Weekly Case Summary
09/26/2011

On September 26, 2011, Devon Carr pled guilty to Eluding, Possession of a Controlled Substance- marijuana and Possession of a Controlled Substance- cocaine. Sentencing is set on November 14, 2011 at 9:00 a.m. Courtroom 204.

On September 26, 2011, John Chandler stipulated to violating his probation. The Court revoked his probation and sentenced him to prison for a term not to exceed 5 years.

On September 26, 2011, Angela Henderson was sentenced for Credit Card Fraud, 2 Counts of Forgery, and Operating a Motor Vehicle Without Owner’s Consent. The Court sentenced the defendant to prison for a term not to exceed five years.

On September 26, 2011, Steven Mulder was sentenced for Burglary in the 2nd Degree. The Court granted the defendant a suspended sentence and placed him on probation. A specific condition of probation was to remain in jail, until there is an opening at the Ft. Des Moines Residential Facility and reside there until maximum benefits have been obtained.

On September 26, 2011, Dennis Flanders appeared for a probation violation dispositional hearing. The Court revoked the defendant’s deferred judgment. The Court did grant the defendant’s request for a suspended sentence and probation. A specific condition of probation was the entry of a No Contact Order.

On September 26, 2011, Paul Leach appeared for a probation violation hearing. The Court set this matter for an evidentiary hearing on October 10, 2011 at 2:30 p.m. Courtroom 204.

09/27/2011

On September 27, 2011, Jeffrey Hawbaker appeared in Polk County District Court in criminal number FE 246257. Hawbaker pleaded guilty to two charges of Delivery of a Controlled Substance (methamphetamine). Hawbaker was sentenced to an indeterminate term of imprisonment not to exceed ten years on each charge and the sentences are to be served consecutively to each other. Hawbaker must serve a mandatory one-third of each sentence before he is eligible for parole. Hawbaker was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Morris Amara – FECR247155 – This defendant plead guilty to Identity Theft as an aggravated misdemeanor, a lesser included of the offense in the trial information and Operating While Intoxicated 1st Offense. The defendant received a three year suspended sentence, was placed on two years of probation. As conditions of probation, the defendant was ordered to pay a $625.00 fine for the Identity Theft and a $1,250 fine for the Operating While Intoxicated. In addition the defendant was required to make any restitution, complete the OWI class and obtain a substance abuse evaluation and comply with any treatment that is recommended.

State of Iowa v. Alec Larson – FECR247278 – This defendant plead guilty to Identity Theft as a Class D felony as charged in the trial information. The defendant admitted using the identification of four of his family members to open a line of credit with an online retailer named Bill Me Later. The defendant also admitted to obtaining goods or services in excess of $1,000. The defendant was ordered to comply with a pre-sentence investigation report and return for sentencing on November 17, 2011, at 9:00 a.m. in Room 204. At that time, the defendant will ask the court for a deferred judgment and the State will ask that the court suspend the prison sentence.

State of Iowa v. Joseph Bonacci – FECR248576 – This defendant plead guilty to Forgery as an aggravated misdemeanor and admitted purchasing pizza with a counterfeit $20.00 bill. The defendant received a deferred judgment and was placed on one year of supervised probation. Conditions of probation require the defendant to pay a civil penalty, pay any restitution that is owed, and any other terms and conditions as ordered by the probation officer.

State of Iowa v. Bart McCann – FECR218309 – This defendant stipulated to being in violation of the terms and conditions of his probation and made argument regarding the impact of those violations. The court found the defendant did violate the terms of his conditions of probation and revoked that probation imposing the original five year prison sentence. The defendant was transferred to the custody of the Department of Corrections and sent to the Iowa Medical and Classification Center in Oakdale to begin serving his sentence. The defendant also plead guilty to Harassment in the Third Degree and received a ten day jail sentence giving credit for ten days served.

State of Iowa v. Charles Monte Williams – FECR222167 – This defendant stipulated to being in violation of the terms and conditions of his probation by being out of contact with his probation officer for over a year and smoking marijuana. The defendant asked the court to continue him on probation and the State asked the court to revoke that probation. The court revoked the defendant’s probation and ordered him to serve the original prison sentence and immediately transferred him to the custody of the Iowa Department of Corrections to be sent to Iowa Medical and Classification Center in Oakdale to begin serving his sentence.

Joel Agee appeared for sentencing and was granted a deferred judgment in FECR245888 on a charge of Willful Injury causing Bodily Injury.

Angela Stevens-Thompson appeared for sentencing on a charge of Child Endangerment in FECR 246691; she was granted a deferred judgment.

Jolynn King appeared for bond review and her bond was reduced from cash only to cash or surety.

Valerie Stewart appeared for bond review and her bond was reduced from cash only to cash or surety.

Muzammil Ali appeared for arraignment on a charge of Forgery. Pretrial conference was set for October 27, 2011 and trial was set for November 28, 2011.

Eana Anderson appeared for arraignment on a charge of Theft in the Second Degree. Pretrial conference was set for October 27, 2011 and trial was set for November 28, 2011.

Wilbur Bitting appeared for arraignment on a charge of Theft and OWI. pretrial conference was set for October 27, 2011 and trial was set for November 28, 2011.

Michael Kinkennon appeared for a status conference and entered a guilty plea to the charge of Theft in the Second Degree. Sentencing was set for November 14, 2011.

On September 29, 2011, Terry Fowler was sentenced to prison in Polk County Criminal Number FECR248120 for a period not to exceed 25 years for the crime of Possession of a Controlled Substance with Intent to Deliver (Methamphetamine). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 29, 2011, Cisco Burton pled guilty in Polk County Criminal Number FECR246662 to the crime of Possession of a Controlled Substance with Intent to Deliver (Marijuana) as a Second or Subsequent Offender. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

09/30/2011

On August 11th, 2011, Paul Davis Sr., FE246450, pled guilty to the offense of Manufacturing a Controlled Substance, as a lesser include offense of Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony and Possession of a Controlled Substance with Intent to Deliver, as alleged in Count III of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6) a Class C Felony. On September 30th, 2011, he came before the court for sentencing and received a 20 year suspended sentence and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 30, 2011, Amber Brown was sentenced to prison in Polk County Criminal Number FECR247023 for a period not to exceed 5 years for the crime of Possession of Iodine with Intent it be Used to Manufacture a Controlled Substance (Methamphetamine). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
