Weekly Case Summary
07/18/2011

On July 18, 2011, Lontez Young plead guilty and was sentenced for the crime of Delivery of a Controlled Substance, a Class B felony, in case number FE244660. He was sentenced to a maximum indeterminate term of twenty-five (25) years in prison and must serve a mandatory one-third term prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 18, 2011, Shaley Hillsman plead guilty to the crime of Conspiracy to Deliver a Controlled Substance, a Class C felony, in case number FE244659. She will be sentenced on August 29, 2011 at 9:00 a.m. in courtroom 207 and faces a maximum indeterminate term of ten (10) years in prison with a mandatory one-third term which she must serve prior to becoming eligible for parole. This sentence can be suspended or a deferred judgment may be entered and she may be placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 18, 2011 Melissa Meyers pled guilty to 2 Counts of Forgery. Her sentencing is set for August 31, 2011 at 9:00 a.m. in Courtroom 204.

On July 18, 2011, Kristopher Brookes pled guilty to Theft in the 2nd Degree and Burglary in the 3rd Degree. Sentencing is set for August 31, 2011 at 9:30 a.m. in Courtroom 204.

On July 19, 2011, Timothy Gantz plead guilty and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case number FE248235. Judgment was deferred and he was placed on probation for two (2) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On June 1st, 2011, Kimberly Kendall, FECR243208, pled guilty to the offense of Conspiracy to Manufacture a Controlled Substance-methamphetamine, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony. On July 19th, 2011 she came before the court and received a deferred judgment and probation. The State was willing to jointly recommend a deferred judgment in this case, because the defendant cooperated with police and was willing to testify against her co-defendant Shea Rolling, FECR243207, who eventually pled guilty and was sentenced to prison for manufacturing methamphetamine. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

Jamie Lyons appeared for probation violation hearing in FE213041 for failing to maintain contact with her probation officer for nearly 6 months. The Court found that although she had made efforts to make contact, there was no contact and it was her responsibility to do so. The Court acknowledged that she has been on probation for 4 years and this is the first violation reported. The Court found her in contempt and sentenced her to 90 days in jail and then ordered her probation be discharged.

On July 19, 2011, Jovani Rubio was sentenced in Polk County Criminal Number FECR2400035 for the crime of Posession of an Offensive Weapon. The Court granted Jovani Rubio a deferred judgment and placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Eric Kovaleski entered a plea of guilty AG246223 to the charge of Burglary 3rd Degree and FE246835 to three counts of Burglary in the 3rd Degree. His sentencing was continued to allow him to participate in the Drug Court Program. Kovaleski will be sentenced to twenty years at the conclusion of his participation in Drug Court. If he is successful in the program, he will be granted a suspended sentence. He will be required to make restitution on all matters, including 6 dismissed charges.

Jennifer Tucker pled guilty in FE242992 to Fraudulent Practice 2nd Degree for fraudulently obtaining unemployment benefits. She will be sentenced in September.

Merrill Hankins, III as granted probation in FE244389 for Theft 1st, Criminal Mischief 1st, Theft 2nd and Burglary 3rd. he and several others broke into a business, Keldermann Lime, and damaged the property in an effort to steel copper and then stole major equipment to sell to support their drug habit. The Defendant expressed remorse and acknowledged he did not want to continue to live the lifestyle of an addict. He successfully completed substance abuse treatment at Mt. Pleasant. As a condition of his probation, he will be required to reside at a ½ way house and follow the treatment requirements. If he is unsuccessful on probation, he will be sentenced to prison for 20 years. He is required to make restitution for the damages done to the business.

Sage Talon pled guilty to Burglary 3rd Degree in FE245883. He and several other broke into the Last Stop Beverage Store in Des Moines and stole liquor. He will be sentenced in September.

On July 21, 2011, Marlanda Carr was sentenced to an indeterminate term of incarceration not to exceed 10 years in Polk County Criminal Number FECR245290 for the crime of Posession of a Controlled Substance with Intent to Deliver (Cocaine Base "Crack"). Over the State’s objection and notwithstanding the fact that the defendant had a long and violent criminal history and multiple opportunities at rehabilitation, the Court granted Marlanda Carr a suspended sentence and placed her on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 21, 2011, Ramiro Gonzales was sentenced to an indeterminate term of incarceration not to exceed 10 years in Polk County Criminal Number FECR240790 for the crime of Posession of a Controlled Substance with Intent to Deliver (Methamphetamine). The Court granted Ramiro Gonzales a suspended sentence and placed hhim on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Gerald Zickefoose pled guilty and agreed to prison in three criminal matters. The Defendant admitted he burglarized a residence of a woman he knew, breaking into and stealing property. While in the residence, someone came home. He pled guilty to Burglary 2nd Degree in FE237141. Further he admitted he has twice been convicted of felonies in the past and that he was a habitual offender, thereby enhancing the sentence. He also admitted he provided a woman with a check he forged and asked her to cash the check. This is a forgery as charged in FE237487. He pled guilty pursuant to North Carolina v. Alford to Willful Injury, as a lesser included offense in FE247921 for knocking the teeth of Christopher Hamilton out. He requested immediate sentencing and pursuant to the plea agreement was sentenced to twenty (20) years in prison. He will not be eligible for parole before serving a minimum three (3) years of his sentence

State of Iowa v. David Maffett – FECR247485 – This defendant was arraigned on the charges of Possession of a Controlled Substance With Intent to Deliver, a Class D felony; Failure to Possess a Tax Stamp, a Class D felony; and Possession of a Controlled Substance, a Serious Misdemeanor. To all these charges the defendant entered a plea of not guilty and a pretrial conference was set for August 18, 2011, at 2:00 p.m. in Room 207. Trial was set for September 21, 2011.

State of Iowa v. Alec Larson – FECR247278 – This defendant was arraigned on the charge of Identity Theft as a Class D felony and entered a plea of not guilty. A pretrial conference was set for August 18, 2011, at 9:45 a.m. in Room 204 and trial was set for September 21, 2011.

State of Iowa v. Charles Griffith – FECR247021 – This defendant was arraigned on the charges of Possession of a Controlled Substance With Intent to Deliver, a Class D felony and Failure to Possess a Tax Stamp, a Class D felony. To both these charges the defendant entered a plea of not guilty and a pretrial conference was set for August 18, 2011, at 2:15 p.m. in Room 207. Trial was set for September 21, 2011.

State of Iowa v. Demir Sehic – FECR247443 – This defendant was arraigned on the charge of Criminal Mischief in the Second Degree, a Class D felony and entered a plea of not guilty. A pretrial conference was set for August 18, 2011, at 2:00 p.m. in Room 204 and trial was set for September 21, 2011.

State of Iowa v. Aaron Hickman – FECR247484 – This defendant was arraigned on the charges of Possession of a Controlled Substance With Intent to Deliver, a Class D felony; Failure to Possess a Tax Stamp, a Class D felony; and Possession of a Controlled Substance, a Serious Misdemeanor. To all these charges the defendant entered a plea of not guilty and a pretrial conference was set for August 18, 2011, at 2:00 p.m. in Room 207. Trial was set for September 21, 2011.

State of Iowa v. Shadow Ross – FECR247436 – This defendant was arraigned on the charges of Burglary in the Third Degree, a Class D felony; Operating a Motor Vehicle Without Owner’s Consent, an Aggravated Misdemeanor; and Operating a Motor Vehicle While Under the Influence of Alcohol, a Serious Misdemeanor. To all these charges the defendant entered a plea of not guilty and a pretrial conference was set for August 18, 2011, at 1:30 p.m. in Room 204. Trial was set for September 21, 2011.

State of Iowa v. Jason Mays – FECR247024 – This defendant was arraigned on two counts of Identity Theft, both Class D felonies and entered a plea of not guilty to both charges. A pretrial conference was set for August 18, 2011, at 9:30 a.m. in Room 204 and trial was set for September 21, 2011.

State of Iowa v. Johnna Waddell – FECR245088 – This defendant plead guilty to one count of Forgery as a Class D felony and admitted she attempted to cash a counterfeit payroll check with the intent to defraud. The defendant will participate in a presentence investigation report and sentencing has been set for August 30, 2011, at 9:30 a.m. At that time the parties are free to argue for any legal sentence.

On June 3rd, 2011, Defendant Stefan Collier, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver and Possession of a Controlled Substance, as alleged in the Trial Information, a Class D Felony and serious misdemeanor, in violation of Iowa Code Section(s) 124.401(1)(d) and 124.401(5). On July 22nd, 2011, Defendant Stefan Collier was sentenced to a period of incarceration not to exceed 5 years and 1 year for the charges of: Possession of a Controlled Substance With Intent to Deliver and Possession of a Controlled Substance, as alleged in the Trial Information, a Class D Felony and serious misdemeanor, in violation of Iowa Code Section(s) 124.401(1)(d) and 124.401(5). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Stefan Collier was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On June 3rd, 2011, Defendant Ceeron Williams, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On July 22, 2011, Defendant Ceeron Williams was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Ceeron Williams was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Ryan Gist, Chad Lindberg, Kameron Kitselman, Irri Young, Andrew Buelt, and Megan Harris, all appeared for arraignment on their respective charges. They all entered not guilty pleas and the Court scheduled pretrial conferences and trial dates on their cases.

Marquice Morris pled guilty to Theft in the First Degree and Assault with Intent to Inflict Serious Injury in Polk County Criminal case number FECR246037. Sentencing was set for August 5, 2011.

On July 22, 2011, Lucio Diaz plead guilty and was sentenced for the crimes of Conspiracy to Deliver a Controlled Substance, a Class B felony, Delivery of a Controlled Substance, a Class B felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE245772. He was sentenced to a maximum indeterminate term of twenty-five (25) years and five (5) years, concurrent, and must serve a minimum term of one-third of the twenty-five (25) year term prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 22, 2011, James Cogdill was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, as a second or subsequent offender in case number FE244591. He was sentenced to a maximum indeterminate term of twenty (20) years and must serve a minimum term of one-third of the sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
