controlled Substance and had four other convictions for Possession of a Controlled Substance, a conviction for Operating a Motor Vehicle while Under the Influence of an Alcoholic Beverage and a conviction for Domestic Abuse Assault. As recently as 2006, the defendant was granted probation for the fourth time for Possession of a Controlled Substance. In 2007, the defendant violated his probation and was found in contempt.

On August 27, 2008, the defendant pled guilty to Possession of a Controlled Substance (Third or Subsequent Offense) and sentencing was set for October 13, 2008. On October 12, 2008, the defendant did appear for sentencing but he had not completed his required substance abuse evaluation. Judge Carla T. Schemmel ordered the sentencing reset so the defendant could have an evaluation. On October 21, 2008, the defendant appeared again in front of Judge Schemmel for sentencing. Over the objection of the State, the defendant was granted another deferred judgment and placed on probation. The Court indicated that she was granting the defendant a deferred judgment because he was employed (through a family-owned business) and because he had a substance abuse evaluation. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

10/23/2008 Danny Ames was sentenced before judge Carla T. Schemmel. Ames pled guilty to Manufacturing a Controlled Substance-Marijuana, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony, on September 12, 2008. Ames received a Deferred Judgment and was placed on probation for two years. Ames was prosecuted by the Drug and Gang Bureau.

Murray Ford was sentenced before Judge Carla T. Schemmel for the crime of Possession with Intent to Deliver-Cocaine Base Crack, in violation of Iowa Code Section 124.401(1)(c)(3), a Class C Felony. Ford pled guilty on November 17, 2007. Subsequently, Ford was allowed to participate in the In Jail Treatment Program over the State’s objection. Ford failed to appear for trial on this charge because he was robbing a bank. Ford was ultimately convicted of Robbery in the 2nd Degree for his participation in that crime. Ford was sentenced to 10 years in prison for the drug charge which was run consecutive to his robbery sentence for an indeterminate term of incarceration not to exceed twenty (20) years. Ford must serve 70% of the Robbery 2nd sentence and 1/3 of his sentence for the drug charge. Ford was prosecuted by the Drug and Gang Bureau.
