Weekly Case Summary
10/31/2011

On October 31st, 2011, Michael Raye, FE248186, pled guilty to the offense of Conspiracy to Deliver a Controlled Substance, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony. The Defendant waived time and notice and requested immediate sentencing. Both parties recommended a deferred judgment and probation which the court accepted and granted. The Defendant was one of three co-defendants in a car stopped by police in which a baggie of methamphetamine was found. At first he took responsibility for the baggie of methamphetamine and said it was for personal use. He later signed a proffer agreement, was deposed by the State of Iowa, and agreed to testify against his co-defendant Khonesith Kavan and explained everyone’s involvement in the conspiracy to deliver methamphetamine. The Defendant will remain in custody until he attends and completes the drug treatment program in Mount Pleasant, Iowa. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 31, 2011, the jury returned verdicts in the case of State of Iowa v. Shaunta Hopkins and Latoya Lewis, FE24246205 and FE246207. The jury found Ms. Hopkins guilty of Conspiracy to Deliver a Controlled Substance, cocaine base, a Class B felony, Possession of a Controlled Substance With Intent to Deliver, cocaine base, a Class C felony, Failure to Possess a Tax Stamp, a Class D felony, Conspiracy to Deliver a Simulated Controlled Substance, a Class C felony, Possession of a Simulated Controlled Substance With Intent to Deliver, a Class C felony, and Possession of a Controlled Substance, a serious misdemeanor. The jury found Ms. Lewis not guilty. Ms. Hopkins will be sentenced on December 19, 2011 at 8:30 a.m. and faces a maximum indeterminate term of forty-one (41) years in prison. These defendants were prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 1, 2011, Danielle Patterson plead guilty to the crime of Theft in the First Degree, a Class C felony, in case number FE247926. She will be sentenced on December 27, 2011 at 8:30 a.m. and faces a maximum indeterminate term of ten (10) years in prison. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On November 3rd, 2011, Josephine Lamont, FECR244959, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-methamphetamine, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony. The Defendant waived time and notice and requested immediate sentencing. Both parties recommended a deferred judgment and probation and the court agreed. The Court granted her a deferred judgment and placed her on probation for five (5) years. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

Rickey James Anderson pled guilty in FE249810 to the charges of Burglary 3rd Degree and possession of Burglary tools. He admitted he used a crow bar to break into Edmunds Elementary, doing damage to the school and then stealing property from the school. He asked the Court to immediately sentence and agreed to a prison sentence of five (5) years.

Andrew James Green was discharged from probation in FE229416 and OM67644 after completing all requirements except 10 hours of community service. The remaining community service was converted to a fine of $72.50 which is liened and judged against him.

Timothy Conway was sentenced on a probation violation in FE236940. He had previously stipulated to violating the terms and conditions of his probation by failing to comply with UA’s, placement and other conditions. He was also arrested on a new felony drug charge. Although Conway requested continued probation and vowed to comply with all conditions if given another opportunity, the Court cited his previous failed opportunities and revoked his probation, sentencing him to prison.

Zachary Ramirez was sentenced to probation in FE247353 for failing to comply with the sex offender registry for the 2nd time. Ramirez requested the Court grant him a deferred judgment for this felony offense. He admitted leaving the county to reside in Cedar Rapids and failing to register. He was also on probation at the time in FE244903 and did not notify his probation of his leaving the county. Although the Court continued him on probation in FE244903, he was denied a deferred judgment and granted a suspended sentence in FE247353. He will remain in jail until there is space available for him at the Fort Des Moines Men’s Residential Facility. Cooperation with the Facility is now a condition of his probation. If he fails probation, the Court ordered his sentences to be consecutive to each other for a total period of incarceration not to exceed seven (7) years.
