Randall Scott Smith pled guilty in FE247154 to Failure to Register as a Sex Offender, 2d offense, He was already on probation in FE217554 for a similar offense. He agreed to consecutive suspended sentences with placement at the Fort Des Moines Facility as a condition of his probation.
Thomas Mallory stipulated that he violated the terms and conditions of his probation by drinking alcohol. He requested the Court set out his sentencing so he could obtain a substance abuse evaluation.
Nolan Herring stipulated he violating the terms and conditions of his probation by drinking alcohol. He requested immediate sentencing with placement at a residential treatment facility in Fort Dodge. The Court continued him on probation but kept him in jail until there is a bed at treatment. He will then reside in a ½ way house.
Daved Harrision stipulated to violations of probation in FE238733 for committing a new offense. He pled guilty to Theft 4th degree for changing pricing labels at the Kohl’s store. He pled guilty to the Theft charge and was given credit for time served. He was sentenced to prison for the original charge of Burglary in FE238733.
Lisa Lowe appeared for a probation violation in FE183255. She was originally granted a Deferred Judgment in 2004 for the charge of Forgery. She absconded probation in 2007. She was arrested in July, 2011. She admitted to the violations. The Court revoked her Deferred Judgment and sentenced her to prison for five (5) years.
Kambron Marcus Paige is on probation for carrying weapons on school grounds in FE243269. Since being granted probation two months ago, he has continued to use marijuana. He claims to be participating in treatment at Urban Dreams. He was arrested on a warrant for probation violation and stipulated to those violations as indicated above. He is required to cooperate with a substance abuse evaluation pending disposition hearing August 8.
Robert John Boudreau stipulated to violating the terms and conditions of his probation in FE243270. He was on probation for forgery and absconded supervision after completing residential substance abuse treatment and then residing at the Harbor of Hope for a month. He argued for placement at the Fort Des Moines Facility, but the Court cited his current absconding and his prior lack of success on probation and parole in revoking his probation and imposing the original 5 year sentence.
On July 25th, 2011, Marisol G. Martinez, FE245774, pled guilty to the offense of Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. Due to having an immigration hold, the defendant requested immediate sentencing. She was sentenced to prison for five years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
