WEEKLY CASE SUMMARY
05/19/2008 On March 26th, 2008, Connie Morrison aka Woodworth, FECR217460, pled guilty to Manufacturing a Controlled Substance-marijuana, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On May 19th, 2008, she received a deferred judgment and was placed on probation for two years with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 26th, 2008, Monte Scott Walker, FECR213606, pled guilty to Manufacturing a Controlled Substance-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony without the firearm enhancement. On May 19th, 2008, he received a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 27th, 2008, Charles Howard Sears, Jr., SRCR217172, pled guilty to Failure to Possess a Tax Stamp, as alleged in Count II of the Trial Information, in violation of Iowa code Sections 453B.3 and 453B.12, a Class D Felony. On May 19th, 2008, he received a deferred judgment and was placed on probation for two years with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Muslim Al-Rubaiai pled guilty to Possession of a Controlled Substance with Intent to Deliver and Child Endangerment in Polk County Criminal Case number FECR217671 and was sentenced to seven years in prison. When the defendant has finished his sentence in Iowa, he will be transported to Nebraska to be prosecuted for his role in a string of burglaries. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Kristy Givens pled guilty to Neglect of a Dependant Person in Polk County Criminal Case number AGCR217672. The Court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Souky Saychareun was sentenced for the crime of Delivery of a Controlled Substance, cocaine salt hydrochloride, a Class C felony, in case FECR216227. He was sentenced to a maximum indeterminate term of ten (10) years, but this sentence was suspended and he was placed on probation for a term of two years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Christine Louise Baker appeared in Polk County District Court to answer allegations that she violated her probation. Baker was earlier granted a deferred judgment in Polk County Criminal Number FE 155076 on a felony drug charge. Baker was charged in Jasper County with felony forgery but allowed to plead guilty to theft in the fourth degree. Baker was sentenced to serve 30 days in the Jasper County jail. After hearing, District Court Judge Carla T. Schemmel determined that Baker should not lose her deferred judgment status, but rather found her in contempt of court and sentenced her to 30 days in the Polk County Jail. The State of Iowa argued that Baker should lose her deferred judgment, at a minimum. Baker was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Paul German appeared for probation revocation hearing and stipulated to all violations filed by probation. Parties to argue disposition on May 27, 2008 at 2 p.m.

Quince Spooner appeared for sentencing on Willful Injury. State, defendant’s attorney and corrections all recommended a suspended sentence with probation, restitution, No Contact Order and conditions identified in PSI. Court sentenced defendant to such.

Justin Welsch appeared for sentencing on a Theft in the Second Degree. Joint recommendation for Deferred Judgment with probation, restitution and $750.00 civil penalty.

Angela Kramer appeared for sentencing on a Forgery charge. The State recommended probation without a resistance to a deferred judgment. Defendant received a deferred judgment with probation, restitution, $750.00 civil penalty, SAVE class.

05/20/2008 Vincent Parslow pled guilty to two (2) Counts of Forgery in FE218851. He admitted he took checks from his employer, then forged a signature and negotiated the checks at two bank locations so he could use the money to gamble. His sentencing is set June 30, 2008 at 10: 30 a.m.

Nicholas Clay Miller was granted a deferred judgment for Theft 1st Degree in FE217942. He pled guilty April 8, 2008 to taking property from his employer, including a pool table, pin ball machine, air hockey table and foosball table. He admitted his behavior and agreed to make restitution.

Casey Peterson appeared for a probation violation hearing in FE191214. He stipulated to the violations which included using illegal substances and failing to meet with his probation officer. The Court ordered him to participate in a treatment program and then reside in a half-way house for the remainder of his probation.

Christine Fortes pled guilty to Fraudulent Practice 2nd Degree, a Class D Felony in FE218333. She admitted she was engaged in a business and failed to pay income taxes for that business during the years 2000 through 2005. Sentencing is schedule June 30, 2008 at 10:00 a.m.

Daryl Wentland pled guilty to Reckless use of Fire, Assault by Use or Display of a Dangerous Weapon and Criminal Mischief 4th Degree in FE219041. The Court suspended his sentences and ordered him to probation for two (2) years.

Santos Salazar-Cerda plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class B felony, in case FECR218460. He was sentenced to a maximum indeterminate term of twenty-five (25) years and will be required to serve a mandatory one-third term of this sentence prior to becoming eligible for parole. He received a one-third reduction of this sentence for the entry of his plea. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Sofia Salazar-Reyes plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class C felony, in case FECR218461. She was sentenced to a maximum indeterminate term of ten (10) years and will be required to serve a mandatory one-third term of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Nathaniel Potter pled guilty to Theft in the 2nd Degree for exercising control over stolen motor cycles. His sentencing has been scheduled for July 7, 2008 at 9:00 a.m.

05/21/2008 Todd Allen Little pled guilty to Possession of a Controlled Substance with Intent to Deliver as a Second or Subsequent Offender and as an Habitual Offender and to Failure to Affix a Tax Stamp as an Habitual Offender in Polk County Criminal Case FECR217152. Little also stipulated that he violated his probation; Little was on probation for Possession of a Controlled Substance with Intent to Deliver when he was caught dealing drugs again. The Court sentenced the defendant to fifteen years prison. The defendant cannot be considered for parole until he serves three years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Travis Grinnell, age 17, was sentenced to a form of probation for five years for his convictions on Theft in the Second Degree, Eluding and Possession of an Offensive Weapon. As a condition of his probation, Grinnell has to reside at the Fort Des Moines Correctional Facility and participate in substance treatment.

Matthew Barber stipulated that he violated his probation for a conviction of Burglary in the Second Degree , Possession of a Prescription Drug and Assault Causing a Bodily Injury. His probation was continued, but he has been sent to the Mount Pleasant facility for drug treatment.

Michelle Crow in case FE217637 was sentenced after pleading guilty to three counts of Forgery. Ms. Crow was granted a Deferred Judgment and sentenced to two years probation. She was ordered to pay a $750.00 civil penalty and $5000 restitution.

Jerae Griffith in case Fe218542 plead guilty and was sentence on the charge of Theft in the First Degree. Ms. Griffith was sentenced to ten years in prison. The prison sentence was suspended and the defendant was placed on probation. She was ordered to reside at the Women’s Residential Facility and ordered to pay restitution.
