On October 11th, 2011, Jose Rivera, FE247659, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony and Failure to Possess a Tax Stamp, as alleged in Count III of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The defendant waived time and notice and requested immediate sentencing. The defendant received a 15 year suspended sentence and probation. Prior to sentencing the defendant completed IRTC and is now residing at the Harbor of Hope Halfway House. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On October 11th, 2011, Antonio Serrano Jr., FE248515, Pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony and Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The defendant waived time and notice and agreed to immediate sentencing. The defendant was sentenced to prison for 15 years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Tyson Robinson and Brian Hendrickson were sentenced in their respective cases. They were co-defendants who pled guilty to Willful Injury Causing Bodily Injury, a lesser offense that the original charge. They were downtown Des Moines following a Nebraska v. Iowa State football game last year when they assaulted a Nebraska fan severely injuring him. They were each granted a suspended sentence and placed on probation for two years. They both admitted alcohol played a role in their behavior. Although the victim did not attend the sentencing, they both apologized to him for their actions. They will both be required to obtain a substance abuse evaluation and pay substantial restitution to the victim. The Court considered granting both a Deferred Judgment but denied them the opportunity to not have this conviction on their record citing the seriousness of their behavior and the seriousness of the injuries sustained by the victim.
Craig LaCour pled guilty in FE248906 to the charge of Willful Injury causing Bodily Injury for stabbing his neighbor in the back with a screw driver. He admitted the two had been fighting after drinking together. LaCour admitted he left the scene and returned with a screw driving. He will be sentenced in November.
On October 11, 2011, defendant Jonathan Rickabaugh plead guilty to one count of Felon in Possession of a Firearm, a Class D felony. Sentencing is scheduled for November 22, 2011, at 9:00 a.m. in Room 204.
On October 11, 2011, defendant Andrew Bohn appeared for sentencing for the charge of Burglary in the Third Degree. The defendant was granted a deferred judgment and he was placed on probation for a period of two years. He was also ordered to comply with any recommended treatment and/or classes required by the Department of Corrections.

On October 13, 2011, Michael Allen Jr. was sentenced to fifty years in prison after being convicted of four counts of Robbery in the First Degree. On October 26, 2010, Allen followed four unsuspecting young adults for miles before robbing them at gunpoint. When one of the victims did not turn over his property fast enough, Allen shoved him to the ground and pointed a gun at his head. Allen was previously convicted of Willful Injury and Going Armed with Intent and sent to prison in 2000 after he shot a man three times (Allen was only fourteen when he committed this prior offense). Allen was only out of prison seven months prior to committing the robbery. He will be required to serve thirty-five years on the robbery charges prior to being considered for parole.
On October 13th, 2011, Javier Lopez, FE246119, entered a guilty plea to the offense of Possession of a Controlled Substance with Intent to Deliver-cocaine salt hydrochloride, as alleged in the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(2)(b) and 124.401(1)( c )(2)(d), a Class C Felony without the sentencing enhancements and Failure to possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. The Defendant waived time and notice and requested immediate sentencing. The Defendant was sentenced to prison for fifteen (15) years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On October 13th, 2011, Marc Colby, FECR248866, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony. The Defendant waived time and notice and requested immediate sentencing. On September 7th, 2011, the Defendant pled guilty to Domestic Abuse Assault Enhanced-second offense, in violation of Iowa Code Sections 708.1(1) and 708.2A(3)(b) an aggravated misdemeanor in AGCR246406 and AGCR248401. The parties reached an agreement where these two domestic assault cases would run concurrent with the felony drug case in FECR248866. The defendant was sentenced to prison for ten (10) years in FECR248866 and two (2) years each in AGCR246406 and AGCR248401. The court ran the domestic charges concurrent with the drug offense for a total period of incarceration not to exceed ten (10) years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
State of Iowa v. Miguel Tinoko – FECR249593 – This defendant was arraigned on the charge of Theft in the Second Degree, a Class D felony and entered a plea of not guilty. Pretrial conference was set for November 10, 2011, at 1:30 p.m. in Room 204 and trial was set for December 12, 2011.
State of Iowa v. Kyle Freemann – FECR249465 – This defendant was arraigned on the charges of Burglary in the Third Degree, a Class D felony and Theft in the Second Degree, a Class D felony. To both of these charges the defendant entered a plea of not guilty and a pretrial conference was set for November 10, 2011, at 2:45 p.m. in Room 204. Trial was set for December 12, 2011.
State of Iowa v. Daniel Binder – FECR249830 – This defendant was arraigned on the charge of Theft in the Second Degree, a Class D felony and entered a not guilty plea. Pretrial conference was set for November 10, 2011, at 2:30 p.m. in Room 204 and trial was set for December 12, 2011.

Michael Pratt – FECR249732 – This defendant was arraigned on the charges of Possession of a Controlled Substance With Intent to Deliver, a Class D felony; Possession of a Controlled Substance, a Serious Misdemeanor; and Operating a Motor Vehicle While Under the Influence of Alcohol or Drug, a Serious Misdemeanor. To all of these charges the defendant entered a plea of not guilty and a pretrial conference was set for November 10, 2011, at 3:00 p.m. in Room 207. Trial was set for December 12, 2011.

State of Iowa v. Maria Baker – FECR249566 – This defendant was arraigned on the charge of Theft in the First Degree, a Class C felony and entered a plea of not guilty. A pretrial conference was set for November 10, 2011, at 10:45 a.m. in Room 204 and trial was set for December 12, 2011.
State of Iowa v. Luke Joseph Nielsen – FECR244927 – This defendant plead guilty on August 3, 2011, to one count of Theft in the Second Degree, a Class D felony. At sentencing on October 13, 2011, the defendant received a five year suspended prison sentence and was placed on five years of supervised probation with the Fifth Judicial District Department of Corrections. The defendant was ordered to pay a fine of $750.00 and ordered to complete treatment and after care and any other terms and conditions required by the probation department.
State of Iowa v. Debbie Alfrey – FECR248574 – This defendant plead guilty to Theft in the Third Degree and admitted taking money from her employer to which she was not entitled. Sentencing was set for December 1, 2011, at 9:00 a.m. in Room 204.

Pleas and Sentencing
John Rong II was sentenced in SR228646 to the charge of Possession of a Controlled Substance. The defendant was sentenced to 365 days in jail. The sentence was suspended and he was placed on formal probation for 12 months. The defendant shall be required to pay $350.00 fine and restitution.
Monica Fagan pled guilty in FECR242100 to the charge of Count II: Theft in the Second Degree. Sentencing was scheduled for November 22, 2011 at 10:00 a.m. At the time of sentencing, the defendant is free to request a deferred judgment and the State is free to argue. At the time of sentencing, the State will recommend dismissal of Count I.
Quinton Dennis pled guilty in FECR242171 to the charge of Fraudulent Practice in the Second Degree. Additionally, Mr. Dennis entered pleas of guilty in SR245351 and SR246313 to Domestic Abuse Causing Injury and Possession of a Controlled Substance, to wit: Marijuana. Sentencing on all matters was scheduled for November 22, 2011 at 10:30 a.m. At the time of sentencing, all parties will recommend a suspended sentence and probation, and all sentences to run concurrent to each other.
