Sivone Sayavong pled guilty to Possession of a Controlled Substance with Intent to Deliver, Failure to Possess a Tax Stamp, Malicious Prosecution and Perjury in Polk County Criminal case numbers FECR215723 and FECR215103. The Court sentenced the defendant to sixteen years prison, suspended the sentence, and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.
On March 5th, 2008, Timothy Jay Parker, FECR216164, pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation, or Subterfuge-vicodin/hydrocodone, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 155A.23, 155A.24 and 124.401(1)( c )(8), a Class C Felony. On April 28th, 2008, he received a deferred judgment and was placed on probation for two years with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
On March11th, 2008, Keith Martin Adamson, FECR217283, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony without the Second or Subsequent Offender Provision. On April 28th, 2008, he received a 5 year suspended sentence and two years probation with the applicable $750.00 fine. He will be required to comply with the all the recommendations of his treatment providers and complete 100 hours of community service before discharging probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Jose Hernandez-Cruz pled guilty to Possession of a Controlled Substance with Intent to Deliver in Polk County Criminal Case number FECR218286 and was sentenced to five years prison. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.
Derek Casey was sentenced for the crime of Possession of a Controlled Substance, marijuana, With Intent to Deliver, a Class D felony, in case number FE218111. The Court deferred judgment and he was placed on probation for two years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Jason Bottjen pled guilty to Burglary in the 3rd Degree. The Court sentenced him to probation. As a condition of probation, the defendant was ordered to pay full restitution and to comply with a No Contact Order with the victims/ witnesses.

Nicholas Bullock plead guilty to Theft in the Second Degree and was sentenced to a term of incarceration not to exceed five (5) years. The sentence was ordered to run consecutive to a sentence the defendant was currently serving from Poweshiek County. The consecutive sentences made his total term of incarceration not to exceed ten (10) years with the Iowa Department of Corrections.
Darsie Lindquist plead guilty to the crime of Theft in the Second Degree. She was sentenced to a term of incarceration not to exceed five (5) years, however that sentence was suspended and she was placed on probation for a period of two (2) years. As a condition of probation she was ordered to reside at the Blackhawk County Residential Facility. This sentence was also ordered to run consecutive to a sentence that she was currently serving from Dubuque County and another sentence from Blackhawk County.
On March 10th, 2008, Dustin Michael Deterding, FECR216900, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On April 29th, 2008, he received a deferred judgment and was placed on probation for two years with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.
On March 11th, 2008, Jason Edward Howell, FECR217449, pled guilty to Manufacturing a Controlled Substance-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony without the firearm enhancement and failure to Possess a Tax Stamp, as alleged in Count III of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. On April 29th, 2008, he received a 5 year prison sentence on Count II and Count III of the Trial Information. The Court
ran both sentences consecutive to each other for a total period of incarceration not to exceed 10 years. The Court then suspended the sentences and placed him on probation for two years. The Court also suspended the fine on both counts. This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.
On March 25th, 2008, Seth Andrew Fisher, FECR217973, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On April 29th, 2008, he received a deferred judgment and was placed on two years probation with the applicable $750.00 civil penalty. On January 30th, 2008, Dorisha Urea Rucker, FECR216237, pled guilty to Possession of a Controlled Substance with Intent to Deliver-Cocaine Base Crack, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(3), a Class C Felony. On April 29th, 2008, she received a deferred judgment and was placed on probation for two years with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.
Britni Sheeder appeared for sentencing in Polk County Criminal Number FE 217284. Sheeder had earlier admitted to being in possession of a controlled substance (“crack” cocaine) with the intent to deliver it. Sheeder was granted a deferred judgment and placed on probation for two years. Sheeder must pay a $1000.00 civil penalty. Sheeder was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Eddy Cortez was sentenced to prison for guilty pleas to Ct I Burglary in the Second Degree and Ct II Sexual Abuse in the Third Degree arising out of a home burglary and ensuing sexual assault . Both counts were ordered to run consecutively to each other for a term not to exceed 20 years in prison. Cortez was also placed on the sex offender registry and ordered to provide a DNA sample. Cortez admitted at the guilty plea to breaking into an occupied home and sexually assaulting one of the residents . Cortez also faces further legal action because there is an Immigration hold against him.

State of Iowa v. Anthony Smith - FECR218892 and AGCR21424
In 218892, the charge of Robbery in the Second Degree, was amended to Theft in the First Degree. Defendant plead guilty and was sentenced to serve 10 years in prison. In 214424, defendant plead guilty to three counts of Credit Card Fraud and was sentenced to six years in prison. The sentences will be served consecutively for a total of 16 years. This is not the first time that defendant has served time in prison.
Tory Deshawn Galvin was sentenced to a term of Five years in prison after pleading guilty to Failure to Comply with the Sex Offender Registry – Second Offense. Galvin has been on the Sex Offender Registry since 2001 for a sex crime originating out of Page County.

On March 25th, 2008, Brandon Scott Stanford, FECR217735, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony without the firearm enhancement and Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa Code Sections 453B.3 and 453B.12, a Class D Felony. On May 1, 2008, he received a 5 year prison term on each count. The Court ran the sentences consecutive to each other for a total period of incarceration not to exceed 10 years. The sentences were suspended and the defendant was placed on two years probation with the applicable $750.00 fine on each count. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
Nathanial Yancey was on probation for Felon in Possession in CR212363 and Going Armed with Intent and Intimidation with a Dangerous Weapon in CR199029. Defendant was arrested on new charges of Felon in Possession of a Firearm, Possession with Intent, No Tax Stamp, Domestic Causing Injury, Harassment First and Child Endangerment. Court revoked defendant’s probation and imposed prison sentence. In CR199209 defendant was sentenced to five years on Intimidation and five years on Going Armed with Intent, consecutive. Defendant also sentenced to five years on Felon in Possession in CR212363.

On February 28, 2008, Christa Marie Smith plead guilty to Homicide by Vehicle by Reckless Driving – Count I and Operating a Motor Vehicle While Under the Influence of Alcohol – Count II. The charges arose in the early morning hours of July 5, 2007 when the defendant drove her Ford Explorer at excessive speed around an on ramp to Interstate 80 in Urbandale, Iowa and rolled the vehicle. Thomas Carpenter was thrown from the vehicle and was killed. Further investigation showed that the defendant and the victim had attended a party earlier in the evening and had become intoxicated.
On May 2, 2008, the defendant was sentenced to 10 years in prison on the Homicide by Vehicle charge and one year in prison on the charge of Operating While Intoxicated. The sentences were run consecutively for a total of 11 years.
On March 27, 2008, a post conviction relief trial was held on James Gamble. He had previously been found guilty by a jury of Robbery in the 2nd Degree. During the post conviction relief proceeding, the defendant attempted to claim that his trial counsel was ineffective. On May 2, 2008,the Court issued a written ruling finding that the defendant’s counsel was not ineffective and dismissed the post conviction relief case.
