WEEKLY CASE SUMMARY
07/01/2008 Bianca Barber pled guilty and was sentenced for the crime of Possession of a Controlled Substance with Intent to Deliver-Methamphetamine, as a lesser included offense of the Trial Information, in violation of Iowa Code Section 124.401(1)(c)(6), a Class C Felony. Barber was sentenced to 10 yeas I prison and must serve a mandatory minimum 1/3 of her sentence prior to being eligible for parole. Barber’s sentence shall run consecutive to her parole revocation. Barber was prosecuted by the Drug and Gang Bureau.

On April 23, 2008, David Leroy Allen, FECR218598, pled guilty to Delivery of a Controlled Substance-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony and Delivery of a Controlled Substance-marijuana, as alleged in Count III of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. Sentencing was set for July 1st, 2008. At the time of sentencing the State argued for a 5 year suspended sentence on both counts and further argued that the sentences run consecutive to each other for a total period of incarceration not to exceed 10 years. The Defendant requested a deferred judgment. The Court granted the defendant a deferred judgment on both counts and placed him on probation for two years with the applicable civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

07/02/2008 David Spalding was sentenced to prison in Polk County Criminal Number FECR219952 for a period not to exceed 20 years for the crime of Possession of a Controlled Substance with Inten to Deliver - Methamphetamine, as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Sabino Gallardo-Moreno plead guilty to and was sentenced for the crime of Possession of a Controlled Substance, methamphetamine, With Intent to Deliver, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, in case FECR219587. He was sentenced to a maximum indeterminate term of ten (10) years and five (5) years and these sentences were ordered to be served consecutively. The defendant must serve a mandatory minimum term of one-third of the ten year sentence before he is eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

07/03/2008 Jeffrey Wiese plead guilty to and was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, methamphetamine, a Class C felony, and Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, in case FECR218955. He was sentenced to a maximum indeterminate term of ten (10) years and five (5) years and these sentences were ordered to be served consecutively. The defendant must serve a mandatory minimum term of one-third of the ten year sentence before he is eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Timothy Hughes plead guilty to and was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, methamphetamine, a Class C felony, and Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, in case FECR218954. Maximillion Harris was sentenced to a term of incarceration not to exceed ten (10) years for violating his probation in case number FE210944. He had been previously granted probation for the crime of Possession of a Controlled Substance, cocaine, With Intent to Deliver, a Class C felony. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
