5/17/2010

Alexander Douglas Cadwell pled guilty in FE232981 to the charges of Theft 1st Degree and Criminal Mischief 2nd Degree for his role in stealing a car and then taking several parts from it and doing significant damage to the vehicle in the process. His co-defendant, Nathan Crawford, entered a plea agreement earlier this year. Cadwell will be sentenced on June 30, 2010. Pending sentence, he has been released and will be supervised under a separate probation in FE215324.

On March 11, 2010, Lawrence William Yates, Jr., FECR233425, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On May 17, 2010, he came before the court for sentencing and received a 5 year suspended sentence and was placed on probation for 5 years with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 24, 2010, Angie Stephenson, known now as Angie Lame, FECR234282, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count Ii of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On May 17, 2010, the defendant appeared before the court for sentencing and received a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Alvin Miles, Jr., appeared in the Polk County District Court for a probation violation hearing. The defendant stipulated that he violated the terms and conditions of his probation and he was sentenced to prison for a period not to exceed five years.

Chakachan Marshall in CR253879 appeared in court and pled guilty to the crime of Fraudulent Practice in the Third Degree, an aggravated misdemeanor. Ms. Marshall was placed on probation for a term not to exceed two years and/or to make restitution to the Iowa Workforce Development.

Sean McFadden in CR224470 appeared for a hearing to determine whether or not he violated the terms and conditions of his probation. The court found that the defendant did violate the terms and conditions of his probation and sentenced him to prison for a period not to exceed five years for the crime of Count 1 – Serious Injury by Vehicle by Reckless Driving. Defendant was also sentenced to prison for Count 2 – OWI, a serious misdemeanor.

State of Iowa v. Ronald David Dare - FECR235069
Ronald David Dare appeared in Polk County District Court and plead guilty to Assault with Intent to Inflict Serious Injury, Count II, and Theft in the Fifth Degree, Count III. The charges arose on February 8, 2010, when the defendant went into the Menard’s Store located at 6000 SE 14th Street in Des Moines, and tried to steal a security camera. He concealed the security camera in his coat and made no attempt to pay for it while he went through the check out area of the store. He was confronted by Menard’s Store security. The defendant fought with security briefly before being held at the store until police arrived. While the store employees and the defendant were waiting for the police to arrive, the defendant made a second attempt to escape by striking one of the store employees in the head and knocking his glasses off. The defendant then ran from the store, but was quickly apprehended by store personnel. Part of the defendant’s security camera theft was captured on store security cameras. The defendant was sentenced to two years on Count II and 30 days on Count III. The sentences were to be served at the same time. The defendant was denied probation due to his prior criminal history. The defendant plead guilty to these misdemeanor charges as part of a plea bargain in which the State agreed to dismiss the charge of Robbery in the Second Degree which had been charged as Count I.

Danny Hill Jr. FECR233692 was sentenced to probation for committing Lascivious Acts with a Child. He was ordered to undergo Sex Offender Treatment Program and obtain a mental health evaluation. The defendant will be required to register with the Iowa Sex Offender Registry as a convicted sex offender. The defendant was also sentenced to a Special Sentence committing him into the custody of the Director of the Iowa Department of Correction for the rest of his life, with eligibility for parole. The Court ordered that he have No Contact with the victim and all minor children. The sentencing order specifically finds that this is a “sexually predatory offense.... (and) will be used to enhance any future convictions for any sexually predatory offense.”

Kevin Grimes appeared in FE223409 and stipulated that he violated the terms and conditions of his probation by leaving a halfway house where he was ordered to reside. He was sentenced to prison.

Steven Seelye appeared in FE230924 and stipulated that he violated the terms and conditions of his probation by being convicted of an offense in Marshall County, where he was sentenced to prison. The Court imposed the original sentence of five (5) years imprisonment in this matter.

Dana Johnson appeared in FE227586 and FE227715 and stipulated that he violated the terms and conditions of his probation. He was sentenced to his original term of incarceration.

On January 29, 2010, Andrew Hethershaw, FECR232736, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On May 18, 2010 he came before the Court for sentencing and received a 5 year suspended sentence and probation with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

A Polk County jury found David Callison guilty in Polk County Criminal Number FECR230369 of the crime of Possession of a Controlled Substance. The defendant subsequently stipulated he had two or more prior convictions for controlled substance violations and two or more prior felony convictions making the defendant a Habitual Offender. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Cedric Williams was found to have violated the conditions of his probation in case numbers FE222253 and AG228237. He was sentenced to a maximum indeterminate term of thirty (30) years and two (2) years in prison, concurrent, and must serve a mandatory one-third term before he becomes eligible for parole. He was on probation for the crimes of Delivery of a Simulated Controlled Substance, a Class C felony, as a second or subsequent offender, and Driving While Barred, an aggravated misdemeanor. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 24, 2009, Defendant Charles C. Dyer, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. On May 18, 2010, Defendant Charles C. Dyer was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, in violation of Iowa Code Section (s) 124.401(1)(d). The sentence was suspended and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Charles C. Dyer was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On January 13, 2010, Defendant Harold L. Dalton, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. On May 18, 2010, Defendant Harold L. Dalton was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver as alleged in Count I of the Trial Information, in violation of Iowa Code Section (s) 124.401(1)(d). The judgment was deferred and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Harold L. Dalton was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

38 Norwalk Middle School students and 5 teachers visited the Polk County Courthouse today for a part of their career day. The students were given a brief tour of the courthouse and given some history of the building. They met with Assistant Polk County Attorneys Steve Foritano and Jaki Livingston, Judge Rosenberg and Judge Reis, Public Defender Pam Summers, Captain Peterman, PCSO and Jodi McCabe, certified shorthand reporter. They were given an overview of what each person does in their job, how a courtroom runs and who all is involved. They asked several questions including how long one has to go to school to be a lawyer and what it feels like to be “tazed.”

Russell Briggs appeared in Polk County District Court in criminal number FE 23574. Briggs pleaded guilty to manufacturing a controlled substance (methamphetamine) and possession of ephedrine or pseudoephedrine as well as anhydrous ammonia with intent they be used to manufacture a controlled substance (methamphetamine). Briggs will be sentenced in July. Briggs is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Cary Johnston appeared in Polk County District Court in criminal number FE 235755. Johnston pleaded guilty to possession of ephedrine or pseudoephedrine with intent it be used to manufacture a controlled substance (methamphetamine). Johnston will be sentence at the end of June. Johnston is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Joseph Moberly appeared for a probation revocation hearing. He agreed that he violated the terms of his probation and his probation was revoked. He was sentenced to a term not to exceed five years in prison.

Greg Emery pled guilty in FECR234439 and was granted a suspended five (5) year sentence. He admitted he failed to report his income when he applied for unemployment benefits, thereby receiving monies to which he was not entitled. As a condition of probation, he will be required to make restitution, complete a life skills class and complete community service work.

Deangelo Allen was sentenced to prison in Polk County Criminal Number FECR219930 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver – Cocaine Base “Crack” and for a period not to exceed 5 years for the crime of Possession of a Controlled Substance with Intent to Deliver - Marijuana. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Kelly Robertson – FECR187192 – Ms. Robertson appeared for disposition of a probation violation stemming from the charge of Forgery. The defendant had previously stipulated that she violated the terms and conditions of her probation in December of 2008. The defendant failed to appear for the original disposition hearing on January 5, 2009, at which time a warrant was issued for her arrest. This defendant was wanted until she was arrested on April 22, 2010. The court revoked the defendant’s deferred judgment and imposed a prison sentence not to exceed five years and she will immediately be transported to the Iowa Department of Corrections.

State of Iowa v. Chris Robert Riley – FECR234254 – This defendant appeared for sentencing today having previously pled guilty on March 5, 2010, to one count of Burglary in the Second Degree, a Class C Felony. The defendant was placed on probation and ordered to complete the in jail treatment program and comply with any after care requirements that accompany that program. Failure to complete the in jail treatment program or the after care component will result in a violation of his probation. A ten year prison sentence was suspended and the defendant was placed on two years or probation through the Fifth Correctional District Department of Correctional Services.

Trisha Simmer was sentenced for the crimes of Conspiracy to Manufacture a Controlled Substance, methamphetamine, a Class C felony, and Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, in case number FE231267. Judgment was deferred and she was placed on probation for five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Eric Auguste plead guilty to and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, cocaine, a Class B felony, while in the immediate possession or control of a firearm, in case number FE235405. He was sentenced to a maximum indeterminate term of fifty (50) years in prison, and must serve a mandatory one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

William Larimer was sentenced to prison in Polk County Criminal Number FECR235528 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jerome Cannon appeared for a probation revocation hearing in case FE228679 for the crime of Burglary in the Third Degree. After a hearing, Judge Richard Blaine revoked his probation and sentenced him to five years in prison.

Kelley Johnson was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, heroin, a Class C felony, as a second or subsequent offender, in case number FE232547. He was sentenced to a maximum indeterminate term of twenty (20) years in prison, but this sentence was suspended and he was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Michelle Mireles pled guilty in Polk County Criminal Number FECR235406 to the crime of Possession of a Controlled Substance with Intent to Deliver. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Clifford Rice pled guilty in Polk County Criminal Number FECR233557 to the crime of Conspiracy to Manufacture a Controlled Substance, Possession of Ephedrine or Pseudoephedrine with Intent it be Used to Manufacture a Controlled Substance, and Possession of Lithium with Intent it be Used to Manufacture a Controlled Substance. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Stephen A. Lorenz appeared in Polk County District Court in criminal number FE 235687. Lorenz pleaded guilty to and was sentenced for the crimes of Possession of a Controlled Substance with Intent to Deliver (in excess of five grams of methamphetamine) and Failure to Possess a Tax Stamp. Lorenz was sentenced to terms of imprisonment not to exceed 25 years and five years respectively. The sentences are to be served consecutively to each other and Lorenz must serve a mandatory minimum one-third of the 25 year sentence before he is eligible for parole. Lorenz was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
