On August 1, 2011, Leshawn Price pled guilty in Polk County Criminal Number FECR244817 to the crime of Possession of a Controlled Substance with Intent to Deliver (Cocaine Base "Crack"). Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 1, 2011, Robert Rogers appeared in Polk County District Court in criminal number FE 241287 for sentencing. Rogers earlier pleaded guilty to Conspiracy to Manufacture a Controlled Substance (in excess of five grams of methamphetamine) and Arson in the First Degree. Rogers was sentenced to a term of imprisonment not to exceed 25 years on each charge and must serve a mandatory minimum one-third of the conspiracy sentence. The sentences were ordered to be served concurrently with each other. The conviction stems from a fire resulting from the manufacturing of methamphetamine at an apartment complex locate at 700 E. Fifth Street in Des Moines, Iowa on October 2, 2010. A codefendant, Henry Dittmer, is awaiting trial. Rogers was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 1, 2011, Bill Van Pelt plead guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE238422, and admitted that he is a second or subsequent offender. He will be sentenced on September 16, 2011 at 9:00 a.m. in courtroom 207. He faces a maximum indeterminate term of thirty (30) years and must serve a minimum term of one-third prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 1, 2011, Janet Leon was sentenced for the crime of Delivery of a Controlled Substance, a Class C felony, in case number FE223783. She was sentenced to a maximum indeterminate term of ten (10) years and must serve a minimum term of one-third prior to becoming eligible for parole. This sentence was suspended and she was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Nicholas Verhuel, Bobby Hester, Cicilia Atary, Joseph Boyer, Ronald Young, Brandon Beenken, Jessica Bensley, Frederick Crawford, and Trinette Harmon appeared for arraignment on their respective criminal cases. All defendants pled not guilty and a pretrial conference hearing and trial date were set on all of their cases.
Ryan Mullin appeared for a bond review hearing in Polk County Criminal case number FECR247544. Mullin asked the Court to reduce his bond. Due to his multiple pending cases and criminal history, the Court denied his request.
Melinda Gatton pled guilty to Theft in the Third Degree in Polk County Criminal case number FECR231013. The Court deferred judgment, ordered her to pay victim restitution and placed the defendant on probation.
Jor Rual appeared for a disposition hearing after stipulating that he violated terms and conditions of his probation in Polk County Criminal case number FECR240007. The Court did revoke his probation and sentenced him to prison.
James Bush pled guilty to Forgery in Polk County Criminal case number FECR246386. The Court sentenced him to a prison sentence to run consecutively to his soon-to-be revoked parole.
Justin Formaro pled guilty to Burglary in the Third Degree in Polk County Criminal case number FECR237603 and was sentenced to prison.
John Dameron pled guilty to Fraudulent Practice in the Second Degree in Polk County Criminal case number FECR243188. Sentencing was scheduled for a later date.
On August 1, 2011, Bobby White pled guilty, pursuant to North Carolina vs. Alford, to Assault with Intent to Commit Sexual Abuse. Sentencing is set for September 9, 2011 at 3:00 p.m. Courtroom 206.

On June 22nd, 2011, Karmel Holt, FECR244774, pled guilty to Possession of a Controlled Substance with Intent to Deliver-cocaine salt hydrochloride, as alleged in Count I of the amended Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(2)(b) and 124.401(1)( c )(2)(d), a Class C Felony. On August 3rd, 2011 she came before the court for sentencing and received a 10 year suspended sentence and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 3, 2011, defendant Zane Schryock appeared for his arraignment. Pretrial conference is set for September 1, 2011, at 2:45 p.m. in Room 204. Trial is set for September 28, 2011, at 9:00 a.m. in Room 204.

On August 3, 2011, defendant Susan Davis entered a plea of guilty to the charge of Fraudulent Practice in the Second Degree, a Class D felony. She was placed on probation for a period of two years and judgment was deferred until successful completion of that probation.

On June 23, 2011, Sherry Lee Only, FECR245323, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-methamphetamine, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony. On August 4th, 2011, she came before the Court for sentencing and received a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 4th, 2011, Daniel W. Weir, FECR242956, pled guilty to Delivery of a Simulated Controlled Substance-simulated methamphetamine, as alleged in Count I of Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony as a second or subsequent offender, in violation of Iowa Code Section 124.411. He waived time and notice and was sentenced to 15 years in prison. The Defendant was also sentenced on case SRCR238469. On September 10th, 2010, he pled guilty to Possession of a Controlled Substance-Third Offense, as alleged in Trial Information SRCR238469, in violation of Iowa Code Section 124.401(5), a Class D Felony. The Defendant failed to appear for sentencing on December 6th, 2010 and a warrant was issued. He received a 5 year prison sentence in SRCR238469 which ran consecutive to FECR242956 for a total period of incarceration not to exceed 20 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 4, 2011, Scott LaRue pled guilty to 2 Counts Lascivious Acts with a Child. Sentencing is set for September 16, 2011 at 8:30 a.m. Courtroom 209A.

Devon Carr – FECR247850 – This defendant was arraigned on the charges of Eluding a Police Officer, Class D felony; Possession of a Controlled Substance, Serious Misdemeanor; and Possession of a Controlled Substance, Aggravated Misdemeanor. To all these charges the defendant entered a plea of not guilty and a pretrial conference was set for September 1, 2011, at 2:00 p.m. in Room 204. Trial date was set for October 3, 2011.
State of Iowa v. Antonio Ross – FECR247313 – This defendant was arraigned on the charge of Theft in the Second Degree, a Class D felony and entered a plea of not guilty. Pretrial conference was set for September 1, 2011, at 3:15 p.m. in Room 204 and trial was set for October 3, 2011.
State of Iowa v. Meegan Ford – FECR242455; FECR242456 – This defendant was arraigned on several charges of Identity Theft and Unauthorized Use of a Credit Card. To all of the charges the defendant entered a plea of not guilty and a pretrial conference was set for September 1, 2011, at 11:15 a.m. in Room 204 and trial was set for October 1, 2011.
State of Iowa v. Joshua Carrington – FECR247542 – This defendant was arraigned on the charge of Theft in the First Degree, a Class C felony and entered a plea of not guilty. Pretrial conference was set for September 1, 2011, at 2:45 p.m. in Room 204 and trial was set for October 3, 2011.
On August 4, 2011, the defendant, John Michael Donahey, Jr., appeared in Polk County District Court and plead guilty to Assault by Use of a Dangerous Weapon (a car), Count I, Criminal Mischief in the Third Degree, Count II and OWI Second Offense, Count III. The charges arose on October 13, 2010, when the defendant crashed a pickup truck he was driving into a van at the intersection of 55th Street and University Avenue. The defendant backed up his truck, accelerated again striking the van a second time and pushing it into University Avenue. The defendant then fled the scene. The defendant’s brother, James Donahey, was initially charged with this crime, however, the defendant in this case, John Donahey, came forward and took responsibility for his actions. The Court sentenced the defendant to two years in prison on each of the three aggravated misdemeanors charges, suspended those sentences and placed the defendant on probation. Conditions of probation include successful completion of substance abuse treatment, payment of a fine of $1,850.00 plus surcharge and court costs, serving 7 days in the Polk County Jail and paying full restitution.

On August 5, 2011, Vaughndre Singleton was sentenced to prison in Polk County Criminal Number FECR242390 for a period not to exceed 10 years for the crime of Burglary in the Second Degree. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 5, 2011, Scott Austin was sentenced to prison in Polk County Criminal Number FECR246342 for a period not to exceed 50 years for the crime of Manufacturing a Controlled Substance as a Second or Subsequent Offeder. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 5, 2011, Christopher Greteman was sentenced to an indeterminate term of incarceration not to exceed 25 years in Polk County Criminal Number FECR242083 for the crime of Posession of a Controlled Substance with Intent to Deliver (LSD). Over the State’s objection and notwithstanding the fact the defendant had an outstanding arrest warrant from the State of California for violating a prior probation, the Court granted Christopher Greteman a suspended sentence and again placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On June 24, 2011, Defendant Tiara Manning, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On August 5, 2011, Defendant Tiara Manning was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Tiara Manning was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On August 5, 2011, Marquice Morris was sentenced to prison for Theft in the 1st Degree- 10 years and Assault with Intent to Inflict Serious Injury – 2 years. Pursuant to plea agreement, the Court ran the counts concurrent to each other for a prison term not to exceed 10 years.
On August 5, 2011, Chad Ziesman pled guilty to Sexual Exploitation of a Minor. Sentencing is set for September 19, 2011 at 9:30 a.m. Courtroom 204.
On August 5, 2011, Mondale Rife pled guilty to Failure to Comply with the Sex Offender Registry 2nd Offense. The defendant waived time before sentencing and the use of a presentence investigation report. Pursuant to plea negotiations, the Court sentenced the defendant to prison for a term not to exceed 5 years. The sentence shall run concurrent to Mr. Rife’s probation violation for Failure to Comply with the Sex Offender Registry.
On August 5, 2011, Jonathan Before pled guilty to Burglary 3rd Degree and Theft 2nd Degree. Sentencing is scheduled for September 19, 2011 at 10:00 a.m. Courtroom 204.
