Weekly Case Summary
10/24/2011

On October 24th, 2011, Adrian Hackney, FE248143, came before the court and pled guilty to the offense of Delivery of a Controlled Substance-cocaine salt hydrochloride, as alleged in the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(2)(b) and /or 124.401(1)( c )(2)(d), a class C Felony. The defendant waived time and notice and agreed to immediate sentencing. Both sides recommended a ten (10) year suspended sentence and probation and the court agreed with the recommendation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 24, 2011, Defendant Jeffery Fair, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d), a Class D Felony. Defendant Jeffery Fair, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was suspended and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Jeffery Fair was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jessie Paul Chandler was revoked from his probation and sentenced to prison inFE242396 on a Forgery charge and OM071853 on an OWI 2nd Offense Chandler had been granted probation at the time of his sentencing and ordered to reside at the Fort Des Moines Facility. He walked away from the Facility earlier this month. He also pled guilty to an Escape charge for leaving Fort Des Moines against Court Order.

Curtis Stratton appeared for sentencing on the charge of Theft 2nd Degree in FE247266. Although the plea agreement called for him to be granted a suspended sentence, the Court imposed a five (5) prison sentence based on his prior criminal history.

Tajuana Banks pled guilty to Theft 2nd Degree in FE247062, Theft 2nd Degree in FE246839 and Theft 3rd Degree in SR249751. She admitted she stole from a variety of businesses over several days. She will be sentenced in December.

Cody Joe Morrison appeared for sentencing in FE248100. He had pled guilty to Child Endangerment and Assault on a Peace Officer. Morrison admitted he had been abusing Xanax while he was caring for his child. When confronted by police, he assault an officer. The Court granted him a deferred judgment on the Child Endangerment charge. If he successfully completes the conditions of probation, he can say he has never been convicted of the offense. The Court suspended sentence as to the Assault change. He will be on probation for two years. He has to comply with a substance abuse evaluation recommendation and comply with mental health monitoring. The Department of Human Services is involved and he will be required to cooperate with their programming and restrictions and conditions as it relates to custody and visitation with his child.

Alexander Abyei pled guilty to Criminal Mischief 2nd Degree for damaging property belonging to Shelby Miller. Abyei will be sentenced in December.

On October 24th, 2011, Thomas Schilling, FE244966, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-methamphetamine, as a lesser included offense of the amended Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony without the sentencing enhancements. The defendant waived time and notice and requested immediate sentencing. Both parties recommended a ten (10) year prison term and the court followed the recommendation. In addition, the court ran this sentence consecutive to his parole. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Kevin Omenda pled guilty to Theft 4th Degree in FE247317. As called for in the plea agreement, he was sentenced to 3 days in prison and given a fine of $1875.

Jamie Luebs was sentenced in FE247119 on a charge of Failure to Comply with the Sex Offender Registry, Second Offense. At the time he committed the offense, he was already on probation for Failure to Comply with the Sex Offender Registry, First Offense and Residing within 2000 feet of a school. The Court sentenced him to prison for five (5) years and revoked his probation.

Bobby Lamar Hester was granted a Deferred Judgment in FE247111. He had previously pled guilty to Forgery. The Court ordered him to complete a substance abuse and mental health evaluation and comply with any recommended treatment, obtain his GED and obtain and maintain full time employment while on probation. The Court granted his probation officer discretion to place him at the Fort Des Moines Facility at the Officers discretion.

Kiesha Dunigan pled guilty to Driving While Barred in AG250066. She was also sentenced on the charge of Theft in the Second Degree in FE247039. The Court placed her in custody pending placement at the Women’s Residential Facility. She was granted a suspended sentence and will begin probation once there is a bed for her at the WRF.

Elizabeth Weah pled guilty to Theft 2nd Degree in FE246588. She admitted she had been falsely loading Walmart gift cards and then using them to purchase items so she did not have to pay for them. Over a month’s time, she obtained over $1800 worth of merchandise through these gift cards. She will be sentenced in December.

Yenisei Irineo Sotelo, Anthony Defino, Joshua Nelson, Jessica Buckalew, and Kevin Eason all appeared for arraignment on their respective criminal charges. They all pled not guilty and the Court scheduled pretrial hearings and trial dates.

Arraignment for Lizette Coleman on Polk County criminal case number FECR209714 was rescheduled for November 23, 2011.

Donald Brooks appeared for a bond review hearing on Polk County criminal case number FECR249706 on a charge of Theft in the Second Degree. The Court set bond at $5000.

Ellen Campbell had a probation revocation hearing on Polk County criminal case number FECR197431. The Court found that she was in compliance with her probation, dismissed the revocation and continued her on probation.

Michael James Gilbert pled guilty to Assault Causing Serious Injury in Polk County criminal case number FECR245170. Sentencing was scheduled for December 2, 2011.

Donald Bolen appeared for a probation revocation hearing on Polk County criminal case numbers FECR232198 and AGCR230784. His hearing was continued until November 9, 2011 due to pending criminal charges.

Sday Chap was sentencing to thirty days in jail after pleading guilty to OWI 1st and Child Endangerment in Polk County criminal case number AGCR248094. When the defendant is released from jail, he will be placed on probation for two years.

Sherry Taylor pled guilty to Fraudulent Practice in the Third Degree inPolk County criminal case number FECR246576. She was sentenced to an indeterminate term of incarceration not to exceed two years. The Court suspended the sentence and placed the defendant on probation for two years.

Shane Cross was found to be incompetent after appearing on a probation revocation hearing on Polk County criminal case number FECR215578. He was ordered to inpatient treatment at Cherokee until his competency was restored. A review hearing was scheduled for November 28, 2011.

On August 29th , 2011, Clark William Young, FE246447, pled guilty to the offense of Conspiracy to Manufacture a Controlled Substance-methamphetamine, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On October 26th, 2011, he came before the court for sentencing. The State argued for a suspended sentence and probation. The Defendant argued for a deferred judgment and probation. The State did not agree with the recommendation of a deferred judgment, due to the nature of the crime, and because he had received a deferred judgment back in 1991 for an operating while intoxicated charge. The defendant was supplying pseudoephedrine pills to the co-defendant Paul Davis, who in exchange for the pills would give the defendant methamphetamine to use. The court granted him a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s office Drug and Gang Bureau.

Emily Brown was sentenced in FE245618 on the charge of Theft 2nd Degree. The Defendant had previously admitted she had stolen property from her parents. The Court granted her a Deferred Judgment in light of parental support and in consideration of her insignificant criminal history. The Court also recognized her need for structure and accountability and ordered her, as a condition of probation, to reside in the Women’s Residential Facility. She was placed in custody pending space at the Facility. She will be on probation for two years.

Shanetino Kittrell, Jr. was granted a Deferred Judgment on a Burglary 3rd Degree charge in FE246812. He and several co-defendants forced their way into a residence for purposes of engaging in a fight. In additional Kittrell was on a Deferred Judgment probation in FE238330 for Possession of a Marijuana. He violated his probation by committing this new offense. The Court revoked his deferred Judgment in that matter and revoked his probation, giving him credit for time served and discharging his sentence. The Court believed he deserved a consequence for committing a new offense while on probation, therefore entered a conviction on the charge, but also believed the Defendant, based on his employment, youth and current compliance with probation, deserved a chance to be on probation and earn the discharge of his felony case. The Defendant will be on supervision for five (5) years for the burglary.

Ezrakiah Rowlinson plead guilty to Forgery and was sentenced to a term not exceed five years in prison. The sentence was run concurrently with a Wisconsin prison sentence.

Lynette McGinnis plead guilty to Fraudulent Practices in the First Degree. Sentencing was set for December 6, 2011.

Tonie Canada was sentenced on charges of Forgery, Malicious Prosecution, and Reckless Use of Fire. She was granted a deferred judgment.

Patrick Maher was sentenced on a charge of Theft in the Second Degree. He was given a sentence not to exceed five years, which was suspended, and he was placed on probation.

On September 13th, 2011, Brandon Jones, FECR241857, pled guilty to the offense of Conspiracy to Deliver a Controlled Substance-Oxycodone, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(8), a Class C Felony and Delivery of a Controlled Substance-Oxycodone, as alleged in Count IV of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(8), a Class C Felony. On October 27th, 2011, this case came before the court for sentencing. The State of Iowa argued for a twenty (20) year suspended prison sentence and probation. The Defense argued for a deferred judgment and probation. The Court granted the defendant a deferred judgment and probation with the requirement that he reside at the Fort Des Moines Residential Correctional Facility until maximum benefits are achieved. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

James Tuttle pled guilty to Fraudulent Practice 3rd Degree in FE248832. He admitted to investigators that he had, on several occasions, underreported the value and purchase price of several vehicles to avoid paying certain taxes and fees. He was cooperative during the investigation and paid all the money back to the State. The Court granted him a Deferred Judgment with two years probation.

Eana Anderson pled guilty pursuant to North Carolina v. Alford to Theft 3rd Degree. Ms Anderson was accused of cashing two checks for $1000 into an account and receiving cash, knowing that when the checks were processed, there would not be sufficient funds to cover them. She was granted a deferred judgment based on her minimal criminal history.

On October 27, 2011, Jeffrey Butts was sentenced to prison in Polk County Criminal Number FECR231943 for a period not to exceed 10 years for the crime of Conspiracy to Manufacture a Controlled Substance (Methamphetamine) and for a period of 5 years for the crime of Burglary in the Third Degree. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 27th, 2011, Jeffrey Butts, FECR249107, entered a guilty plea to the offense of Possession of Ephedrine or Pseudoephedrine with Intent it be used to Manufacture a Controlled Substance-methamphetamine, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 124.401(4), a Class D Felony with application of the Habitual Offender Enhancement, in violation of Iowa Code Section 902.8. The Defendant waived time and notice and requested immediate sentencing. Both parties recommended a fifteen (15) year prison sentence, which the court accepted. The Defendant was also on probation in FECR231943 for a class C and Class D felony and faced a fifteen year prison sentence if revoked. The Defendant agreed to have his probation revoked and the original fifteen year prison sentence imposed. The parties also recommended that this fifteen year prison sentence in FECR231943 run consecutive to the fifteen year prison sentence in FECR249107 for a total period of incarceration not to exceed thirty (30) years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Chad Kain appeared for arraignment on a charge of Criminal Mischief in the First Degree and Assault. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Dennis Korf appeared for arraignment on a charge of Being a Felon in Possession of a Firearm. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Lucas Clewell appeared for arraignment on a Felony Drug Offense. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Brandon Bougher appeared for arraignment on a charge of Arson in the First Degree. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Tye Minteer appeared for arraignment on a charge of Arson in the First Degree. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Crystal See appeared for arraignment on charges of Forgery and Theft. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Jacob Larson appeared for arraignment on charges of Forgery. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Robert Hodges appeared for arraignment on charges of Theft. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Isaiah Cole appeared for arraignment on charges of Forgery. Pretrial conference was set for December 1, 2011 and trial was set for January 9, 2012.

Daijour Hall appeared for a bond review on a charge of Attempted Murder. The hearing was continued to November 7, 2011.

Shannon Bellet appeared for sentencing. Sentencing was continued to November 14, 2011.

Vernon Glass appeared and plead guilty to charges of Eluding and Assault. He was sentenced to serve 360 days in jail.

On August 23, 2011, Defendant Kristina M. Walker, was found guilty following a jury trial of the charge of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(5). On October 28, 2011, Defendant Kristina M. Walker, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance Third Offense, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(5). Kristina M. Walker was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On September 8, 2011, Defendant Brian Schumacher, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On October 28, 2011, Defendant Brian Schumacher, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Brian Schumacher was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
