Weekly Case Summary

Christinea Folsom appeared for an arraignment on charges of Theft in the First Degree and two counts of Credit Card Fraud in Polk County Criminal Case FECR251114. She pled not guilty and a pretrial conference hearing and trial date was scheduled. Folsom was also ordered to have no contact with the alleged victim.

Adam May appeared for arraignment on charges of Attempting to Elude Pursuing Law Enforcement, Operating a Motor Vehicle while Under the Influence of Alcohol or Drugs, and Operating a Motor Vehicle while License Suspended or Revoked in Polk County Criminal FECR250879. He pled not guilty and a pretrial conference hearing and trial date was scheduled.

Keevon Washington appeared for arraignment on charges of Willful Injury Causing Bodily Injury and Assault Causing Bodily Injury in Polk County Criminal Case FECR251309. He pled not guilty and a pretrial conference hearing and trial date was scheduled. Washington was also ordered to have no contact with the alleged victim.

Miguel Alcantor Jr. appeared for a dispositional hearing on a probation revocation in Polk County Criminal Case FECR225164. The Court revoked his probation, imposed the original sentence, and sentenced him to prison.

Jerry Gray appeared for sentencing after pleading guilty to Operating a Motor Vehicle while Under the Influence of Alcohol or Drugs (Third or Subsequent Offense) and Driving While Barred in Polk County Criminal Case OM72439. As this was Mr. Gray's thirteen conviction of OWI, the Court sentenced the defendant to seven years in prison.

Baretta Halamar appeared for sentencing after pleading guilty to Theft in the Second Degree, Unauthorized use of a Credit Card and Domestic Abuse Assault with a Dangerous Weapon in Polk County Criminal Case numbers FECR249361, AGCR248416 and AGCR249904. The Court imposed a nine year prison sentence, suspended the sentence and placed the defendant on probation for five years. Halamar was ordered to complete the Batterers Education Program, substance abuse treatment and pay restitution.

Sarah Hume appeared for a probation revocation hearing in Polk County Criminal Case FECR235882. She stipulated that she did violate terms and conditions of probation. The Court extended her probation until 2015, ordered to complete the program at the Women's Residential Correctional Facility, and ordered her to comply with all recommended mental health and substance abuse treatment.

Anthony Bonner pled guilty to Fraudulent Practice in the Second Degree in Polk County Criminal Case number FECR249787. Sentencing was scheduled for a later date.

Michael Emberlin pled guilty to Theft in the Third Degree in Polk County Criminal Case number FECR248026. The Court sentenced him to two years in prison, suspended the sentence and placed him on probation for two years.

On October 25th, 2011, Noah Iseton III, FE248577, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony with application of the Second or Subsequent offender sentencing enhancement, in violation of Iowa Code Section 124.411. The Defendant was given the following plea offer: plead as charged with both sides free to argue or agree to prison for seven (7) years. The Defendant chose to go to prison for seven years. The Court sentenced him to prison for seven years, but suspended the fine due to his incarceration. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 6, 2011, Brandon Gooden was found guilty by a Polk County jury in Criminal Number FECR249738 of the crimes of Possession of a Controlled Substance with Intent to Deliver (Morphine) and Failure to Possess a Tax Stamp. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 6, 2011, Defendant Michael Cason, entered a plea of guilty to the charge of: Failure to Possess a Tax Stamp, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 453B.3 and 453B.12. Defendant Michael Cason, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Failure to Possess a Tax Stamp, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 453B.3 and 453B.12. The sentence in this matter was suspended and the defendant was placed on probation for a period of 3 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Michael Cason was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Torin Ward was convicted by a jury of Assault Causing Bodily Injury for strangling a female date to the point of unconsciousness in FE249512. He was also convicted of interference in a trial to the bench for running from the police. The Court sentenced Ward to 1 year in jail on the Assault charge and 30 days on the Interference charge. These sentences are to be served concurrent to each other, but will be served consecutive to his underlying parole matter.

On December 6th, 2011, Kimberly Bush FE249254, pled guilty to the offense of Manufacturing a Controlled Substance, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(6), a Class C Felony and Possession of Ephedrine or Pseudoephedrine with Intent it be used to Manufacture a Controlled Substance, as alleged in Count IV of the Trial Information, in violation of Iowa Code Section 124.401(4), a Class D Felony. The Defendant waived time and notice and agreed to immediate sentencing. Both parties recommended a deferred judgment and probation. The Defendant was supplying Pseudoephedrine pills to her co-defendants who were manufacturing methamphetamine. The Court granted her a deferred judgment and probation on both counts. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Ashley Miller was sentenced to ten years in prison in FE211855 and FE2199077. She had previously been granted probation on the charge of Willful Injury Causing Bodily Injury and Failure to Appear. She was violated probation such that she was placed in the Women’s Residential Facility. While in the facility, she continued to use illegal substances and was frequently out of place of assignment. She requested the Court give her the opportunity for treatment at Mount Pleasant. The Court denied her request citing her continued dishonesty and apparent lack of commitment to changing her behavior.

On October 12, 2011, Defendant Nicholas S. Copeland, entered a plea of guilty to the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On December 9, 2011, Defendant Nicholas S. Copeland was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance With Intent to Deliver, as alleged in Count I of the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The judgment in this matter was deferred and the defendant was placed on probation for a period of 2 years. The defendant shall be supervised by the Fifth Judicial District Department of Correctional Services. Nicholas S. Copeland was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 9, 2011, Yamilette Crespo-Reyes plead guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE247719. She was sentenced to a maximum indeterminate term of ten (10) years and five (5) years, consecutive for a total of fifteen (15) years in prison, and must serve a mandatory one-third term of the ten (10) year sentence prior to becoming eligible for parole. This sentence was suspended and she was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jolynn King appeared and plead guilty to five counts of Forgery. Sentencing was set for January 20, 2012.

Frederick L. Clark Jr. appeared for sentencing one count of Burglary in the Third Degree and one count of Theft in the Second Degree. He was sentenced to five years on each charge, to run consecutively, for a period not to exceed ten years.

David Williams appeared and plead guilty to Theft in the Second Degree. Sentencing was set for January 18, 2012.

Anthony Knight plead guilty to Burglary in the Second Degree. Sentencing was set for January 25, 2012.

Kelsea Swope appeared for a probation revocation hearing. The hearing was continued to December 21, 2011.

Michael Stllpflug appeared for a probation revocation hearing. He stipulated that he was in violation of probation and a dispositional hearing was set for December 16, 2011.

Agok Philip appeared for a probation revocation hearing. He stipulated that he was in violation of probation and was ordered to complete substance abuse treatment.

Shane Ginther appeared for a bond review. Bond was reduced to $20,300 cash or surety (from cash only).

Glenda Braggeman appeared for arraignment on charges of Theft and Forgery. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

Mark Prall appeared for arraignment on charges of Theft. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

Arichica Holt appeared for arraignment on felony drug charges. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

William Moyer appeared for arraignment on charges of Use Tax Evastion. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

Glenda Braggeman appeared for arraignment on charges of Theft and Forgery. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

Alfred Lottie appeared for arraignment on charges of Fraudulent Practices. Pretrial conference was set for January 5, 2012 and trial was scheduled for February 1, 2012.

On December 9th, 2011, Eric Troy FE249549, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver-Benzylpiperazine (BZP), as alleged in Count II of the amended Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(8), a Class C Felony without the firearm enhancement. The Defendant waived time and notice and requested immediate sentencing. Both parties recommended a ten year prison sentence. The Court agreed with the recommendations of the parties and sentenced him to prison for ten years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
