John Dameron was granted a Deferred Judgment in FE243188 for Fraudulent Practice 2nd Degree. Dameron had falsely reported income to Iowa Work Force Development in such a way as to receive unemployment benefits when he was not otherwise entitled. He will be required to pay $8691.00 in Restitution while he is on probation for at least two (2) years.

On September 6, 2011, Samuel Clark plead guilty and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, as a second or subsequent offender, in case number FE245727. Mr. Clark was found to be in possession of over ten grams of cocaine base “crack” and had previously served seventy (70) months in federal prison for a nearly identical offense. The State recommended that the Court sentence Mr. Clark to a maximum indeterminate term of forty (40) years in prison. Although Mr. Clark faced a potential term of seventy-five (75) years in prison, the Honorable Robert B. Hanson sentenced him to a maximum indeterminate term of forty (4) years and suspended this sentence and placed him on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 6, 2011, Stephanie Robinson plead guilty and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE245683. Judgment was deferred and she was placed on probation for five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 6, 2011, Mathew Millsap plead guilty and was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE245682. Judgment was deferred and he was placed on probation for five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 6, 2011, Juran Bailey was sentenced for the crime of Possession of a Controlled Substance, ecstasy, With Intent to Deliver, a Class C felony, in case number FE242971. He was sentenced to a maximum indeterminate term of incarceration not to exceed ten (10) years and must serve a mandatory one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 6th, 2011, Demarkus D. Simon, FE247163, pled guilty to the offense of Delivery of a Controlled Substance-cocaine base crack, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(3), a Class C Felony as a Second or Subsequent Offender, in violation of Iowa Code Section 124.411. The defendant waived time and notice and agreed to immediate sentencing. The defendant received a twenty year suspended sentence and probation. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

Curtis Wade Stratton and Savannah Hammer each pled guilty in related Theft cases. Stratton and Hammer report to be dating. They were both charged with taking property from or being in possession of property stolen from Adventureland, including tickets and electronic devices. Hammer had been able to bond out of jail and Stratton remained in jail pending the plea. Stratton pled guilty in FE247266 to Theft 2nd Degree. Pending sentence, which will take place in October, he was released from custody. At sentencing the parties expect to recommend he receive probation. Hammer pled guilty, as part of a plea agreement which was mitigated by her limited prior criminal history, to the charge of Theft 3rd Degree. The Court granted her a deferred Judgment.

On July 7th, 2011, Richard Kenney, FECR245777, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-methamphetamine, as alleged in the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony with application of the Habitual Offender Enhancement, in violation of Iowa Code Section 902.8. On September 8th, 2011, he came before the Court for sentencing. Prior to sentencing the defendant successfully completed the treatment program at the Iowa Residential Treatment Center in Mount Pleasant, Iowa. Both parties recommended a fifteen year suspended sentence and probation, due to the defendant successfully completing the IRTC treatment program. He must remain in the Polk County Jail until a bed is available at the Habor of Hope residential facility, where he will remain until maximum benefits are achieved. This is the defendant’s first felony drug conviction. The Court accepted the parties sentencing recommendations. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 8, 2011, David Burris pled guilty in Polk County Criminal Number FECR246658 to the crime of Possession of a Controlled Substance with Intent to Deliver (Methamphetamine) as a Habitual Offender. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Eric Williams – FECR247998 – This defendant was arraigned on the charge of Possession of a Controlled Substance, Third or Subsequent Offense, is a Class D felony and pleaded not guilty. A pretrial conference was set for October 6, 2011, at 2:45 p.m. in Room 207 and trial was set for November 2, 2011.

Stave of Iowa v. James Saukko – FECR248461 – This defendant was charged with Felon in Possession of a Firearm, a Class D felony and entered a plea of not guilty. A pretrial conference was set for October 6, 2011, at 2:15 p.m. in Room 204 and trial was set for November 2, 2011.

State of Iowa v. Jared Elson – FECR248560 – This defendant was charged with Theft in the Second Degree, a Class D felony and entered a plea of not guilty. A pretrial conference was set for October 6, 2011, at 2:30 p.m. in Room 204 and trial was set for November 2, 2011.

State of Iowa v. Christopher Lessmann – FECR248204 – This defendant was charged with Possession of a Controlled Substance With Intent to Deliver, a Class D felony and Failure to Possess a Tax Stamp, also a Class D felony. To both charges the defendant entered a plea of not guilty and a pretrial conference was set for October 6, 2011, at 3:00 p.m. in Room 207. A trial date was set for November 2, 2011.

State of Iowa v. De’Angelo Waters – FECR246594 – This defendant entered a guilty plea to Forgery as an aggravated misdemeanor for making a purchase at a convenience store with a counterfeit $100 bill. The defendant was placed on two years of probation, ordered to make restitution, and participate in the Victim Offender Reconciliation Program as well as any other terms and conditions imposed by the probation department.

State of Iowa v. Pamela Bennett – FECR248092 – This defendant plead guilty to Trespass and was ordered to serve 22 days in the Polk County Jail.

State of Iowa v. Domingo Lopez – FECR247876 – This defendant plead guilty to Assault With a Dangerous Weapon and admitted displaying a knife in a threatening manner while riding in a car with the victim. The defendant was granted a two year suspended prison sentence and placed on two years of probation. The defendant was ordered to comply with the terms and conditions of probation including Victim Offender Reconciliation Program and the Assaultive Behavior class.

State of Iowa v. Michelle Gonzalez-Quiroz – FECR244082 – This defendant plead guilty to Forgery as a Class D felony for cashing a counterfeit payroll check at a local grocery store. The defendant has no criminal history and was granted a deferred judgment. The defendant was placed on two years of probation with the terms and conditions imposed by the probation department.

On May 27th, 2011, Dajuan Easter, FECR240503, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-cocaine base crack, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(3), a Class C Felony as a Second or Subsequent offender, in violation of Iowa Code Section 124.411. On September 9th, 2011, this case came before the court for sentencing. The State of Iowa argued for a twenty year prison sentence. The Defendant argued for a suspended sentence and probation. The Court sentenced him to prison for fifteen years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 29th, 2011, Tina E. Diaz, FE246411, pled guilty to the offense of Delivery of a Controlled Substance-methamphetamine, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony and Delivery of a Controlled Substance-methamphetamine, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On September 9th, 2011, she came before the court for sentencing. The State argued for a 20 year suspended sentence and probation. The Defendant argued for a deferred judgment. The Defendant did not have any prior criminal convictions. The Court granted her a deferred judgment and probation on both counts. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
