Justin Phillip Silvers pled guilty in FE228886 to the charge of Attempted Burlgary
3rd Degree for trying to break into or enter a private residence for the purpose
of committing a theft. He will be sentenced on February 25, 2010 following a pre-sentence
investigation.
Abram Nathaniel Magang stipulated to violating his probation by failing to go through
probation intake and being arrested for OWI. He is to remain in the Polk County
Jail until an opening arises at the Fort Des Moines Facility, where he will remain
until he receives maximum benefits.
Morice Drew Jones stipulated to violating his probation because of failure in the
Mt. Pleasant treatment program. He was admitted to the in-jail treatment program
for substance abuse.
Nathaniel Potter appeared in Polk County District Court in criminal numbers FE 232663
and FE 217882. In FE 232663, Potter pleaded guilty to and was sentenced for the
crime of Possession of a Controlled Substance With Intent to Deliver (in excess
of five grams of methamphetamine). Potter was sentenced to a term not to exceed
25 years and must serve a mandatory minimum one-third before being eligible for
parole. He received a one-third reduction from his minimum based on his pleading
guilty and accepting responsibility. In FE 217882, Potter agreed he’d violated the
probation granted him on a charge of Theft in the Second Degree. He was sentenced
to a term of imprisonment not to exceed five years on the theft charge. The sentences
imposed are to be served consecutively to each other. Potter was prosecuted by the
Polk County Attorney’s Office Drug and Gang Bureau.
On December 1, 2009, Defendant Anthony B. Heer entered a plea of guilty to the charge
of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code
Section(s) 124.401(5), a Class D Felony. On January 11, 2010, Defendant Anthony
B. Heer, was sentenced for a period not to exceed 5 years for the charge of: Possession
of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5),
a Class D Felony. The sentence in this case was suspended, and the defendant was
placed on probation for a period of 5 years to be supervised by the Fifth Judicial
District Department of Correctional Services. Anthony B. Heer was prosecuted by
the Polk County Attorney’s Office Drug and Gang Bureau.
