On March 15, 2011, Defendant Bradley Farrow, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(5). On August 15, 2011, Defendant Bradley Farrow, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(5). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Bradley Farrow was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On August 16, 2011, Fausto Ledesma was sentenced in Polk County Criminal Number FECR242121 for the crime of Delivery of a Controlled Substance (Marijuana). The Court granted Fausto Ledesma a deferred judgment and placed him on probation for a period of 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On August 16th, 2011, Russell Barlow Jr., FECR246983, entered an Alford Plea to the offense of Manufacturing a Controlled Substance Substance-methamphetamine, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony as a Second or Subsequent Offender, in violation of Iowa Code Section 124.411. The defendant was sentence to 20 years in prison on this case. On May 3, 2011, the defendant pled guilty to Possession of a Controlled Substance- third offense, a Class D Felony, as alleged in AGCR243114. On August 16th, 2011, he was sentenced to 5 years in prison. The Court ran both sentences consecutive to each other for a total period of incarceration not to exceed 25 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 5, 2011, Defendant Brandon Brazelton, entered a plea of guilty to the charge of: Conspiracy to Deliver a Controlled Substance, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On August 16, 2011, Defendant Ashley Isenberg, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Ashley Isenberg was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 2, 2011, Defendant Tyler Humphreys, entered a plea of guilty to the charge of: Possession of a Controlled Substance with Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On August 16, 2011, Defendant Tyler Humphreys, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Tyler Humphreys was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Martin Nyariel – FECR248003 – This defendant was arraigned on the charges of Intimidation With A Dangerous Weapon, a Class C felony and Going Armed With Intent, a Class D felony and to both of these charges the defendant entered a plea of not guilty. A pretrial conference was set for September 8, 2011, at 2:00 p.m. in Room 204 and trial was set for October 10, 2011.

State of Iowa v. Dyllon Morgan – FECR247770 – This defendant plead guilty to Operating a Motor Vehicle Without the Owner’s Consent and Burglary in the Third Degree. The defendant received a deferred judgment, was placed on two years of probation. As a part of probation the defendant was ordered to participate in a Victim Offender Reconciliation Program, pay restitution, perform 172 hours of community service, and any other terms and conditions required by the probation officer.

State of Iowa v. Maria Luttrell-Murphy – FECR244889 – This defendant was sentenced after pleading guilty on June 24, 2011, to one count of Identity Theft as a Class D felony. In the plea the defendant admitted using the identification information of another person to obtain a benefit greater than $1,000. The court deferred judgment on the defendant, placed her on two years of probation and ordered her to pay a $750 civil penalty, and perform any other terms and conditions required by the probation officer.

State of Iowa v. Tyler Brown – FECR246418 – This defendant plead guilty to Identity Theft as an aggravated misdemeanor and admitted using the identification information of his sister to obtain a benefit less than $1,000. The defendant received a deferred judgment, was placed on one year of probation and ordered to pay restitution, complete the Victim Offender Reconciliation Program, and any other terms and conditions required by the probation officer.

Duran Thomas had his probation revoked and was sentenced to a term not to exceed ten years in prison.

Antonio Rodriguez plead guilty to Willful Injury Causing Bodily Injury. A pre-sentence investigation report was ordered and sentencing was set for a later date.

Shawn Tough plead guilty to Felony Eluding, Drunk Driving and Probation Violation and was sentenced to a term not to exceed eight years in prison.

Cornell Fraley appeared for arraignment in Polk County Criminal case number FECR247894 on felony drug charges. He plead not guilty and the Court set a pretrial conference hearing and a trial date.

Macie Burton pled guilty to Assault with Intent to Commit Serious Injury in Polk County Criminal Case number FECR246302. She was sentenced to serve up to two years in prison. This sentence will not begin until she discharges a prior prison sentence.

Angela Henderson pled guilty to Credit Card Fraud, two counts of Forgery, and Operating a Motor Vehicle without the Owner’s Consent in Polk County Criminal case numbers AGCR247108, FECR247109, FECR247136, and AGCR247108. The Court accepted her pleas and scheduled a sentencing hearing for September 21, 2011.

Ashley Petty pled guilty to Theft in the Second Degree in Polk County Criminal case number FECR246389. The Court accepted her plea and scheduled a sentencing hearing for September 30, 2011.

Bobby Dewees asked for his bond to be reduced in Polk County Criminal case number FECR248460. The Court reduced his bond to $10,000 cash or surety.

08/18/2011

Ernesto aka Emmanuel Perez appeared in court for his pre-trial conference in FE247502. Defendant is currently under an ICE hold pending deportation proceedings. He pled guilty to trespass with damages for entering an apartment, not his own, when he was heavily intoxicated, and disrobing in the room and presence of a minor. The Defendant was extremely intoxicated and believed he was in his own apartment. He will face deportation proceedings

On August 18, 2011, Dorian Thomas was sentenced in Polk County Criminal Number FECR242389 to an indeterminate term of incarceration not to exceed 10 years for the crime of Burglary in the Second Degree, to an indeterminate term of incarceration not to exceed 5 years for the crime of Theft in Second Degree, and to a term of 240 days for the crime of Burglary in the Third degree. The Court imposed a split sentence wherein the defendant was sentenced to a term of incarceration followed by a term of probation for 5 years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On August 18, 2011, Steven Schmidt was sentenced to prison in Polk County Criminal Number FECR246674 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver (Methamphetamine) and for a period not to exceed 5 years for the crime of Felon in Possession of a Firearm. The Court ordered the sentences to be served consecutively. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 26th, 2011, Shawn Lilland, FECR243585, pled guilty to the offense of Manufacturing a Controlled Substance-methamphetamine, as a lesser included offense of Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony and Possession of Lithium with Intent it be used to Manufacture a Controlled Substance-methamphetamine, as alleged in Count IV of the Trial Information, in violation of Iowa Code Section 124.401(4), a Class D Felony. Prior to sentencing, the defendant successfully completed the United Community Services In-jail treatment program. On August 19th, 2011, he came before the court for sentencing and received a prison sentence of 10 years on Count II and 5 years on Count IV, which the court suspended and placed him on probation for 5 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 7, 2011, Defendant Brandon Billings, entered a plea of guilty to the charge of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge, as alleged in the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24 and 155A.23. On August 19, 2011, Defendant Brandon Billings, was sentenced to a period of incarceration not to exceed 10 years for the charge of: Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge, as alleged in the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(8), 155A.24 and 155A.23. On August 19, 2011, Defendant Joshua Paddock, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance with Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Joshua Paddock was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 7, 2011, Defendant Cassandra Twombly, entered a plea of guilty to the charge of: Possession of a Controlled Substance Third Offense, two Counts as alleged in the Trial Information, Class D Felonies, in violation of Iowa Code Section(s) 124.401(5). On August 19, 2011, Defendant Cassandra Twombly, was sentenced to a period of incarceration not to exceed 10 years for the charges of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(5). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Cassandra Twombly was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
