Weekly Case Summary
06/13/2011

On April 27th, 2011, Shannon Johnson, FECR243968, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony as a Second or Subsequent Offender, in violation of Iowa Code Section 124.411. On June 13th, 2011, he came before the court for sentencing. The State of Iowa argued for a 10 year prison sentence. The defense argued for probation. The Court sentenced him to prison for 10 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On June 13, 2011, Lisa Lowe stipulated to violating her probation. The Court revoked the defendant’s deferred judgment. Sentencing is set for 7-25-11 at 9:30 a.m. Courtroom 204.

On June 13, 2011, Cody Johnson’s Motion to Reconsider was rescheduled for June 22, 2011 at 3:30 p.m. Courtrom 204.

On June 13, 2011, Justin Valenti pled guilty to Theft in the 2nd Degree. Sentencing is set for August 16, 2011 at 9:00 a.m. Courtroom 204.

On June 13, 2011, Fritzie Bailey stipulated to violating her probation. The Court revoked her probation for Theft in the 1st Degree. Ms. Bailey was sentenced to prison for a term not to exceed 10 years.

On June 13, 2011, the Court modified David Robinson’s No Contact Order. Mr. Robinson is allowed supervised contact with his children, as provided by DHS. The defendant has been charged with Child Endangerment.

On June 13, 2011, Nathan Brown stipulated to violating his probation. The Court revoked the defendant’s probation and sentenced him to prison. The defendant also pled guilty to Escape. The defendant was sentenced to thirty days in jail consecutive to the probation violation.

On June 13, 2011 Cory Strumpfer pled guilty to Fraudulent Practice in the 3rd Degree. The Court granted Mr. Strumpfer a suspended sentence and he was placed on probation.

On June 13, 2011 Christopher Lewis pled guilty to Operating a Motor Vehicle Without Owner’s Consent and OWI. The Court granted Mr. Lewis a suspended sentence and he was placed on probation.

On June 13, 2011, Keven James Gabriel was sentenced to five years in prison for operating while intoxicated causing serious injury. This comes from an incident on November 14, 2010 at 4:45 a.m. when Mr. Gabriel, driving at a high rate of speed, ran the stop light at Fleur and McKinley in Des Moines and broadsided a vehicle with three passengers. The other vehicle was sent to the southeast corner of the intersection and was totaled. During the investigation Mr. Gabriel submitted to chemical testing which revealed a blood alcohol concentration of .190%--over twice the legal limit. The husband and wife victims, ages 76 and 72, respectively, were sent to hospital by ambulance for treatment of serious injuries. The husband suffered from bleeding on the brain and a lacerated liver. The wife had glass imbedded in her face and sustained a broken clavicle. Both victims were hospitalized for several weeks and relied on the help of family and friends after they discharged. Both victims are also still receiving long-term treatment for the injuries they sustained. At the time of this crime, the victims were on their way to the Des Moines airport to catch an early flight to Arizona for a family event.

On June 14, 2011 Charrell Shetworth’s Motion in Arrest of Judgment was set for hearing on June 27, 2011 at 10:30 a.m. Courtroom 204.

On June 14, 2011, Alonzo Williams was ordered to be interviewed by Pretrial Release. The bond review was set for June 27, 2011 at 10:30 a.m. Courtroom 204.

On June 14, 2011, the Court changed Darrell Williams’ bond to $25,000 cash or surety.

On June 14, 2011, the Court changed Ashlee Matthias’ bond to $10,000 cash or surety.

On June 14, 2011, the Court sentenced Cody Jorgenson for eluding, OWI 2nd and Driving while license revoked. The Court granted Mr. Jorgenson probation and a suspended sentence.

On June 17, 2011, Nicholas Hill was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE242552. He was sentenced to a maximum indeterminate term of ten (10) years in prison and must serve a mandatory one-third of the sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
