One Hundred fifty-six Defendants were sentenced for Operating while under the Influence (OWI) in Polk County District Courts the weeks of July 11, July 18, July 25 and August 1, 2011.
One Hundred-fifteen of those defendants were sentenced for OWI First Offense. OWI, First Offense is a Serious Misdemeanor, punishable by a maximum sentence of one year in the County Jail and a maximum fine of $1250. The Court MUST impose a minimum of two days incarceration and a fine of $1,250, upon conviction. Blood Alcohol levels are shown below in parentheses. DRE indicates that the conviction was based upon use of drugs other than alcohol. REF means that the defendant refused the chemical test. A deferred judgment (non-conviction) is usually available to those defendants who test below .150 for a first offense.

Of those defendants sentenced for OWI first offense this report, forty-one had a test of greater than .160 (twice the legal limit). The low chemical test among this group was .095 and the high test was .269 (over three times the legal limit). Eleven defendants were found guilty and sentenced based upon their use of drugs other than alcohol and twenty refused chemical testing.
Thirty-one Defendants were sentenced for OWI Second Offense. OWI second offense is an Aggravated Misdemeanor punishable by up to two years in prison and a fine of up to $6250. The Court MUST impose a minimum of seven days incarceration and a minimum fine of $1875 upon conviction of Second Offense OWI. Johnston (.169), Markham Humphrey (.186) Humphrey was sentenced to two years in prison, Gabriel R. Leitner (.186), Kenneth P. Fitzgerald (.190 and .275) Fitzgerald was sentenced to serve 68 days in the Polk County Jail for two counts of OWI second offense, Travis W. Marquis (.202), Byrce J. Abel (.208), Derrick Smith (.231), Pascual Saldana Arroyo (.255), Stacia L. Newlin (.274), Richard C. Samuelson (.314), Walter Bickham (REF), James W. McMahan (REF), Gregory A. Of those Defendants sentenced for OWI second offense who took a chemical test, those tests ranged from a low of .106 to a high of .314 (almost Four times the legal limit). Twelve of these defendants refused the chemical test,. The State of Iowa has a legislatively set, presumptive level of intoxication of .08.
There were ten defendants sentenced this reporting period for Third Offense OWI. Third Offense OWI is a Class D felony, punishable by up to five years in prison and by a fine of up to $7500. The Court MUST sentence a Defendant convicted of Third Offense OWI to a minimum of thirty days in jail and a minimum fine of $3125. Douglas A. Johnson (REF) Johnson was sentenced to Five years in Prison, all but 90 days being suspended, and probation for two years and fined $3125, Bruce M. Paulson (.201), Robert Matthew Shaver (REF) were sentenced to five years in prison all but 60 days suspended and placed on probation for five years. Aaron Ray Hodges (REF), Kirby D. Talley (REF), Tamar M. Collins (REF), Marvin K. Griffin (REF), Jeremy E. Evans (REF), Kyle L. Parker (.241) and Steve Ramos Jr. were all sentenced for OWI third offense sentenced to serve five years in prison and fined $3125.They may serve all or part of their prison sentence in an OWI residential correctional setting such as the one operated by the Department of Corrections on the grounds of the Fort Des Moines Facility.
