On August 19, 2011, Defendant Preston A. On October 4, 2011, Defendant Preston A. Cole was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. On October 6th, 2011, Deborah Kay Thornton, FECR243581, entered an Alford Plea of guilty to the offense of Conspiracy to Manufacture a Controlled Substance, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony as a Second or Subsequent offender, in violation of Iowa Code Section 124.411 and Possession of Lithium with Intent it be used to Manufacture a Controlled Substance, as alleged in Count IV of the Trial Information, in violation of Iowa Code Section 124.401(4), a Class D Felony. The Parties recommended a Fifteen Year prison sentence on Count I and a Five year prison sentence on Count IV with both counts running consecutive to each other for a total period of incarceration not to exceed twenty years. The Court was in agreement with the recommendation and sentenced her to twenty years in prison. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On October 6, 2011, Earl Adkins was sentenced to prison in Polk County Criminal Number FECR246075 for a period not to exceed 5 years for the crime of Possession of a Controlled Susbtance (Third Offense). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

To both of these charges the defendant entered a plea of not guilty and a pretrial conference was set for November 3, 2011, at 3:00 p.m. in Room 204. A trial was set for December 5, 2011.

Bradley Langford – FECR249651 – This defendant was arraigned on the charges of Burglary in the Third Degree, a Class D felony and Possession of a Controlled Substance, a Serious Misdemeanor. To both of these charges the defendant entered a plea of not guilty. A pretrial conference was set for November 3, 2011, at 2:45 p.m. in Room 204 and trial was set for December 5, 2011.
State of Iowa v. Ronald Oliver – FECR246372; FECR244617 – This defendant plead guilty to two counts of Forgery and admitted presenting counterfeit payroll checks purportedly from a local business. The defendant admitted knowledge that the checks were counterfeit and that he presented them with the intent to defraud. A presentence investigation will be conducted and sentencing has been scheduled for November 28, 2011, at 10:00 a.m. in Room 204.
State of Iowa v. Joshua Richards – FECR246646; SRCR246555; SRCR246956 – This defendant plead guilty on August 23, 2011, to Attempted Burglary in the Second Degree, a Class D felony; Burglary in the Third Degree, a Class D felony; and Possession of a Controlled Substance – Methamphetamine, a Serious Misdemeanor. At the sentencing on this date the defendant received a 10 year suspended prison sentence and was placed on five years of probation to be supervised by the Fifth Judicial District Department of Corrections. As a condition of the probation, the defendant is ordered to complete the Residential Treatment Center program at Mt. Pleasant and abide by any after care that that program recommends. The defendant is to be held in the Polk County Jail until a bed is available at Mt. Pleasant. In addition to this term or condition of probation, the defendant is ordered to make restitution and pay fines in the amount of $2,125 as well as any other terms and conditions imposed by the probation department.
State of Iowa v. Tonya Real – FECR246647; FECR246807 – On August 23, 2011, this defendant plead guilty to Attempted Burglary in the Second Degree, a Class D felony; Burglary in the Third Degree, a Class D felony; and Possession of a Controlled Substance With the Intent to Deliver, a Class C felony. At sentencing on this date, the defendant received a 15 year suspended sentence and was placed on five years of probation to be supervised by the Fifth Judicial District Department of corrections. The defendant was ordered to pay any restitution that’s owing in these cases, pay fines in the amount of $2,500 as well as comply with any other terms and conditions as imposed by the probation department.

On October 7, 0211, Russell Shives was sentenced for Willful Injury Causing Serious Injury, a forcible felony. The Court sentenced the defendant to prison for a term not to exceed 10 years. The Court also entered a No Contact Order prohibiting the defendant from contacting the victim.
On October 7, 2011, Jason Smith appeared before the Court. The Court ordered that he undergo a competency evaluation. A status hearing is set for this matter on October 31, 2011 at 2:30 p.m.
On October 7, 2011 Ron McChristian appeared for a probation violation hearing. The defendant was discharged from his probation as unsuccessful. The Court ordered the defendant to set up a payment plan with the Polk County Attorney’s Office.
