Weekly Case Summary
2/1/2010

Ronald Wolfe pleaded guilty to the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE233162. Sentencing is scheduled for April 1, 2010 and he faces a maximum indeterminate term of incarceration of ten (10) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Joseph Roberts-Adams appeared in court to determine if he had violated terms of his probation. Roberts-Adams was placed on probation in March 2009 for Criminal Mischief in the First Degree after he pled guilty to spray painting graffiti, with three juvenile co-defendants, on a number of businesses along Ingersoll Ave. in Des Moines, Iowa. Each defendant was adjudged to be jointly and severally liable for over $9,000 in restitution costs to the victim businesses for cleanup and repair resulting form the damage. At the revocation hearing, Roberts-Adams was given 60 days in jail for contempt of court. The contempt of Court time was suspended so that he could perform 16 hours of community service and pay $150 a month in restitution. His next court appearance is set for May 3, 2010 to determine if he is meeting these conditions of his probation.

Mathew Procyk appeared in court and stipulated to a probation violation. Procyk pled guilty and was sentenced in October 2006 to Willful Injury. He has twice been convicted of Operating a Motor Vehicle While Intoxicated since being placed on probation. The disposition of his probation will be held at a later date.

Romain Dupree Turner also known as Romain Bradley pled guilty to Failure to Comply with the Sex Offender Registry – Second Offense and Assault with Intent to Commit Sexual Abuse. He will be sentenced on March 3, 2010 and faces up to 5 years and 2 years incarceration, respectively, on both charges, or the possibility of probation.

On December 11, 2009, Defendant Joshua M. Moore entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. On February 2, 2010, Defendant Joshua M. Moore was sentenced to a period of incarceration not to exceed 5 years for the charge Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. The defendant was committed to the custody of the Director of the Iowa Department of Corrections. Joshua M. Moore was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

In FECR 233655, Antele Pelayo pleaded guilty to Extortion and Possession of a Controlled Substance and was sentenced to a term not to exceed 5 years and 180 days, concurrently. His sentence was suspended and he was to be released to Immigration Officials for possible deportation proceedings.

Bryan Holt FECR228085 stipulated to violating his probation. The Court ordered that he enter the in jail treatment program. Dispositional hearing was set for July 26, 2010.

Nicholas King FECR229232 stipulated to violating his probation. Dispositional hearing was set for February 9, 2010. The Court ordered that he provide verification that he has been attending Powell.

Nicholas Charlson FECR232186 pled guilty to Neglect of a Dependent Person. Sentencing is set for March 19, 2010.

Amy Charlson FECR232193 pled guilty to Child Endangerment. Sentencing is set for March 19, 2010.

Tanner Hucka plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case number FE233619. Sentencing is scheduled for March 16, 2010 and he faces a maximum indeterminate term of incarceration of five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

William Harris plead guilty to the crimes of Possession of a Controlled Substance, second offense, an aggravated misdemeanor, and Failure to Register as a Sex Offender, an aggravated misdemeanor, in case number FE232688. He was sentenced to a term of incarceration of four (4) years, this sentence was suspended and he was placed on probation for two years. He must remain in custody pending a placement at the Fort Des Moines facility. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

2/3/2010

A bond review was held before Judge Richard Blane II on Marc B. Johnson. The defendant has been charged with Count I: Felon in Possession of a Firearm and Count II: Harassment. Johnson’s bond was previously set at $7,000.00 cash or surety; however, the State sought and was granted a $100,000.00 cash only bond because Johnson made specific threats to kill the two Des Moines Police Officers who arrested him along with their families.

Jason Chace appeared for sentencing in FECR 232468 on a charge of Child Endangerment Causing Bodily Injury. Judge Richard Blane sentenced the defendant to a term not to exceed five years in prison on the charge.

Shelli Blanchard appeared and plead guilty to Theft in the Second Degree in FECR 232411. Sentencing was set for March 24, 2010.

Kendra Sandy appeared for a probation revocation and was discharged from probation in FECR 185440.

Dawn Smith was sentenced to prison in Polk County Criminal Number FECR233135 for a period not to exceed 50 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine, as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Marcus Oldes appeared for a probation revocation hearing in CR 215607 and OM63796. He was discharged in OM63796, but his probation was extended in CR215607 to a full five years.

Christopher Weber appeared for a probation revocation hearing in FECR 218621. He was found to have violated the terms of his probation, but he was continued on probation with the added condition that he reside at the Fort Des Moines Residential Facility to maximum benefits.

2/4/2010

James Dennis was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE232314. He was sentenced to an indeterminate term of five (5) years on each count, consecutive, but these sentences were suspended and he was placed on five years probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Gracie Byrd plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE233287. Sentencing is scheduled for March 17, 2010. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jerrid Michael Winfrey a/k/a “Gator” appeared for sentencing in Polk County District Court in criminal number FE 218465. On December 16, 2009, Winfrey was convicted by a Polk County jury of the crimes of Murder in the First Degree, Attempt to Commit Murder and Willful Injury Causing Serious Injury. Winfrey was found guilty of the February 24, 2008, shooting death of Richard “Man Man” Lewis, Jr. and the shooting and serious injury of Damont Jackson. Winfrey, 21 years old, was sentenced to spend the remainder of his life in prison on the murder charge and to serve periods not to exceed 25 years and ten years respectively for the attempted murder and willful injury crimes. The sentences imposed were ordered to be served consecutively to each other. Winfrey was prosecuted by Assistant Polk County Attorneys Nan Horvat and Dan Voogt.

Kimberly Danielle Victor, FECR232242, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On February 4, 2010, the defendant appeared before the Court for sentencing and received a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 23, 2009, Defendant Kelli Nall entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense as a Habitual Offender, in violation of Iowa Code Section(s) 124.401(5), and 902.8, a Class D Felony. On February 5, 2010 Defendant Kelli Nall, was sentenced for a total period not to exceed 15years for the charge of Possession of a Controlled Substance Third Offense as a Habitual Offender, in violation of Iowa Code Section(s) 124.401(5), and 902.8, a Class D Felony. The sentence in this case was suspended, and the defendant was placed on probation for a period of 5 years to be supervised by the Fifth Judicial District Department of Correctional Services. Kelli Nall was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
