Weekly Case Summary
01/09/2012

On January 9th, 2012, Calena Shorter FECR251022 pled guilty to the offense of Delivery of a Controlled Substance-cocaine base crack, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(3), a Class C Felony and Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The Defendant waived time and notice and requested immediate sentencing. The Court sentenced her to prison for ten years on count I and five years for count II, but ran the sentences concurrent to each other for a total period of incarceration not to exceed ten years. The Court ran this ten year sentence consecutive to the sentences for which she was currently on probation, which resulted in a fourteen year prison sentence. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 9, 2012, Kahlil Roby pled guilty in Polk County Criminal Number FECR251064 to the crime of Conspiracy to Deliver a Controlled Substance (Cocaine Base "Crack"). Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 9, 2012, Deangelo McKinney pled guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, cocaine base “crack”, a Class C felony, and admitted that he is a second or subsequent offender, in case number FE2246208. He faces a maximum indeterminate term of thirty (30) years in prison and must serve a mandatory one-third of this sentence prior to becoming eligible for parole. He will be sentenced on March 20, 2012 at 10:00 a.m. in courtroom 208. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 9, 2012, John Dolan appeared in Polk County District Court in criminal number FE250601. Dolan was granted a deferred judgment and placed on probation for one year for the crime of Possession of a Controlled Substance (methadone). Dolan was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 10, 2012, Matthew Padilla was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, cocaine base “crack”, a Class B felony, as a second or subsequent offender, and Receipt, Transportation, Dominion or Control Over a Firearm as a Convicted Felon, in case number FE246209. He was sentenced to a maximum indeterminate term of thirty-five (35) years in prison and five (5) years in prison, consecutive, and must serve a mandatory one-third of the thirty-five (35) year sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 22, 2011, Defendant Christopher Lessman, entered a plea of guilty to the charge of: Possession of a Controlled Substance with Intent to Deliver, to wit: marijuana and Failure to Possess a Tax Stamp, as alleged in the Trial Information, each a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d), 453B.3 and 453B.12. On January 10, 2012 Defendant Christopher Lessman, was sentenced to a period of incarceration not to exceed 5 years each for the charges of: Possession of a Controlled Substance with Intent to Deliver, to wit: marijuana and Failure to Possess a Tax Stamp, as alleged in the Trial Information, each a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d), 453B.3 and 453B.12. The sentence in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Christopher Lessman was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 10, 2012, Sharon Vandermark appeared in Polk County District Court in criminal number FE250609. Vandermark pleaded guilty and was sentenced to a period of imprisonment not to exceed ten years for the crime of Possession of a Controlled Substance With Intent to Deliver (methamphetamine). She must serve a mandatory minimum one-third of her sentence before she is eligible for parole. Vandermark was prosecute by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 10, 2012, a jury found Kenya Duop guilty of Domestic Abuse Assault. The Court found Duop guilty of Criminal Trespass. Sentencing was set for January 20, 2012, at 10:30 a.m. in Room 210 of the Polk County Courthouse.

01/11/2012

On January 11, 2012, Teresa Schott admitted she had violated his probation in case number FE242001. Her probation was continued and she was ordered to reside at the Women’s Residential Facility. She is on probation for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 11, 2012, Abas Takoy was found guilty, by a jury, of Domestic Abuse Assault. At sentencing, Judge Birkenholz granted the defendant’s request for a deferred judgment and assessed a $65 civil penalty. Takoy was placed on probation for 1 year, required to participate in the 24 week Batterer’s Education Program and abide by a 5 year No-Contact Order.

On January 11, 2012, the Court dismissed Francis Vacco’s Application for Post Conviction Relief. Mr. Vacco had attempted to vacate his previous guilty pleas to 2 Counts Sexual Abuse in the Third Degree and Lascivious Acts with a Child. The Court granted the State’s Motion for Summary Judgment in its entirety.

On November 28th, 2011, Sadie Brown FECR249026 pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(3), a Class C Felony. On January 12th, 2012 she came before the court for sentencing and received a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 12th, 2012, Ginger Turner FECR249953 pled guilty to offense of Possession of a Controlled Substance with Intent to Deliver, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(b)(7), a Class B Felony as a Second or Subsequent Offender, in violation of Iowa Code Section 124.411 and Failure to Possess a Tax Stamp, as alleged in Count VI of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The Defendant waived time and notice and requested immediate sentencing. She was sentenced to thirty five (35) years on Count II and five (5) years on Count VI with both counts running consecutive to each other for a total period of incarceration not to exceed forty (40) years. This sentence ran consecutive to her parole for a total period of incarceration not to exceed seventy five (75) years. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

On January 12th, 2012, Nancy Johnson FECR249956, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(b)(7), a Class B Felony as a Second or Subsequent Offender, in violation of Iowa Code Section 124.411 and Failure to Possess a Tax Stamp, as alleged in Count VI of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The Defendant waived time and notice and requested immediate sentencing. She was sentenced to thirty (30) years on Count II and Five (5) years on Count VI with both sentences running consecutive to each other for a total period of incarceration not to exceed thirty five (35) years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 8, 2011, Defendant Sean King, entered a plea of guilty to the charge of: Delivery of a Controlled Substance, to wit: marijuana, as alleged in the Trial Information, each a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On January 13, 2012 Defendant Sean King, was sentenced to a period of incarceration not to exceed 5 years each for the charge of: Delivery of a Controlled Substance, to wit: marijuana, as alleged in the Trial Information, each a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was suspended and the defendant was placed on probation for a period of 3 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Sean King was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 29th, 2011, Demarious Carey FE246921, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-cocaine salt hydrochloride, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(2)(b) and 124.401(1)( c )(2)(d), a Class C Felony without the sentencing enhancements and Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count III of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony without the sentencing enhancements and Eluding or Attempting to Elude a Pursuing Law Enforcement Vehicle, as alleged in Count V of the Trial Information, in violation of Iowa Code Section 321.279(3), a Class D Felony without the sentencing enhancement. On January 13th, 2012, he came before the court for sentencing and received a ten (10) year prison sentence on Count I and a five year prison sentence on Counts III and V. These counts were run consecutive to each other for a total period of incarceration not to exceed twenty (20) years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 13, 2012, Kendric Birden was sentenced in Polk County Criminal Number FECR249550 for the crime of Possession of a Controlled Substance with Intent to Deliver (Cocaine Base "Crack"). Over the State’s objection, the Court granted Kendric Birden a deferred judgment and placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau. On October 7, 2010, Angula Vanchum was sentenced in Polk County Criminal Number FECR235763 for the crime of Delivery of a Controlled Substance (Methamphetamine). The Court granted Angula Vanchum a deferred judgment and placed on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 13, 2012, Jason Vandermark appeared in Polk County District Court in criminal number FE 241635. Jason Vandermark pleaded guilty and was sentenced for two crimes of Possession of a Controlled Substance With Intent to Deliver (methamphetamine). Jason Vandermark received two ten years suspended prison sentences and was placed on probation. Jason Vandermark was fined $1,000.00 on each charge. Jason Vandermark was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 13, 2012, Stephanie Vandermark appeared in Polk County District Court in criminal number FE 241637. Stephanie Vandermark pleaded guilty and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver (methamphetamine). Stephanie Vandermark received a ten years suspended prison sentence and was placed on probation. Stephanie Vandermark was fined $1,000.00. Stephanie Vandermark was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
