On May 2, 2011, David Alan Hansen, FECR239174, pled guilty to Manufacturing a Controlled Substance-Psilocybin/Psilocin mushrooms, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(8), a Class C Felony. On June 20, 2011, this case came before the court for sentencing with the defendant receiving a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.
On May 10th, 2011, Craig E. Tracy, FECR243973, pled guilty to Manufacturing a Controlled Substance-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. The State argued for a five year suspended sentence and probation, since the defendant had already received a deferred judgment on a possession case in 2004 out of Story County. On June 21, 2011, Elizabeth Best was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, in case number FE239526, as a second or subsequent offender. She was sentenced to a maximum indeterminate term of thirty-five (35) years in prison and must serve a mandatory one-third of the sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On June 21, 2011, Janet Leon plead guilty to the crime of Delivery of a Controlled Substance, a Class C felony, in case number FE223783. On June 22, 2011, defendant Charles Barnes entered a plea of guilty to Assault With Intent to Commit A Sexual Abuse, an Aggravated Misdemeanor. Sentencing is scheduled for August 16, 2011, at 8:30 a.m. in Room 209.
On June 22, 2011, Randy L. Rice appeared in Polk County District Court in criminal number FE244773 and SMAC 311078. Rice pleaded guilty and was sentenced for the crimes of Manufacturing a Controlled Substance (in excess of five grams of methamphetamine) as a Second or Subsequent Offender and Assault respectively. Rice was sentenced to a period of imprisonment not to exceed 45 years on the manufacturing charge. He must serve a mandatory minimum one-third of that sentence before being eligible for parole. However, the mandatory minimum was reduced by one-third based on his acceptance of responsibility. Rice was sentenced to 30 days in the Polk County Jail and given credit for the time he has served on the assault charge. Rice was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On June 22, 2011, Dawn Woodruff was sentenced for the crimes of Conspiracy to Manufacture a Controlled Substance, a Class C felony, and Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, in case number FE242179. She was sentenced to a maximum indeterminate term of ten (10) years in prison for the Class C felony and five (5) years in prison for the Class D felony, consecutive, and must serve a mandatory one-third of the ten (10) year sentence prior to becoming eligible for parole. On Friday, June 24, 2011, Timothy Kendrick received a term of incarceration not to exceed 5 years in prison after pleading guilty to being a Felon in Possession of a Firearm. When Kendrick was arrested by the Des Moines Police Department on February 17,2011, he was found to be in possession of a Guardian .380 automatic handgun. Kendrick was previously convicted of Possession of a Controlled Substance in 2002, 2007, and 2008 and, Theft in the Second Degree in 1999.
On May 6th, 2011, Yvonne R. Martinez, SRCR243721, pled guilty to Conspiracy to Deliver a Controlled Substance-methamphetamine, as a lesser included offense of Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On June 24th, 2011, she came before the court for sentencing. The State argued for a ten year suspended sentence and probation. The defense argued for a deferred judgment. The Court granted the defendant a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

He was sentenced to a maximum indeterminate term of ten (10) years in prison for the Class C felony and five (5) years in prison on each Class D felony, and these sentences were ordered to run consecutive to each other for a total of twenty (20) years in prison.
