Weekly Case Summary

Justin Phillip Silvers pled guilty in FE228886 to the charge of Attempted Burlgary 3rd Degree for trying to break into or enter a private residence for the purpose of committing a theft. He will be sentenced on February 25, 2010 following a pre-sentence investigation.

Abram Nathaniel Magang stipulated to violating his probation by failing to go through probation intake and being arrested for OWI. He is to remain in the Polk County Jail until an opening arises at the Fort Des Moines Facility, where he will remain until he receives maximum benefits.

Morice Drew Jones stipulated to violating his probation because of failure in the Mt. Pleasant treatment program. He was admitted to the in-jail treatment program for substance abuse.

Nathaniel Potter appeared in Polk County District Court in criminal numbers FE 232663 and FE 217882. In FE 232663, Potter pleaded guilty to and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver (in excess of five grams of methamphetamine). Potter was sentenced to a term not to exceed 25 years and must serve a mandatory minimum one-third before being eligible for parole. He received a one-third reduction from his minimum based on his pleading guilty and accepting responsibility. In FE 217882, Potter agreed he’d violated the probation granted him on a charge of Theft in the Second Degree. He was sentenced to a term of imprisonment not to exceed five years on the theft charge. The sentences imposed are to be served consecutively to each other. Potter was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 1, 2009, Defendant Anthony B. Heer entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. On January 11, 2010, Defendant Anthony B. Heer, was sentenced for a period not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. The sentence in this case was suspended, and the defendant was placed on probation for a period of 5 years to be supervised by the Fifth Judicial District Department of Correctional Services. Anthony B. Heer was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 28th, 2009, Nicole Carter-Allen, FECR230359, pled guilty to Conspiracy to Deliver a Controlled Substance-cocaine base “crack”, as alleged in Count I of Trial Information, in violation of Iowa Code Section 124.401(1)( c )(3), a Class C Felony. On January 12, 2010, she came before the Court for sentencing and received a 10 year suspended sentence and probation with the applicable $1,000.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Michael Kilpatrick was sentenced in FE231618 on one count each of Theft 2nd Degree and Burglary 3rd for crimes he committed in August 4, 2009. The Court sentenced Kilpatrick to two five years terms, consecutive to each other, but suspended and granted him probation with conditions that he provide UA's, obtain a substance abuse evaluation and comply with treatment recommendations. He must maintain full time employment and participate in any other programming deemed appropriate. He is also subject to a No Contact Order with the victim and the business he burgled.

Nicole Trotter appeared to answer charges of a probation violation. She pled guilty to two new charges of Criminal Trespass and Theft 5th Degree in FE233586 for entering her employment after hours and stealing money. She had previously been granted a Deferred Judgment on the charge of Fraudulent Practice 2nd Degree in FE216538. Because of her probation violations, the Court entered judgment against her for the Fraudulent Practice charge and placed her on probation pending placement at the Women's Residential Facility in Ames, Iowa.

Gary Albert Robinson, Jr. pled guilty to Voluntary Absence for walking away from the Fort Des Moines Residential Facility. He was sentenced to 30 days in jail. In addition, he was found in violation of his probation. The Court ordered him to undergo a substance abuse evaluation and comply with treatment recommendations. He will then be returned to the Fort Des Moines Residential Facility.

Star June Griffin pled guilty to several misdemeanor offenses in FE233072. Griffin took socks from Walmart and then tried to leave with out paying for them. When she was stopped by store security and engaged in a struggle with the loss prevention officers, spraying one in the face with feminine spray. When the police arrived, she gave them a different name. When she was taken to the hospital to treat some injuries she complained of, she gave the hospital an incorrect name. When she was booked into the jail she again gave a different name. She pled guilty to Interference, Harassment of a Peace Officer, Disorderly Conduct and Theft 5th. She was sentenced to 30 days on each offense, consecutive for 120 days. She also pled guilty to Assault Causing Injury and was granted a suspended 1 year sentence and placed on probation. At the time she committed the offense, she was on probation under a deferred judgment for forgery, an aggravated misdemeanor inAG226540. As a result of the plea in FE233072, she stipulated to being in violation of her probation. The Court revoked her deferred judgment and was sentenced two two years which was suspended to allow the Defendant to complete probation.
