Weekly Case Summary

Brandie Courter was arraigned on Assault with Intent Causing Serious Injury. Trial is set for November 14th, 2011.

Lee West was arraigned on Forgery. Trial is set for November 14th, 2011.

Joshua Meyers had is bond increased to $20,000 cash only.

Kevin Bettin pled guilty to Assault with a Dangerous Weapon and was sentenced to probation with a fine.

Earl Smith, Jr., pled guilty and was sentenced for Assault Causing Injury and Assault with Intent to Commit Serious Injury. He was placed on probation.

Jennifer Shaver complied with the conditions of probation concerning financial payments. Her probation is continued.

Tyler Hardwick was sentenced to prison for Burglary in the 3rd Degree after failing the Youthful Offender Program.

Lastalcha A. Bragg (aka Jones) was given a deferred judgment and placed on probation for Fraudulent Practice in the First Degree.

Russell Kirk Brown pled guilty to Eluding, OWI, and Driving While Barred. Sentencing is set for October 31st, 2011, at 9 a.m.

Passion Soward and Keyara Byrd pled guilty to Child Endangerment and Theft in the Second Degree. Sentencing is set for October 31, 2001, at 9:30 and 10 a.m., respectively.

State of Iowa v. John Lee Wade FECR246020 The above case was set for trial on September 12. On the morning of September 12, 2011, and before the trial started, the defendant entered a plea of guilty to Count I – Robbery in the First Degree and agreed to be sentenced immediately. He received a prison term of 25 years which is mandatory, and will be required to serve 17 years prior to any opportunity for parole. The defendant robbed a Des Moines Pharmacy at gunpoint of narcotics.

State of Iowa v. Michael Carter – FECR248612 – This defendant was arraigned on the charges of Possession of a Controlled Substance With Intent to Deliver, a Class D felony and Failure to Possess a Tax Stamp, a Class D felony. To both of these charges the defendant entered a plea of not guilty and a pretrial conference was set for October 13, 2011, at 2:45 p.m. in Room 207. Trial was set for November 14, 2011.

State of Iowa v. Nathan Smith – FECR238496 – This defendant plead guilty to Theft in the Third Degree as a lesser included offense and admitted writing several bad checks in exchange for merchandise and services. The defendant received a deferred judgment, was placed on two years of probation, ordered to make any restitution, complete the Victim Offender Reconciliation Program and any other requirements from the Department of Corrections.

On September 16, 2011, Scott Eugene Larue was sentenced for two Counts of Lascivious Acts with a Child. The Court sentenced the defendant to a prison term not to exceed 20 years. The sentence was suspended and the defendant was granted probation. Specifically, the defendant must remain in jail until there is bed space available at the Ft. Des Moines Facility, successfully complete a Sex Offender Treatment Program and comply with a No Contact Order restricting contact with all minor children. The Court further imposed a lifetime Special Sentence.

On July 21, 2011, Defendant Damien Cain, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On September 16, 2011, Defendant Damien Cain was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 5 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Damien Cain was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
