Yenisei Irineo Sotelo, Anthony Defino, Joshua Nelson, Jessica Buckalew, and Kevin Eason all appeared for arraignment on their respective criminal charges. They all pled not guilty and the Court scheduled pretrial hearings and trial dates.
Arraignment for Lizette Coleman on Polk County criminal case number FECR209714 was rescheduled for November 23, 2011.
Donald Brooks appeared for a bond review hearing on Polk County criminal case number FECR249706 on a charge of Theft in the Second Degree. The Court set bond at $5000.
Ellen Campbell had a probation revocation hearing on Polk County criminal case number FECR197431. The Court found that she was in compliance with her probation, dismissed the revocation and continued her on probation.
Michael James Gilbert pled guilty to Assault Causing Serious Injury in Polk County criminal case number FECR245170. Sentencing was scheduled for December 2, 2011.
Donald Bolen appeared for a probation revocation hearing on Polk County criminal case numbers FECR232198 and AGCR230784. His hearing was continued until November 9, 2011 due to pending criminal charges.
Sday Chap was sentencing to thirty days in jail after pleading guilty to OWI 1st and Child Endangerment in Polk County criminal case number AGCR248094. When the defendant is released from jail, he will be placed on probation for two years.
Sherry Taylor pled guilty to Fraudulent Practice in the Third Degree inPolk County criminal case number FECR246576. She was sentenced to an indeterminate term of incarceration not to exceed two years. The Court suspended the sentence and placed the defendant on probation for two years.
Shane Cross was found to be incompetent after appearing on a probation revocation hearing on Polk County criminal case number FECR215578. He was ordered to inpatient treatment at Cherokee until his competency was restored. A review hearing was scheduled for November 28, 2011.
On August 29th , 2011, Clark William Young, FE246447, pled guilty to the offense of Conspiracy to Manufacture a Controlled Substance-methamphetamine, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On October 26th, 2011, he came before the court for sentencing. The State argued for a suspended sentence and probation. The Defendant argued for a deferred judgment and probation. The State did not agree with the recommendation of a deferred judgment, due to the nature of the crime, and because he had received a deferred judgment back in 1991 for an operating while intoxicated charge. The defendant was supplying pseudoephedrine pills to the co-defendant Paul Davis, who in exchange for the pills would give the defendant methamphetamine to use. The court granted him a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s office Drug and Gang Bureau.
Emily Brown was sentenced in FE245618 on the charge of Theft 2nd Degree. The Defendant had previously admitted she had stolen property from her parents. The Court granted her a Deferred Judgment in light of parental support and in consideration of her insignificant criminal history. The Court also recognized her need for structure and accountability and ordered her, as a condition of probation, to reside in the Women’s Residential Facility. She was placed in custody pending space at the Facility. She will be on probation for two years.
Shanetino Kittrell, Jr. was granted a Deferred Judgment on a Burglary 3rd Degree charge in FE246812. He and several co-defendants forced their way into a residence for purposes of engaging in a fight. In additional Kittrell was on a Deferred Judgment probation in FE238330 for Possession of a Marijuana. He violated his probation by committing this new offense. The Court revoked his deferred Judgment in that matter and revoked his probation, giving him credit for time served and discharging his sentence. The Court believed he deserved a consequence for committing a new offense while on probation, therefore entered a conviction on the charge, but also believed the Defendant, based on his employment, youth and current compliance with probation, deserved a chance to be on probation and earn the discharge of his felony case. The Defendant will be on supervision for five (5) years for the burglary.
Ezrakiah Rowlinson plead guilty to Forgery and was sentenced to a term not exceed five years in prison. The sentence was run concurrently with a Wisconsin prison sentence.
Lynette McGinnis plead guilty to Fraudulent Practices in the First Degree. Sentencing was set for December 6, 2011.
Tonie Canada was sentenced on charges of Forgery, Malicious Prosecution, and Reckless Use of Fire. She was granted a deferred judgment.
Patrick Maher was sentenced on a charge of Theft in the Second Degree. He was given a sentence not to exceed five years, which was suspended, and he was placed on probation.
