Weekly Case Summary
05/16/2011

Ronald R. Fisher was sentenced in FE243118 to five (5) years in prison for Burglary 3rd degree. The Court suspended his sentence and granted him probation due to his minimal criminal history. He requested a Deferred Judgment, which the Court declined due to his limited acceptance of responsibility. The Defendant denied knowing about the intent to commit the burglary, claiming he had just lent his truck to someone. He pled guilty on March 23rd, 2011 by North Carolina v. Alford, which allowed him to accept a recommendation of probation without having to actually admit wrong doing.

Renita M. Allen stipulated she violated the terms and conditions of her probation in FE217091 by failing to report to her probation officer and failing to comply with any probation requirements for the last two (2) years. She advised the Court she was taking care of family matters during the time. She turned herself in on a warrant and reported to the Court she was ready to face the consequences so she could make the necessary changes in her life. The Court gave her a 2nd chance at probation, finding her in contempt and sentencing her to 120 days as a result of the contempt. She received credit for the 14 days she had served since she turned herself in. She will be required to be on probation for two years upon release from custody.

On May 16, 2011, Kristin Bray stipulated to violating her probation. The Court ordered that the defendant be taken into custody, by the Polk County Sheriff’s Office and remain incarcerated at the jail. Ms. Bray is to be evaluated for the In Jail Treatment Program. The probation violation dispositional hearing is set for May 23, 2011 at 3:00 p.m. Rom 204.

On May 16, 2011, Jessie Parish stipulated to violating his probation. After an evidentiary hearing, the Court revoked the defendant’s probation and sentenced him to prison. The Court found that “Continued probation in this case is denied because it would not provide reasonable protection of the public, it is unwarranted, and would unduly lessen the seriousness of the crime.”

On May 17, 2011, Stacy Comstock was sentenced for the crime of Delivery of a Simulated Controlled Substance, a Class B felony, as a second or subsequent offender in case number FE243220. He was sentenced to forty (40) years in prison and must serve a mandatory one-third term of this sentence prior to becoming eligible for parole. He was granted a one-third reduction of this sentence for his acceptance of responsibility. This sentence was also ordered to run consecutive to his parole revocation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 17, 2011, Thomas M. Rhoades was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE243303. He was sentenced to ten (10) years in prison. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2011, Jeffery Hickcox appeared in Polk County District Court in criminal number FE 240504. Hickcox was sentenced to a term of imprisonment not to exceed 25 years for the crime of Possession of a Controlled Substance With Intent to Deliver (in excess of five grams of methamphetamine). Hickcox must serve a mandatory minimum one-third of his sentence before he is eligible for parole. His mandatory minimum was reduced by one-third based on his acceptance of responsibility. Hickcox was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2011, Coty Turner appeared in Polk County District Court in criminal number FE 234796. Turner pleaded guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver (marijuana) and Failure to Possess a Tax Stamp. Turner was also sentenced to an indeterminate term of incarceration not to exceed five years on each charge to be served consecutively to each other. Turner was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2011, Walter Parker appeared in Polk County District Court in criminal number FE 243793. Parker pleaded guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver (cocaine base “crack”) and Failure to Possess a Tax Stamp. Parker was sentenced to an indeterminate term of imprisonment not to exceed ten years and five years respectively. Parker must serve a mandatory minimum one-third of his ten year sentence before being eligible for parole. Parker was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2011, Christopher Hallinan was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, two counts, a Class C felony and a Class D felony, in case number FE242522. He was sentenced to ten (10) years and five (5) years in prison, consecutive, and must serve a mandatory one-third term of the ten year sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2011, Kevin Kraft was found guilty of Violating a No Contact Order. The Court ordered that he serve 15 days in the Polk County Jail. The Court further found that he had violated his probation and continued him on probation for 2 Counts of Assault with Intent to Inflict Serious Injury and Criminal Mischief.

On May 19, 2011, Tony Weese was sentenced to prison in Polk County Criminal Number FECR239836 for a period not to exceed 10 years for the crime of Arson in the Second Degree and for a period not to exceed 10 years for the crime of Conspiracy to Manufacture a Controlled Substance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 19, 2011, Teresa Schott was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE242001. She was sentenced to a ten (10) year term in prison, but this sentence was suspended and she was placed on probation for two (2) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 19, 2011, Juan Villasenor-Zavala plead guilty and was sentenced for the crime of Delivery of a Controlled Substance, a Class B felony, in case number FE243947. He was sentenced to a twenty-five (25) year term in prison, and must serve a mandatory minimum term of one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jerry Shane Pratt was unsuccessfully discharged from the Drug Court program on May 13, 2011 after he was unsuccessfully discharged from residential treatment at IRTC. He pled guilty to 3 counts of Forgery, Theft 1st Degree and Identity Theft and was sentenced to 35 years in prison with a mandatory 3 years because he is a habitual offender.

Clarence Delmott stipulated he violated the terms and conditions of his probation in FE239189 and SR238854 for being arrested on new charges. Delmott was in the Drug Court program when he relapsed and used illegal substances. He broke into a church. Although that charge is as yet unresolved, he stipulated he did use, absconded supervision and broke into the church. The Court revoked his probation and sentenced him to the original term of thirty (30) years. He must serve a minimum six (6) years before he is eligible for parole because he is a habitual offender and the Court imposed the enhancement on two different charges.

05/20/2011

Everett Abbey plead guilty to Theft in the Second Degree and was granted a probation.

Carter Woodruff plead guilty to Theft in the Second Degree and Felony Failure to Appear. The court ordered a presentence investigation report and set sentencing for June 28th.

Brenda Jones appears on a probation revocation matter. She was found in violation of probation, but was continued on probation will additional terms.

Matthew Kellen appeared for a bond review hearing. The court order a substance abuse evaluation pending further consideration of his request.

Christopher Heyer appeared for arraignment on charges of Theft in the Second Degree and OWI, trial was set for July 18, 2011.

Toby O’Connor appear for arraignment on charges of Theft in the Second Degree and Possession of Drug Paraphernalia, trial was set for July 18, 2011.

On May 20, 2011, Daeron Merrett was sentenced to prison in Polk County Criminal Number FECR241536 for a period not to exceed 10 years for the crime of Delivery of a Controlled Substance (Cocaine Base Crack), for a period not to exceed 10 years for the crime of Delivery of a Controlled Substance (Cocaine Base Crack), for a period not to exceed 25 years for the crime of Possession of a Controlled Substance with Intent to Deliver (Cocaine Base Crack), and for a period not to exceed 5 years for the crime of Failure to Possess a Tax Stamp. A Polk County Jury had previously found the defendant guilty of the above offenses. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 20, 2011, Zuedon Knox pled guilty in Polk County Criminal Number FECR241976 to the crime of Delivery of a Controlled Substance (Cocaine Base Crack). Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 1, 2011, Defendant Nickolus Peterson, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. On May 20, 2011, Defendant Nickolus Peterson was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Nickolus Peterson was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
