ONE-HUNDRED SEVENTY-FOUR DEFENDANTS SENTENCED FOR OWI THE WEEKS OF APRIL 18, APRIL 25 MAY 2nd and MAY 9th, 2011.

One Hundred seventy-four Defendants were sentenced for Operating while under the Influence (OWI) in Polk County District Courts the weeks of April 18, April 25 May 2 and May 9, 2011.

One Hundred-forty-one of those defendants were sentenced for OWI First Offense. OWI, First Offense is a Serious Misdemeanor, punishable by a maximum sentence of one year in the County Jail and a maximum fine of $1250. The Court MUST impose a minimum of two days incarceration and a fine of $1,250, upon conviction. Blood Alcohol levels are shown below in parentheses. DRE indicates that the conviction was based upon use of drugs other than alcohol. REF means that the defendant refused the chemical test. A deferred judgment (non-conviction) is usually available to those defendants who test below .150 for a first offense.

Those defendants being sentenced for OWI First Offense the weeks of April 18, April 25 May 2 and May 9, 2011 were: Jeffery Van Toome (.085), Richard Reed Sweatt (.093), Katie Lynn Winslow (.098), Danice R. Keller (.102), Brandon Cady (.103), Joseph Michael Kuder (.106), Morlitha Lita Khoangvan (.106), Christian Allen Pedersen (.109) and (.140) Pedersen had two first offenses, he was sentenced to twenty five days in the Polk County Jail , Jessica Rossmanith (.109), Elizabeth N. Weinheimer (.110), Luke Reinhart Lewis (.110), Emily Dorothy Gundlach (.111), Ian William Dennis (.112), Davis Allen Hall (.112), Mindy Jo Euken Cardenillas (.112), Herbert McCoy (.112), Nathan Jerome Schroeder (.113), Ashley Nicole Dale (.116), Soukanh Xayavongchanh (.119), Scott A. Hoveland (.120), Eric L. Herriage (.181), Kent Micah Seieror (.182), Christian Mendoza (.186), Stephanie Myers (.187), Mestor Daniel Romero (.187), Yvette Lea Rochon (.188), Brittany Renae Chapman (.189), Adrian Johnson (.192) Johnson was also convicted of Possession of Marijuana, Steven Michael Allen (.200), Jerry Lee Gillespie, Jr. (201), Brenda Benavidez (.202), Roberto Gallegos (.204), Bernadine Iona Bartley (.206), Robert Allen Ziebell (.206), Dana Sue Garcia (.207), Erika Brianne Burrier (.208), Andria Marie Rodriguez (.209), Linda M. Sibley (.211) Sibley was also convicted of two counts of Child Endangerment, Dennis D. Benson (.220), Timothy Jay Hayes (.224), William Joseph Henry (.226), Christian Carl Jahn (.228), Tyler Joseph Luft (.228), Lucas Eugene Sopicher (.234) Spicher was sentenced to serve forty-nine days in the Polk County Jail, George A. Falkiewicz (.238) Falkiewicz was sentenced to serve seventy days in the Polk County Jail, Richard Joseph Peterson (.244) Peterson was sentenced to serve thirty days in the Polk County Jail, Kelly R. Hilpipre (.256), John Thomas Warner (.270), Todd M. Russell (.270), Austin J. Allison (DRE), Daniel E. Cook (DRE), Shedrick Russell Elliott (.075/DRE), Antonio Lovan Hall (.057/DRE) hall was sentenced to serve 120 Days in the Polk County Jail, Justin David Wendelboe (DRE), Hilary Jo Claybrook (DRE), Larry Holloway, Jr. (DRE), Angela Sue Blanchford (DRE), Preston T. Prather (DRE), Douglas Jones (DRE), Robert Jon Miller (REF), Dixie L. Smith (REF), Brett Hanson (test results suppressed by the court), John W. Holiday (REF), Tracy B DeVaughn (REF), Hector Casillas (REF), Sepester Ekiek Samuel (REF), Amy B. Laprei (REF), Michelle D. Robb (no test results), Tuoi Van Luong (REF), Mersaydes Lashay Jones (REF), Ermyas G. Ftwi (REF), Jonathan Mills (REF) Mills was also sentenced in a Driving while Revoked case and was sent to prison for one year sixty days, Frank Stewart (REF) Stewart was sentenced to serve sixty days in the Polk County Jail, Trace Marcus Washington (REF) Washington was sentenced to serve thirty days in the Polk County Jail, Janey Lynn Boehm (REF), Jack L. Graeve (REF), Joshua A. Mayhugh (REF), Nicholas York Bell (REF), John R. Sparland (REF), Justin Allen Boswell (REF), Joshua Wayne Perkins (REF), Janet Safris (REF), and Frederick Andrew Jones (REF).

Of those defendants sentenced for OWI first offense this report, forty-four had a test of greater than .160 (twice the legal limit) and twenty-four refused the chemical test. The low chemical test among this group was .085 and the high test was .270 (almost FOUR times the legal limit). Nine defendants were found guilty and sentenced based upon their use of drugs other than alcohol.

Thirty-three Defendants were sentenced for OWI Second Offense. OWI second offense is an Aggravated Misdemeanor punishable by up to two years in prison and a fine of up to $6250. The Court MUST impose a minimum of seven days incarceration and a minimum fine of $1875 upon conviction of Second Offense OWI. The defendants sentenced for OWI second offense report were: Ryan T. Carroll (.112), Jason R. Smith (.120), Asmir Mujdzic (.122), Ryan C. Davis (.122), Daniel Vizcarra (.129), Amar Music (.136), Thomas W. Henckel (.143), Shane J. Edwards (.144), Kristina Dozal (.175), Kevin R. Wilson (.182), Ryan Ostring (.186), John E. Ballard (.206), Christopher Ross (.208), Darlene Faye Shepard (.221), Cody Taylor (.226), Wade A. Handlos (.231), Joshua G. Richardson (.245), Robert R. Bourdon (.253), Daungta Queng (REF) Queng was sentenced to ninety days in the Polk County Jail, Matthew Blaha (REF) Blaha was sentenced to sixty days in the Polk County Jail, Jeffrey V. Mele (REF), Michael Jacob Baker (REF),Noah Miller (REF), Timothy Burns (REF), Corey A. McBride (REF), Bridget N. Ryan (REF), Byron L. Smith, Jr. (REF), Michael L. Gauthier (REF), Celeste E. Burdick (REF), Glen Hays (DRE), Jordon bell (DRE), Joey Smith (DRE),and Marcus Mohorne (REF) Mohorne was sentenced to two years in prison.

Of those Defendants sentenced for OWI second offense who took a chemical test, those tests ranged from a low of .120 to a high of .253 (over THREE times the legal limit). Twelve of these defendants refused the chemical test, and three were sentenced based upon their use of drugs other than alcohol. The State of Iowa has a legislatively set, presumptive level of intoxication of .08.

There were two defendant sentenced this reporting period for Third Offense OWI. Third Offense OWI is a Class D felony, punishable by up to five years in prison and by a fine of up to $7500. The Court MUST sentence a Defendant convicted of Third Offense OWI to a minimum of thirty days in jail and a minimum fine of $3125. Sentenced this report were Dennis W. Stoutenberg (REF) and Jorge O. Gonzalez(.129). Stoutenberg and Gongalez were sentenced to five years in prison, fined $3125 and had their driving privileges revoked for six years. They may serve all or part of their prison sentence in an OWI residential correctional setting such as the one operated by the Department of Corrections on the grounds of the Fort Des Moines Facility.
