State of Iowa v. Metrick Lawen Jenkins FECR232316
Metrick Lawen Jenkins plead guilty on February 22, 2010 to Homicide by Vehicle by
OWI – Count I and Serious Injury by Vehicle by OWI – Counts II and III.
The charges arose on September 21, 2009 when the defendant, Metrick Jenkins, was
driving a 2003 Chevrolet Cavalier while under the influence of alcohol. He was traveling
eastbound on East Birdland Drive, at a high rate of speed, when he lost control
of the vehicle and crashed into a bridge embankment which was adjacent to Birdland
Marina. The defendant had three passengers in the car with him at the time of the
accident. Heavan Chumos died from injuries she received in the accident. Julie Edwards
and Carla Chiles were seriously injured, but survived the crash. The defendant,
Metrick Jenkins, was also seriously injured.
At this plea of guilty, the defendant admitted to being under the influence of alcohol
at the time of the crash and that that was the cause of the crash. The defendant
admitted that he unintentionally caused the death of Heavan Chumos and unintentionally
caused the serious injuries to Julie Edwards and Carla Chiles.
Following his plea of guilty, the defendant asked for immediate sentencing. The
court granted his request and sentenced the defendant to 25 years in prison on Count
I and 10 years in prison on each of the Counts II and III. The defendant’s sentences
were run concurrently for a total of 25 years.
On January 11, 2010, Zachary Elijah Swim, FECR232951, pled guilty to Possession
of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count
I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class
D Felony. On February 22, 2010, he came before the Court for sentencing. The State
of Iowa argued for a 5 year suspended sentence and probation with the applicable
$750.00 fine. The Defendant was on probation for OWOM067023 when he picked up this
charge and had also received a deferred judgment on a possession charge two years
prior. The Defendant asked the Court for his second deferred judgment. The Court
granted him a deferred judgment and probation with the applicable $750.00 civil
penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and
Gang Bureau.
On January 11, 2010, Joseph Andrew Iliff, FECR227894, pled guilty to Possession
of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count
I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class
D Felony. On February 22, 2010, he came before the Court for sentencing and received
a deferred judgment and probation with the applicable $750.00 civil penalty. This
case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Richard Lynch appeared in Polk County District Court in criminal number FE 230988.
Lynch earlier pleaded guilty to Conspiracy to Manufacture a Controlled Substance
as a Second of Subsequent Offender. Lynch was sentenced to a period of imprisonment
not to exceed 40 years. Lynch must serve a mandatory minimum one-third of his sentence
before being eligible for parole. His mandatory minimum was reduced by one-third
based on his guilty plea and acceptance of responsibility. Lynch was prosecuted
by the Polk County Attorney’s Office Drug and Gang Bureau.
On December 3, 2009, Charles Yaw entered a plea of guilty to the charge of: Possession
of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5),
a Class D Felony. On February 22, 2010 Defendant Charles Yaw, was sentenced for
a total period not to exceed 5years for the charge of Possession of a Controlled
Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class
D Felony. The sentence in this case was suspended, and the defendant was placed
on probation for a period of 5 years to be supervised by the Fifth Judicial District
Department of Correctional Services. Charles Yaw was prosecuted by the Polk County
Attorney’s Office Drug and Gang Bureau.
Bobbie Spoon stipulated that she had violated the conditions of her probation in
case number FE225155. She was previously granted probation for the crime of Possession
of a Controlled Substance With Intent to Deliver, cocaine, a Class C felony. She
was sentenced to a maximum indeterminate term of ten (10) years in prison and must
serve a minimum term of one-third before becoming eligible for parole. This defendant
was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Donna Jones was sentenced for the crime of Conspiracy to Manufacture a Controlled
Substance, a Class C felony, in case number FE232238. She was sentenced to a maximum
indeterminate term of ten years with a mandatory one-third, but this sentence was
suspended and she was placed on five years probation. This defendant was prosecuted
by the Polk County Attorney’s Office Drug and Gang Bureau.
On January 4, 2010, Brian Bowser, FECR232414, pled guilty to Possession of a Controlled
Substance with Intent to Deliver-marijuana, as alleged in the Trial Information,
in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On February 22,
2010, he came before the Court for sentencing and received a deferred judgment and
probation with the applicable $750.00 civil penalty. This case was prosecuted by

On December 29, 2009, Defendant Jared L. Miller entered a plea of guilty to the
charge of: Obtaining or Attempting to a Obtain a Prescription Drug by Fraud, Deceit,
Misrepresentation, or Subterfuge, in violation of Iowa Code Section(s) 124.401(1)(c)(8),
155A.24, and 155A.23, a Class C Felony. On February 22, 2010 Defendant Jared L.
Miller, was sentenced for a total period not to exceed 10 years for the charge of
Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation,
or Subterfuge, in violation of Iowa Code Section(s) 124.401(1)(C)(8), 155A.24, and
155A.23, a Class C Felony. The judgment in this case was deferred, and the defendant
was placed on probation for a period of 5 years to be supervised by the Fifth Judicial
District Department of Correctional Services. Jared L. Miller was prosecuted by
the Polk County Attorney’s Office Drug and Gang Bureau.
Dennis Patterson was sentenced to prison in Polk County Criminal Number FECR228960
for a period not to exceed five (5) years for the crime of Possession of a Controlled
Substance (Third Offense) and for a period not to exceed five (5) years for the
crime of Possession of a Controlled Substance (Third Offense). The defendant was
likewise sentenced to prison in Polk County Criminal Number OM67395 for a period
of one (1) year for the crime of Operating a Motor Vehicle while Intoxicated and
for a period of one (1) year for the crime of Harassment in the Second Degree. The
defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On October 30, 2009, Defendant Michelle M. Taylor entered a plea of guilty to the
charge of: Possession of a Controlled Substance With Intent to Deliver, in violation
of Iowa Code Section(s) 124.401(d), a Class D Felony. On February 22, 2010, Defendant
Michelle M. Taylor, was sentenced for a total period not to exceed 5 years for the
charge of Possession of a Controlled Substance With Intent to Deliver, in violation
of Iowa Code Section(s) 124.401(d), a Class D Felony. The sentence in this case
was suspended, and the defendant was placed on probation for a period of 5 years
to be supervised by the Fifth Judicial District Department of Correctional Services.
Michelle M. Taylor was prosecuted by the Polk County Attorney’s Office Drug and
Gang Bureau.
On January 13, 2010, Defendant Bryan A. Northcott, entered a plea of guilty to the
charges of: Count I: Manufacturing a Controlled Substance; and Count II: Possession
of a Controlled Substance With Intent to Deliver, in violation of Iowa Code Section(s)
124.401(d), both Class D Felonies. On February 22, 2010, Defendant Bryan A. Northcott,
was sentenced for a total period not to exceed 5 years in Count I, and for a total
period not to exceed 5 years in Count II of the Trial Information. These sentences
shall run Concurrent to one another. The sentences in this case was suspended, and
the defendant was placed on probation for a period of 5 years to be supervised by
the Fifth Judicial District Department of Correctional Services. Bryan A. Northcott
was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Angel J. Sanchez entered a plea of guilty to the charge of Escape or Absence From
Custody, in violation of Iowa Code Section(s) 719.4., a Class D Felony. Sanchez
was sentenced for a total period not to exceed 5 years. The sentence in this case
shall run consecutive to the sentence imposed in FECR226172, but concurrent to the
sentence imposed in FECR227245. The defendant shall not be incarcerated for a total
period not to exceed 15 years. The defendant is committed to the custody of the
Director of the Iowa Department of Corrections. Angel J. Sanchez was prosecuted
by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 13, 2009, Kevin Brammer, FECR230811, pled guilty to Possession of a Controlled
Substance-Oxycodone, Third Offense, in violation of Iowa Code Section 124.401(5),
a Class D Felony. Pending sentencing, the Defendant successfully completed the United
Community Services In-Jail Treatment Program. On February 16, 2010, he came before
the Court for sentencing and received a 5 year suspended sentence and probation.
This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On November 10, 2009, Matthew J. Grubb, FECR231000, pled guilty to Possession of
a Controlled Substance-methamphetamine, Third Offense, as alleged in Count II of
the Trial Information, in violation of Iowa Code Section 124.401(5), a Class D Felony.
Pending sentencing, the Defendant completed the Iowa Residential Treatment Center
in Mount Pleasant, Iowa. On February 16, 2010, he came before the Court for sentencing
and received a 5 year suspended sentence and probation with the applicable $750.00
fine. As an added condition of probation, the defendant must reside at the Point
of Entry Recovery House, until maximum benefits are achieved. This case was prosecuted
by the Polk County Attorney’s Office Drug and Gang Bureau.
Tyrese Brewer stipulated that he had violated the conditions of his probation in
case number FE185285. He was previously granted probation for the crime of Possession
of a Controlled Substance With Intent to Deliver, cocaine base “crack”, a Class
C felony. He was sentenced to a maximum indeterminate term of ten (10) years in
prison and must serve a minimum term of one-third before becoming eligible for parole.
This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang
Bureau.
Robert McKeever appeared for a probation revocation hearing for the crime of Failing
to Comply With the Iowa Sex Offender Registry Second Offense FE227545. The court
revoked his probation and sentenced him to five years in prison.
Anne Grask plead guilty to Child Endangerment AG233722 for leaving her three year
old child unattended in the car in a public place while she was intoxicated inside
the store. The court sentenced her to probation.
Karen Graham appeared for a probation revocation hearing for the crime of Burglary
in the Third Degree FE211062. The court sentenced her to complete inpatient drug
treatment.

Irving Cartagena a/k/a Martinez was sentenced to a total of nine years in prison
after a jury found him guilty of multiple offenses arising out of events on August
13, 2009, during which Sgt. Larina Blad of the Des Moines Police Department was
run over by Cartagena’s motor vehicle. Cartagena was convicted of Assault on a Peace
Officer, Assault Causing Injury, Interference with Official Acts, Operating a Motor
Vehicle While under the Influence of Alcohol and Operating a Motor Vehicle While
Barred. This was also the fourth time Cartagena has been convicted of Operating
a Motor Vehicle While under the Influence of Alcohol.
Jennifer Shaver pled guilty and was granted a deferred judgement on the charge of
Fraudulent Practice 2nd Degree in FE225899. She misreprsented her employment status
to Iowa Work Force Development in order to receive over $6000 in unemployment benefits
to which she was not entitled.
Kenneth Hayes pled guilty and was granted a deferred judgement on the charge of
Fraudulent Practice 2nd Degree in FE233038. He misreprsented his employment status
to Iowa Work Force Development in order to receive over $4000 in unemployment benefits
to which he was not entitled.
Justin Silvers was sentenced to prison for a period not to exceed five (5) years
for Attempted Burglary 2nd Degree in FE228886. The Court ordered this sentence to
run consecutive to the sentence which had previoulsy imposed in his underlying parole
matter, Theft 1st Degree, Assault w/ Weapon and Extortion.
On December 29, 2009, Defendant Amanda J. Barsness entered a plea of guilty to the
charge of: Obtaining or Attempting to a Obtain a Prescription Drug by Fraud, Deceit,
Misrepresentation, or Subterfuge, in violation of Iowa Code Section(s) 124.401(1)(c)(8),
155A.24, and 155A.23, a Class C Felony. On February 25, 2010, Defendant Amanda J.
Barsness, was sentenced for a total period not to exceed 10 years for the charge
of Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation,
or Subterfuge, in violation of Iowa Code Section(s) 124.401(1)(C)(8), 155A.24, and
155A.23, a Class C Felony. The judgment in this case was deferred, and the defendant
was placed on probation for a period of 5 years to be supervised by the Fifth Judicial
District Department of Correctional Services. Amanda J. Barsness was prosecuted
by the Polk County Attorney’s Office Drug and Gang Bureau.
Randall Galler was sentenced to an indeterminate term of incarceration not to exceed
10 years in Polk County Criminal Number FECR231901 for the crime of Possession of
a Controlled Substance with Intent to Deliver – Cocaine Base “Crack”. The Court
granted Randall Galler a suspended sentence and placed him on probation for a period
of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug
and Gang Bureau.
Drisana Davis pled guilty in Polk County Criminal Number FECR231901 to the crime
of Conspiracy to Manufacture a Controlled Substance – Methamphetamine. Sentencing
was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s
Office Drug and Gang Bureau.
Ray Edward Lee plead guilty to the felony crime of Going Armed With Intent. Mr.
Lee was sentenced to a term of incarceration not to exceed five years. Ray Lee has
also been indicted in federal court for two bank robberies.
Blake Stephen was sentenced after previously pleading guilty to Burglary in the
Third Degree and Theft in the Third Degree in Polk County Criminal Case Number FECR231519.
The Court sentenced the defendant to two years prison on each offense.
Adam Hamblin pled guilty to Carrying Weapons in Polk County Criminal Case Number
FECR231729. Sentencing has been set for April 29, 2010.
Lewis Claussen pled guilty to Theft in the Fourth Degree in Polk County Criminal
Case Number SRCR233965. The Court deferred judgment and placed the defendant on
probation for one year.

On December 21, 2009, Defendant Roberta L. Dichiara, A.K.A. Huizar, entered a plea
of guilty to the charges of: Count I: Possession of a Controlled Substance With
Intent to Deliver; and Count II: Failure to Possess a Tax Stamp, in violation of
Iowa Code Section(s) 124.401(d), 453B.3, and 453B.12, both Class D Felonies. On
February 26, 2010, Defendant Roberta L. Dichiara, A.K.A. Huizar, was sentenced for
a total period not to exceed 5 years in Count I, and sentenced for a total period
not to exceed 5 years in Count II of the Trial Information. These sentences shall
run Consecutive to one another. The sentences imposed in this matter were suspended,
and the defendant was placed on probation for a period of 5 years to be supervised
by the Fifth Judicial District Department of Correctional Services.
Ramon Ortiz plead guilty to Felon in Possession of a Firearm. Sentencing is set
for April 22nd, 2010.
Franklin Torres plead guilty to Accessory after the Fact, received a deferred judgment,
and was placed on probation.
Steven Seelye was sentenced to a suspended sentence for Burglary in the Third Degree.
He was placed on intensive supervision and electronic monitoring.
Alan Ensley plead guilty to Theft in the Second Degree. Sentencing is set for May
5th, 2010.
Michael Vasquez entered an Alford plea to Unauthorized Possession of an Offensive
Weapon. Sentencing is set for April 26th, 2010.
On December 15, 2009, Candie Jean Combs, FECR231777, pled guilty to Possession of
a Controlled Substance with Intent to Deliver-Marijuana, as alleged in Count VII
of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class
D Felony and Possession of a Controlled Substance with Intent to Deliver-Psilocybin
Mushrooms, as alleged in Count X of the Trial Information, in violation of Iowa
Code Section 124.401(1)( c )(8), a Class C Felony. On February 26, 2010, she appeared
before the Court for sentencing and received a deferred judgment and probation on
both counts. This case was prosecuted by the Polk County Attorney’s Office Drug
and Gang Bureau.
Scott Adams pled guilty to the crime of Conspiracy to Manufacture a Controlled Substance,
a Class C felony, in case number FE232490. He will be sentenced on April 9, 2010
at 9:30 a.m. in courtroom 207 and faces a maximum sentence of ten years in prison
with a mandatory one-third term, but this sentence may be suspended or deferred
and he could be placed on five years probation. This defendant was prosecuted by
the Polk County Attorney’s Office Drug and Gang Bureau.
Chad Wheeler paid $1500 in restitution up front and plead guilty to Theft in the
Third Degree and was granted a suspended sentence in FECR 233312.
General Williams plead guilty to Extortion and was sentenced to a term not to exceed
five years in prison in FECR 234017.
On September 16, 2009, Christopher David Graham, FECR228392, pled guilty to Obtaining
or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation
or Subterfuge, as alleged in Counts I and II of the Trial Information, in violation
of Iowa Code Sections 124.401(1)( c )(8), 155A.24 and 155A.23 both Class C Felonies.
On February 26, 2010, he came before the Court for sentencing. Pending sentencing,
the defendant completed the in-jail treatment program. The Defendant received a
10 year suspended sentence and probation on both counts. The Court ran the two 10
year sentences consecutive to each other for a total period of incarceration not
to exceed 20 years. This case was prosecuted by the Polk County Attorney’s Office
Drug and Gang Bureau.
