WEEKLY CASE SUMMARY
05/12/2008 Eric Allen pled guilty and received a Deferred Judgment for the crime of Possession of a Controlled Substance, in violation of Iowa Code Section 124.401(5) a serious misdemeanor. Allen was prosecuted by the Drug and Gang Bureau.

Jose Amaya Ricardo-Delgado aka Richard Delgado-Amayo pled guilty to Possession of a Controlled Substance with Intent to Deliver in violation of Iowa Code Section 124.401(1)(d) and Failure to Possess a Tax Stamp in violation of Iowa Code Sections 453B.3 and 453B.12 in Polk County Criminal case number FECR216152 for his role in the distribution of approximately one hundred pounds of marijuana. The Court sentenced the defendant to an indeterminate prison term not to exceed five years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Adan Rubio-Garibay pled guilty to Possession of a Controlled Substance with Intent to Deliver in violation of Iowa Code Section 124.401(1)(d) and Failure to Possess a Tax Stamp in violation of Iowa Code Sections 453B.3 and 453B.12 in Polk County Criminal case number FECR216153 for his role in the distribution of approximately one hundred pounds of marijuana. The Court sentenced the defendant to an indeterminate prison term not to exceed five years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Ryan Larimer pled guilty to Conspiracy to Deliver a Controlled Substance in violation of Iowa Code Section 124.401(1)(d) in Polk County Criminal Case number FECR215459. The Court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Joshua Cory pled guilty to Possession of a Controlled Substance with Intent to Deliver in violation of Iowa Code Section 124.401(1)(d) in Polk County Criminal case number FECR216442. The Court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Morgan Magee pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation or Subterfuge in violation of Iowa Code Sections 124.401(1)(c)(8), 155A.24 and 155A.23 in Polk County Criminal case number FECR216487. The Court sentenced the defendant to ten years prison on this offense as well as an additional ten years on a prior offense. After the defendant successfully completed the in jail treatment program, the Court suspended the sentences and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Christina Gilchrist pled guilty to Possession of a Controlled Substance with Intent to Deliver in violation of Iowa Code Section 124.401(1)(d) and Failure to Possess a Tax Stamp in violation of Iowa Code Sections 453B.3 and 453B.12 in Polk County Criminal case number FECR217360. The Court sentenced the defendant to a total of ten years prison, suspended the sentence, and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Frederick Leon Huddleston was sentenced in Polk County Criminal Number FE 218883. Huddleston earlier pleaded guilty to Conspiracy to Deliver a Controlled Substance (marijuana). Huddleston was granted a five year suspended sentence and placed on probation for two years. Huddleston must pay a $750.00 fine, a D.A.R.E. surcharge, a supervision fee and complete a substance abuse evaluation and follow any suggested treatment recommendation. He must also provide a DNA sample and his driver’s license was revoked for 180 days. Huddleston was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Daniel Shedd plead guilty to Theft in the Second Degree and Driving While License Under Suspension. He was sentenced to prison for four years. The court ordered that the sentences run concurrent to a probation violation case from Ringgold County for OWI 2nd.

Michaela Bebee was sentenced for Child Endangerment. She was sentenced to probation, community service, substance abuse evaluation and treatment, and parenting skills programming.

05/14/2008 Veronica M. Sinat FE217156 was sentenced today for the crime of Burglary 3rd Degree. Although the parties made a joint recommendation to the Court that she should be granted a Deferred Judgment, the Court imposed a five year sentence which was then suspended and she was granted probation for two years.

Arthur J. Smith, Jr. FE218142 was sentenced on 3 counts of Forgery. The Court granted the Defendant a Deferred Judgment. The Defendant apologized for his behavior and agreed he owed restitution for his actions. A Restitution order for all counts will be entered at a future date. Counts 4, 5 and 6 were dismissed.

Regina Bedwell plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class C felony, in case number FE217613. She was sentenced to a maximum indeterminate term of ten (10) years and will be required to serve a mandatory one-third of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Rodney Cornelsion stipluated that he violated his probation in FECR205212. As the defendant has repeatedly violated his probation, the Court revoked his probation and sentenced him to five years prison for his original offense of Possession of a Controlled Substance with Intent to Deliver. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

05/15/2008 Cheyenne Rouse was sentenced to 15 years in prison for the crimes of Possession of a Controlled Substance with Intent to Deliver-Cocaine Salt Hydrochloride, in violation of Iowa Code Section 124.401(1)(c)(2)(b), a Class C Felony and Failure to Possess a Drug Tax Stamp, as alleged in Count II, in violation of Iowa Code Section 453B.3 and 453B.12, a Class D Felony. These sentences shall run consecutively to each other for an indeterminate term of incarceration not to exceed 15 years. Rouse will be required to serve a mandatory minimum 1/3 of his sentence prior to being eligible for parole. Rouse had the opportunity to receive a suspended sentence and probation upon successful completion of the In Jail Treatment program; however, he was removed from the program do to behavioral issues. Rouse was prosecuted by the Drug and Gang Bureau.

Ricky Johnson was sentenced to prison in Polk County Criminal Number FECR218652 for a period not to exceed 25 years for the crime of Manufacturing a Controlled Substance - Methamphetamine. The Court ordered this sentence to be served consecutively to the defendant’s outstanding parole. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

05/16/2008 Deondre Amerison plead guilty to and was sentenced for the crimes of Possession of a Simulated Controlled Substance, cocaine base “crack,” With Intent to Deliver, a Class C felony, and admitted he is a habitual offender within the meaning of Iowa Code section 902.8, and Assault on a Police Officer With a Dangerous Weapon, a Class D felony, in case number FE216581. He was sentenced to a maximum indeterminate term of fifteen (15) years for the drug charge and five (5) years for the charge of Assault on a Peace Officer With a Dangerous Weapon, to be served consecutively for a total of twenty (20) years. He will be required to serve a mandatory minimum term of five years of the fifteen (15) year sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Scott Crolty plead guilty to Operating a Motor Vehicle Without Owner’s Consent and there was a joint recommendation for a suspended sentence, formal probation and community service.

Sue Berreth was sentencing on the charge of Dependant Adult Abuse, a class D felony. The State recommended a suspended sentence with probation, defendant recommended a Deferred Judgment. Victim’s family asked for prison. The judge sentenced defendant to a suspended with probation for 3 years and 100 hours of community service.

Nancy Kroger plead guilty to Theft in the First Degree with a presentence investigation. The parties are free to argue at sentencing. State to recommend prison.

Corey Moore plead guilty to Theft in the Second Degree with a presentence investigation. The parties are free to argue any legal disposition.
