Johnny Mascaro pled guilty to Theft in the 3rd Degree in FECR233811. The Court sentenced him to two years in prison, but suspended the sentence. The defendant had previously served 86 days in the Polk County jail. The Court placed Mr. Mascaro on probation and ordered that he undergo a psychological evaluation and successfully complete all recommended treatment, pay full restitution and comply with a No Contact Order prohibiting him from any contact with Rocky Pepeli, Patrice Pepeli and Jessica Pepeli.

Ricky P. Moore stipulated to his report of violations and agreed to the disposition. Specifically, the defendant was found in contempt and required to serve 3 days in jail and given credit for 3 days served. The defendant’s probation was extended, with his consent, for one year until July 2, 2012. Additionally, the defendant agreed to pay a minimum of $50 per month for restitution.

Corey Hochmuth stipulated to a violation of probation, received contempt of 15 days in jail, and was ordered to be evaluated by EFR.

Marcus Adreon stipulated to violating his probation and was ordered to be evaluated by EFR.

Sherman King stipulated to violating his probation and was sent to the Fort Des Moines Correctional Facility.

Alexis Moeller stipulated to violating probation and was found in contempt and sent to jail for 48 hours.

Tremeshia Holder stipulated to violating her probation and was found in contempt and sent to jail for 48 hours.

Shelby Jellison was sentenced in Polk County Criminal Number FECR227971 for the crime of Manfuacturing a Controlled Substance. The Court granted Shelby Jellison a deferred judgment and placed her on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Isaac Mesta a/k/a Wicked was sentenced to prison in Polk County Criminal Number FECR234064 for a period not to exceed 5 years for the crime of Assault on a Police Officer with a Dangerous Weapon and for a period not to exceed 5 years for the crime of Going Armed with Intent. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Rashawn Lovejoy was sentenced to prison in Polk County Criminal Number FECR229943 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver as Second or Susbequent Offender and to prison in Polk County Criminal Number FECR232855 for a period not to exceed 15 years for the crime of Possession of a Controlled Susbtance with Intent to Deliver as a Second or Subsequent Offeder. The Court ordered the sentences to be served consecutively. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Anthony Stevens plead guilty to the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE234067. He will be sentenced on April 6, 2010 at 2:00 p.m. in courtroom 207 and faces a maximum sentence of ten years in prison with a mandatory one-third term, but this sentence may be suspended or deferred and he could be placed on five years probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Mandi Stowers plead guilty to the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE234065. She was sentenced to a maximum indeterminate sentence of ten years in prison with a mandatory one-third term which she must serve prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Irene Arringdale was sentenced for the crimes of Conspiracy to Manufacture a Controlled Substance, a Class B felony, and three counts of Possession of a Precursor (ephedrine or pseudoephedrine, lithium and ether) With Intent It Be Used to Manufacture a Controlled Substance, Class D felonies, in case number FE230978. She was sentenced to a maximum indeterminate sentence of forty (40) years in prison with a mandatory one-third term of the twenty-five (25) year sentence which she must serve prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Christopher Nichols plead guilty to the charge of Burglary in the Third Degree. Mr. Nichols was sentenced to a period of incarceration not to exceed five years for his role in breaking into coin operated laundry machines.

Gary Robinson, Jr. appeared in court for a probation violation hearing. Mr. Robinson was found to have violated the terms and conditions of his probation. The deferred judgment that he had previously received was revoked and he was found guilty of the charge of Conspiracy to Commit a Forcible Felony, a Class C Felony. He was ordered to the Fort Des Moines Residential Facility until maximum benefits are received. Mr. Robinson is being held in the Polk County Jail until space is available at the Fort Des Moines Residential Facility.

Michael Teasley was sentenced to prison in Polk County Criminal Number FECR201383 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver and for a period not to exceed 2 years for the crime of Carrying Weapons. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Maryann Gatewood pled guilty in Polk County Criminal Number FECR233284 to the crime of Conspiracy to Deliver a Controlled Substance. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Alan Davis was sentenced to prison in Polk County Criminal Number FECR233784 for a period not to exceed 10 years for the crime of Manufacturing a Controlled Susbtance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Randy Killen appeared and plead guilty to charges of Criminal Mischief in the Second Degree and Burglary in the Third Degree in FECR 233214. Sentencing was set for April 21, 2010. Two other cases against Killen were dismissed.

Jonette Lomax plead guilty to Child Endangerment in CR 233686. Sentencing was set for March 19, 2010.

On December 17, 2009, Mark E. Stinson, SRCR232283, pled guilty to possession of a controlled substance-marijuana, third offense, as alleged in the Trial Information, in violation of Iowa Code Section 124.401(5), a class D felony without the habitual offender enhancement. Prior to sentencing, the defendant completed the United Community Service’s In-Jail Treatment Program. On March 4, 2010, he came before the Court for sentencing and received a 5 year suspended sentence and 5 years of probation with the condition that he complete the aftercare component of the program. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Thomas Chambers plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, in case number FE233912. He was sentenced to a maximum indeterminate term of twenty-five years in prison with a mandatory one-third term, but this mandatory one-third was reduced by one-third because of his acceptance of responsibility. The sentence was run consecutive to his parole revocation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jeffrey Baase stipulated that he violated terms and conditions of his probation in Polk County Criminal case number AGCR224420 after unsuccessfully completing the Youthful Offender Program. Disposition was set for March 18, 2010.

Dennis Hart pled guilty to Theft in the Third Degree in Polk County Criminal case number FECR230330 after an investigation revealed that Mr. Hart stole money from his elderly and dependent mother. Sentencing was set for April 22, 2010.

Scott Schwartz was sentenced to prison in Polk County Criminal Number FECR232851 for a period not to exceed 35 years for the crime of Possession of a Controlled Substance with Intent to Deliver, as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Eric Johnson was sentenced to prison in Polk County Criminal Number FECR233651 for a period not to exceed 25 years for the crime of Conspiracy to Manufacture a Controlled Substance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Samuel Williams was sentenced to prison in Polk County Criminal Number FECR232930 for a period not to exceed 10 years for the crime of Conspiracy to Manufacture a Controlled Substance and for a period not to exceed 5 years for the crime of Possession of Ephedrine or Pseudoephedrine with Intent it be Used to Manufacture a Controlled Substance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Romain Dupree Turner, FECR231460 and FECR232327, a sentencing was held in this case in which Mr. Turner had previously plead guilty to one count of Failure to Comply With the Sex Offender Registry – Second Offense, Class D Felony and Assault With Intent to Commit Sex Abuse, an Aggravated Misdemeanor. The defendant was sentenced to an indeterminent period of imprisonment not to exceed five years.

Russell Thompson, FECR213895 and OM66940 on March 4, 2010, stipulated that he violated the terms and conditions of his probation by not paying restitution and failing to do the OWI 1st program. Disposition for his probation violation was set for March 18, 2010, at 9:00 a.m in room 204. At that time the defendant will begin a 10 day jail sentence for contempt of court.

State of Iowa v. Melinda Hanson, FECR229438. Ms. Hanson plead guilty to Theft in the Third Degree, an Aggravated Misdemeanor for presenting several bad checks to local businesses. Ms. Hanson received a suspended two year prison sentence, was placed on two years of probation, ordered to pay restitution, participate in the Victim Offender Reconciliation Program, and take the Bad Check Class.

On December 22, 2009, Blake Andrew Wenzel, FECR232014, pled guilty to manufacturing a controlled substance-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony, as a second or subsequent offender, in violation of Iowa Code Section 124.411. The Defendant was previously convicted of the offense of possession of marijuana with intent to deliver in 2003 in Wapello County. On March 5, 2010, he appeared before the Court for sentencing. Both parties recommended a 15 year suspended sentence and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 28, 2010, Jack Daniel Van Sickle, FECR233224, pled guilty to possession of a controlled substance with intent to deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On March 5, 2010, he appeared before the Court for sentencing and received a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 27, 2010, Salvador Montano-Chavez, FECR232877, pled guilty to possession of a controlled substance with intent to deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On March 5, 2010, he appeared before the Court for sentencing. The State of Iowa argued for a 5 year prison sentence. The Defense argued for a deferred judgment and probation. The Defendant is currently being held in the Polk County Jail on an immigration hold for I.C.E. The Court sentenced him to prison for 5 years. After the Defendant discharges his prison sentence, he will be deported back to Mexico. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Troy Mure Jr. pled guilty to Eluding, Operating a Motor Vehicle While Under the Influence of a Drug, and Possession of a Controlled Substance in Polk County Criminal Case numbers FECR231512, SRCR234459, and OM68525. Pending sentencing, Mr. Mure is to be evaluated for entry into the Drug Court program. Sentencing has been set for April 27, 2010.

On December 2, 2009, Defendant Shane A. Bachmeyer, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. On March 5, 2010, Defendant Shane A. Bachmeyer, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense, in violation of Iowa Code Section (s) 124.401(5). The defendant was committed to the custody of the Director of the Iowa Department of Corrections. Shane A. Bachmeyer was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Chris Robert Riley plead guilty to Burglary in the Second Degree in FECR 234254. Sentencing was set for April 27, 2010.
