Weekly Case Summary
03/07/2011

Jacob Howe was arraigned on Possession of a Controlled Substance with Intent to Deliver, among other charges. Trial is set for May 2nd, 2011.

Allison Ruiru was arraigned on Fraudulent Practice in the First Degree. Trial is set for May 2nd, 2011.

Luis Alvarado pled guilty to Lascivious Acts with a Child. Sentencing is set for April 18th, 2011, in Courtroom 204.

Jodi Cooper was sentenced to probation on her guilty plea to Fraudulent Practice in the Second Degree.

Barbara Ann Warner had her bond changed to $5,000 cash or surety and is to have no contact with any retail establishments during the pendency of her case.

Alexandria Marie Smith failed to appear for her sentencing hearing and a warrant issued for her arrest.

Kyle Kinsey was sentenced to probation for Burglary in the Third Degree.

Joseph Donato was sentenced to probation for Theft in the Second Degree.

Ryan Lee Johnson was unsuccessful in his motion to dismiss the charge of Burglary in the Third Degree.

On March 8, 2011, Eric Grund was sentenced to an indeterminate term of incarceration not to exceed 5 years in Polk County Criminal Number FECR240027 for the crime of Possession of a Controlled Substance with Intent to Deliver (Marijuana). The Court granted Eric Grund a suspended sentence and placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 24, 2011, Defendant Juan Moncada, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. On March 8, 2011, Defendant Juan Moncada, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Juan Moncada was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau

On March 9, 2011, Diego Rodriguez pled guilty in Polk County Criminal Number FECR237396 to the crime of Possession of a Controlled Substance with Intent to Deliver (Marijuana). Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Charles Barnes – FECR242206 – This defendant was arraigned on the charges of Sexual Abuse in the Third Degree, a Class C Felony and Indecent Exposure, a Serious Misdemeanor. To both of these charges the defendant plead not guilty and a pretrial conference was set for April 7, 2011, at 2:30 p.m. in Room 209A and trial was set for May 2, 2011.

State of Iowa v. Thomas Stark II – FECR243281 – This defendant was arraigned on the charge of Possession of a Controlled Substance With Intent to Deliver, a Class D Felony and entered a plea of not guilty. A pretrial conference was set for March 31, 2011, at 1:30 p.m. in Room 207 and trial was set for April 27, 2011.

State of Iowa v. Robert Scott – FECR244005 – This defendant was arraigned on the charges of Possession of a Controlled Substance as a Third or Subsequent Offense which is a Class D Felony. The defendant entered a plea of not guilty and a pretrial conference was set for April 7, 2011, at 2:30 p.m. in Room 207 and trial was set for May 4, 2011.

State of Iowa v. Jennifer Tucker – FECR242992 – This defendant was arraigned on the charge of Fraudulent Practices in the First Degree, a Class C Felony and entered a plea of not guilty. Pretrial conference was set for April 7, 2011, at 1:45 p.m. in Room 204 and trial was set for May 4, 2011.

State of Iowa v. David Karaidos – FECR244006 – This defendant was arraigned on the charges of Possession of an Offensive Weapon, Class D Felony; Domestic Abuse Assault With a Dangerous Weapon, Aggravated Misdemeanor; Harassment in the First Degree, Aggravated Misdemeanor; and False Imprisonment, Serious Misdemeanor. To all of these charges the defendant entered a plea of not guilty and a pretrial conference was set for April 7, 2011, at 1:30 p.m. in Room 204 and trial was set for May 4, 2011.

State of Iowa v. Donna Shelton – FECR241518 – This defendant plead guilty to Theft in the Third Degree, an Aggravated Misdemeanor as a lesser included offense of the charge of Theft 2nd in the trial information. The defendant admitted and plead guilty to presenting several checks from her own account at Hy-Vee Food Stores that she knew would not be paid when presented and receiving property and services in exchange for those checks. The defendant was ordered to pay $200.00 in restitution immediately upon entering a plea and another $100.00 by the end of the day tomorrow. The defendant received a deferred judgment and was placed on one year of probation. As conditions of probation she is ordered to complete 87 hours of community service, participate in a Victim Offender Reconciliation Program and any other requirements of the probation department.

Melvin Aviles-Amaya – FECR243377 – This defendant plead guilty to Fraudulent Practices in the Fourth Degree and admitted putting false information on a car registration at the Department of Transportation. The defendant received a 180 day suspended sentence and was placed on one year of probation to comply with all terms and conditions set forth by the Department of Corrections.

Maria Pulida Verduzco – FECR242631 – This defendant plead guilty to Fraudulent Practices in the Fourth Degree and admitted putting false information on a job application or record of a business in order to received employment. The defendant received a 180 day suspended jail sentence and was placed on one year of probation to comply with all terms and conditions as set forth by the Department of Corrections.

Artee Jesse Smith pled guilty to Willful Injury Causing Bodily Injury in FE241625 for his part in an assault on an acquaintance. Mrisad Ibrahimovic was severely beaten by several men after he had an initial confrontation. He suffered a broken jaw, ribs and bones in his eye. Smith has already been sentenced to prison in other matters. He is awaiting a pre-sentence investigation report before sentencing which is set April 26, 2011.

Deandre Montez Brown was granted a suspended sentence in FE237386 on the charge of Theft 1st Degree, Conspiracy to Commit a Forcible Felony, and Assault with a Dangerous Weapon. The Court sentenced him to a total of twelve (12) years on the offenses, suspended them and ordered him to be on probation for 3 years. He successfully completed residential treatment at Mt. Pleasant and will be placed at the Bridges of Iowa Residential Facility.

Dicky Bonwell was sentenced to five (5) years in prison in FE 223823 for a third offense possession of an illegal substance. He had violated the terms and conditions of his probation by using illegal substances, falsifying his UA and failing to keep his PO apprised of his living arrangements.

On March 10, 2011, Cody Wade was sentenced to prison for a term not to exceed five years, for committing Willful Injury Causing Bodily Injury. He pled guilty to assaulting his girlfriend and having his dog attack her. The Court also entered a No Contact Order prohibiting the defendant from having any contact with the victim.

On March 11, 2011, Michael Bivians pled guilty in Polk County Criminal Number FECR242702 to the crime of Possession of a Controlled Substance with Intent to Deliver (Methampehtamine). Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 11, 2011, Kevin Kraft was sentenced to probation for committing Count 1 & Count 2 Assault with Intent to Inflict Serious Injury and Count 3 Criminal Mischief in the 3rd Degree. The Court ordered the he successfully complete all recommended mental health treatment, including being current on medication. In addition, he was ordered to complete the Repeat Offender Program and Assaultive Behavior Class. The Judge also entered a No Contact Order for five years with the victims.

On March 11, 2011, Nicholas Scott Smith stipulated to violating his probation, for Burglary in the 3rd Degree. The Court revoked his probation and sentenced him to prison for a term not to exceed 5 years. In addition, the defendant pled guilty to a separate case of Burglary in the 3rd Degree and Escape. He was also sentenced to prison for those convictions.

On March 11, 2011, Jonathan Garcia-Baena pled guilty and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, in case number FE241533. He was sentenced to a maximum indeterminate term of twenty-five (25) years and must serve a mandatory one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Tommy Gines, Jr. FECR242926 The defendant in this case, Tommy Gines, Jr., came before the court on March 11, 2011 and plead guilty to Burglary in the Third Degree. The charges arose on November 23, 2010 when an apartment located at 6000 Creston in Des Moines was broken into. Taken in the burglary were a flat screen television, a Wii video game system and other electronic items. Following his plea of guilty, the court sentenced the defendant to five years incarceration, suspended the sentence, and placed him on probation for 2 years.
