Weekly Case Summary

Nathan Kent appeared in court for sentencing for the crime of Theft in the Second Degree. Mr. Kent was sentenced to a term of incarceration not to exceed five years in prison. The defendant was immediately ordered into the custody of the Iowa Department of Corrections.

Melissa Bierman plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE232708. She will be sentenced on July 23, 2010 at 9:00 a.m. in courtroom 207 and faces a maximum indeterminate term of ten (10) years in prison, but this sentence may be deferred or suspended and she may be placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Nicholas Ceolla plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE235113. He will be sentenced on July 19, 2010 at 10:00 a.m. in courtroom 207 and faces a maximum indeterminate term of ten (10) years in prison, but this sentence may be deferred or suspended and he may be placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Mathew Rivers appeared for a probation revocation hearing. His probation was revoked and he was sentenced to a term not to exceed five years in prison in FECR 197815. He also plead guilty to second offense possession of a controlled substance, marijuana, and was sentenced to a year in custody to run concurrently with his felony probation revocation.

Khasif Rasheed White plead guilty to three counts of Robbery in the Second Degree in unrelated cases. In case number FECR230747 Khasif White committed a robbery at the Dahl’s Store located at 1320 E. Euclid in Des Moines. In that case, Mr. White attempted to steal a bottle of vodka when he was confronted by store employees. He assaulted the store employees in an effort to get away. In case number FECR232323 Mr. White committed a robbery at the Burlington Coat Factory on Merle Hay. In that case the defendant attempted to steal clothing items from the store. When he was stopped by store employees, he assaulted them in an effort to get away from the scene. In FECR235343 the defendant assaulted a man in his apartment building while he tried to steal the man’s wallet. He was apprehended shortly after the robbery and identified by the victim. Sentencing in each of these cases is set for July 27, 2010 at 8:30 a.m. in courtroom 208. The charge of Robbery in the Second Degree carries a mandatory sentence of 10 year in prison of which 7 years must be served before a person is eligible for parole.

Brandon Lathrop pled in Polk County Criminal Number FECR235608 to the crime of Possession of a Controlled Substance with Intent to Deliver as a Second or Subsequent Offender. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Defendant David Willoughby entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense as alleged in Count III of the Trial Information, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony Willoughby was sentenced to a period of incarceration not to exceed 5 years for the charges of: Possession of a Controlled Substance Third Offense as alleged in Count III of the Trial Information, in violation of Iowa Code Section (s) 124.401(5). The defendant shall be committed to the custody of the Director of the Iowa Department of Corrections David Willoughby was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On February 16, 2010, Defendant Marvin Bell, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense as alleged in Count I of the Trial Information, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony. On June 7, 2010, Defendant Marvin Bell was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense as alleged in Count I of the Trial Information, in violation of Iowa Code Section (s) 124.401(5). The sentence in this matter was suspended and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Marvin Bell was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 19, 2010, Dustin Wayne Rice, FECR233669, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On June 8, 2010, he came before the Court for sentencing and received a 5 year suspended sentence and probation with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Markus Coleman pled in Polk County Criminal Number FECR235925 to the crime of Possession of a Controlled Substance with Intent to Deliver. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Erica Hernandez pled in Polk County Criminal Number FECR236001 to the crime of Conspiracy to Deliver a Controlled Substance. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Carl West was sentenced to prison in Polk County Criminal Number FECR235380 for a period not to exceed 10 years for the crime of Delivery of a Controlled Substance. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Bobby Klinger Sr. was convicted by a jury of Burglary in the Third Degree. The defendant had previously been convicted of three felonies. At the time of his arrest, he had been released from prison- on work release- for those offenses. After the jury returned their verdict, Klinger requested that the Court expedite his sentencing date. On June 11, 2010 the defendant was sentenced to prison, as a Habitual Offender, for a prison sentence not to exceed fifteen years.

Isaiah Russell was sentenced after pleading guilty to two counts of Robbery in the Second Degree and one count of Conspiracy in Polk County Criminal case number FECR229695. The defendant was sentenced to an indeterminate term not to exceed twenty years of incarceration and will have to serve at least fourteen years in prison prior to being considered for parole.

Franreca Brown plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, as a habitual offender, in case number FE236401. She was sentenced to a maximum indeterminate term of fifteen (15) years in prison and must serve a mandatory minimum term of one-third. This sentence was also run consecutive to defendant’s current sentence for another drug felony. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Aaron Beem was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, and Possession of a Controlled Substance, Third Offense, in case numbers FE232818 and FE232155. He was sentenced to a maximum indeterminate term of ten (10) years and five (5) years, concurrent, and these sentences were suspended. Mr. Beem was placed on probation for a term of five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

David Callison was sentenced to prison in Polk County Criminal Number FECR230369 for a period not to exceed 15 years for the crime of Possession of a Controlled Susbtance (Third Offense) as a Habitual Offender. A Polk County jury had previously found the defendant guilty. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Raymond E. Becker – FECR236361 – This defendant pled guilty to Theft in the Third Degree, a lesser included offense of the trial information. The defendant received a suspended two year prison sentence and was placed on two years of formal probation. He is required to participate in the Victim Offender Reconcilation Program and determine amount of restitution to be paid to his employer from whom he stole.

State of Iowa v. Laura Ann Davidson – FECR236668 – This defendant pled guilty to Theft in the Third Degree, a lesser included offense of the trial information for her role in embezzling funds from her employer, Financial Plus Credit Union. The defendant was granted a deferred judgment and placed on two years of formal probation. Terms and conditions of probation are that she participate in the Victim Offender Reconciliation Program, make full restitution to Financial Plus Credit Union and perform 86 hours of community service.

State of Iowa v. Anthony Williams II – FECR235684 – This defendant pled guilty to Theft in the Third Degree as a lesser included offense of Count II in the trial information for his role in cashing a fraudulent check at a bank and receiving money in exchange for the check. A two year prison sentence was suspended and the defendant was placed on two years of formal probation. Terms and conditions of probation are that he participate in a Victim Offender Reconciliation Program and pay full restitution. He is also required to participate and complete the Adult Life Skills class.

State of Iowa v. Joel Isenberg – FECR236420 – This defendant pled guilty Theft in the Third Degree as a lesser included offense of count I in the trial information for his role in taking money from his employer D.I.T. computers. The defendant was granted a deferred judgment and placed on two years of formal probation. As terms and conditions of probation he is required to participate in the Victim Offender Reconciliation Program and make full restitution to the victim.

Defendant Anthony Ramirez appeared for sentencing in Polk County Criminal case numbers FECR234188 and OWOM068773 after successfully completing the In Jail Treatment Program. The Court placed the defendant on probation so long as he successfully complies with all conditions of probation including substance abuse aftercare.

Defendant Michael Scroggins appeared for a plea hearing in Polk County Criminal case numbers FECR231384 and FECR236323. The defendant pled guilty to Failure to Register as a Sex Offender (Second Offense), his prior probation was revoked, and he was sentenced to five years in prison.

Defendant Bryan Rodriguez appeared for a hearing on a probation violation in Polk County Criminal case numbers FECR215740 and SRCR215601. After finding that the defendant was now complying with probation, the Court held the defendant in contempt for sixty days. The Court allowed the defendant to purge the contempt so long as he is complying with probation.

Defendant Steven Neufeldt appeared for a hearing on a probation violation in Polk County Criminal case number FECR225287. After finding that the defendant was now complying with probation, the Court held the defendant in contempt for sixty days. Turner, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, in violation of Iowa Code Section(s) 124.401(5), a Class D Felony On June 11, 2010, Defendant Cody E. Turner, was sentenced to a period of incarceration not to exceed 5 years for the charges of: Possession of a Controlled Substance Third Offense as alleged in the Trial Information, in violation of Iowa Code Section (s) 124.401(5). The defendant shall be committed to the custody of the Director of the Iowa Department of Corrections Cody E. Turner, was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 16, 2010, Defendant Tommy A. Sly, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. On June 11, 2010, Defendant Tommy A. Sly was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, in violation of Iowa Code Section (s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 5 years. On June 11, 2010, Defendant Brian P. Lumadue was sentenced to a period of incarceration not to exceed 15 years for the charge of: Possession of a Controlled Substance Third Offense as a Habitual Offender, as alleged in the Trial Information, in violation of Iowa Code Section (s) 124.401(5), and 902.8. The sentence in this matter was suspended and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Brian P. Lumadue was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
