Weekly Case Summary
6/28/2010

Gustavo Morales was found in contempt of court for violating his terms of probation. He was sentenced to jail for 20 days and ordered to undergo evaluation and treatment for substance abuse.

Dallas Ross Selby stipulated to violating his probation. As a result, he lost his deferred judgment and was sentenced to prison for up to 10 years.

Eduardo Gutierrez pled guilty to Serious Injury by Vehicle and OWI. He was sentenced to prison for up to five years.

Ralph Bills, Jr. stipulated to violating his probation. He was sentenced to prison for a combined term of years not to exceed six.

Mary L. Lasche was given 30 days contempt for violating her probation.

Aenoy Prathane stipulated to violating his probation; pled guilty to domestic assault with intent to commit serious injury; and was sentenced to prison.

On March 29, 2010, Defendant Tiffany L. Guzman, entered a plea of guilty to the charges of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge as alleged in Count I of the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24, and 155A.23. On June 28, 2010, Defendant Tiffany L. Guzman, was sentenced to a period of incarceration not to exceed 10 years for the charges of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge as alleged in Count I of the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24, and 155A.23. The sentence in this matter was suspended and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Tiffany L. Guzman, was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Ivan Gutierrez was sentenced to prison in Polk County Criminal Number FECR236002 for a period not to exceed 25 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau

Cesar Ponce a/k/a Ismeal Pacheco-Ponce was sentenced to prison in Polk County Criminal Number FECR235999 for a period not to exceed 25 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Desiree Gomez plead guilty to the crime of Conspiracy to Deliver a Controlled Substance, a Class C felony, in case number FE234891. She will be sentenced on August 10, 2010 at 9:00 a.m. in courtroom 207 and faces a maximum indeterminate term of ten (10) years with a mandatory one-third term which she must serve prior to becoming eligible for parole, but this sentence may be suspended and she may be placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Ira Eugene Frazier AG235265 was sentenced to probation for Failure to Comply with the Sex Offender Registry. He was ordered to complete all required programming as determined by his correctional treatment team.

Benjamin Hale Sr. was sentenced to five (5) years in prison for a charge of Burglary 3rd Degree in FE235005. Although he successfully completed a residential treatment program, the Court advised he could not overlook the defendant’s significant criminal history and repeated failures while on previous probations.

Daniel Dufoe was sentenced to prison in FE204458. Dufoe was granted probation on charges of Theft 2nd and burglary of 2 motor vehicles. His probation was transferred to Missouri. After a term of probation, Dufoe missed an appointment and was advised a warrant would be issued for his arrest. He then stopped reporting to his probation officer and absented himself from supervision for nearly a year before he was arrested on the warrant. Although he reported to the Court he had been working the whole time and he had not been arrested on new charges, the Court revoked his probation and imposed the original sentence of five (5) years, two (2) years and two (2) years concurrent to each other.

Raul Dominguez-Garcia was sentenced to prison in Polk County Criminal Number FECR236448 for a period not to exceed 10 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

William Pargo was found guilty by a Polk County Jury of Possession of a Controlled Substance with Intent to Deliver – Cocaine Base Crack in Polk County Criminal Number FECR234743. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Abel Aguirre-Zamora was sentenced to prison in Polk County Criminal Number FECR236439 for a period not to exceed 25 years for the crime of Conspiracy to Deliver a Controlled Substance - Methamphetamine. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Cary F. Johnston appeared in Polk County District Court in criminal number FE235755. Johnston earlier pleaded guilty to the crime of Possession of Ephedrine or Pseudoephedrine With Intent It Be Used To Manufacture A Controlled Substance (methamphetamine). On this date, Johnston was granted a deferred judgment and placed on probation for a period of two years. She must pay a civil penalty of $750.00 and continue drug treatment. Johnston was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2010, Defendant Rebecca R. Watkins entered a plea of guilty to the charges of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge as alleged in Counts I and II, Class Felonies and Failure to Possess a Drug Tax Stamp, as alleged in Count II of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24, 155A.23, 453B.3, and 453B.12. On June 30, 2010, Defendant Rebecca R. Watkins was sentenced to a period of incarceration not to exceed 25 years for the charges of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge as alleged in Counts I and II, Class Felonies and Failure to Possess a Drug Tax Stamp, as alleged in Count II of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24, 155A.23, 453B.3, and 453B.12. These sentences shall run consecutive to each other. The sentences in this matter were suspended and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Rebecca R. Watkins was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Alexander Cadwell was sentenced in FE232981 to ten (10) years in prison for Theft 1st Degree and five (5) years in prison for Criminal Mischief 2nd Degree. He previously pled guilty as part of a plea deal. He is accused of stealing and stripping a car worth over $10,000. Cadwell also had a probation revocation pending in FE215324 for which he had been granted a suspended sentence in 2008. Cadwell was on probation for Theft 1st Degree and had a ten (10) year suspended sentence. After he pled on the new charges, Cadwell was released pending sentence and required to report to his probation officer. Among the conditions of probation he was required to follow was to abstain from the use of any alcohol or drug and to abide by the law. Cadwell subsequently admitted he had used methamphetamine and alcohol on this release, which was a violation of his probation and the law. At the time of his plea, the parties had agreed the Court would imposed a suspended consecutive 25 year sentence if Cadwell did not commit any new violations. At sentencing on June 30, 2010, the Court imposed the full sentence of twenty five years.

Shawn Long pled guilty to Escape SRCR235015 and was sentenced to 30 days in jail. He is currently on probation for other offenses. The Court ordered that he participate in the In Jail Treatment Program, pending his dispositional hearing for the probation violation.

Ryan Lanham stipulated to violating his probation in FECR227387 Burglary 3rd Degree and was sentenced to prison for a term not to exceed 5 years.

Ryan Semple stipulated to violating his probation and has it extended to June 11, 2011.

Toni Gandy-Fisher stipulated to violating her probation and was sentenced to serve 30 days contempt time in the Polk County Jail.

Robert Jay Taylor was revoked from Intensive Supervision Drug Court for being arrested on a new charge of Domestic Abuse Assault and for drinking and lying in violation of program rules. He stipulated to the violations and his probation was revoked in FE195924. He was also sentenced in FE201374 to the charge of Forgery. He was sentenced to prison for five years on each, consecutive. In addition, he pled guilty to Domestic Abuse Assault Causing Injury and was sentenced to an additional term of one year.

Tony Grimm was revoked from Intensive Supervision Drug Court for absconding from department of corrections supervision. He stipulated that he violated the terms and conditions of his probation and was sentenced to a period of incarceration not to exceed twenty (20) years in FE221060.

Aaron Walske was revoked from Intensive Supervision Drug Court for absconding and being arrested on new drug and criminal mischief charges. He was sentenced on a Theft 2nd Degree and Failure to Appear for a total term of incarceration not to exceed ten (10) years. He was also given credit for 30 days time served on a malicious prosecution charge.

Jenna Ly pled guilty to fraudulent practice 3rd degree for defrauding Iowa Medicaid in FE236388. She paid the government back the $2062.80 she received fraudulently and the court granted her a deferred judgment. She will be on probation for 6 months and will need to pay a $625.00 civil penalty. She will be barred from providing services through Medicaid in the future.

Ronald Ramsey was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class C felony, in case number FE232816. He was sentenced to a maximum indeterminate term of ten (10) years with a mandatory one-third term which he must serve prior to becoming eligible for parole, but this sentence was suspended and he was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Travis Harvey – FECR217501 – A disposition hearing was held regarding the probation violation of this defendant. The defendant was ordered to serve 24 days in jail as contempt time and gave a credit for the 24 days he has already served. As additional conditions of probation he is to complete intensive outpatient treatment with UCS and the defendant shall not drive until and only if an intoxilizer is installed on his vehicle.

State of Iowa v. Darcy Fairman – FECR237365 – This defendant pled guilty to Forgery as an aggravated misdemeanor for attempting to cash a forged check. The defendant was ordered to complete substance abuse treatment at Iowa Residential Treatment Center at Mt. Pleasant prior sentence. Sentencing was set for August 12, 2010, at 9:00 a.m. in room 204.

State of Iowa v. Deanne Lynn Schipper, FECR207874
The defendant in this case appeared before the Court on July 2, 2010, at the time and place scheduled for a dispositional hearing on a probation violation report. The defendant had previously stipulated to violating the conditions of her probation as reported. After consultation with the defendant’s attorney, the State’s attorney and the probation officer, it was the decision of the Court to revoke the defendant’s probation and sentence her to the original term of 10 years in prison. The defendant’s probation was revoked due to her prior criminal record and her continued use of controlled substances while on probation.

State of Iowa v. Wilmot Johnson, FECR233443
The defendant in this case appeared before the Court on July 2, 2010, and plead guilty to the charge of Theft in the Second Degree, a class D felony. Sentencing was set for August 13, 2010, at 9:00 a.m. in courtroom 204 of the Polk County Courthouse. Both the State and the defendant will have the opportunity to argue for whatever sentence they feel is appropriate. The defendant faces a maximum penalty of five years in prison.

State of Iowa v. Christopher Love Brown, FECR235718
The defendant in this case appeared before the Court on July 2, 2010, for the purpose of a competency hearing. After a hearing on the record, and after review of the psychological evaluation report prepared for the defendant in this case, the Court found that the defendant is suffering from a mental disorder which prevents him from appreciating the charges, understanding the proceedings or assisting effectively in his own defense. As a result, the Court ordered that further proceedings in this case are suspended until further Order of the Court. The defendant was then committed as a safe keeper to the custody of the Director of the Department of Corrections at the Iowa Medical and Classification Center for treatment by a psychiatrist or other appropriate medical personnel. The result of this hearing was that the defendant would remain in the custody of the State until his competency is restored at which time a new trial date would be set.
