WEEKLY CASE SUMMARY
07/28/2008 Joseph L. Fausett was sentenced before Judge Schemmel. Fausett pled guilty on June 11, 2008 to the crime of Conspiracy to Manufacture a Controlled Substance, in violation of Iowa Code Section 124.401(1)(c)(6), a Class C Felony. The State recommended prison based on the defendant’s history of violence however, Judge Schemmel chose to send him to the Fort Des Moines Residential Facility. Fausett was prosecuted by the Drug and Gang Bureau.

On May 28th, 2008, Issac Lawrence Wood, FECR214359, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. On July 28th, 2008, this case came before the Court for sentencing. The Court gave the defendant a 5 year suspended sentence and placed him on probation for two years with the applicable $750.00 fine. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Mirad Delic was sentenced to prison in Polk County Criminal Number FECR189624 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver – Cocaine, for a period not to exceed 5 years for the crime of Possession of a Controlled Substance with Intent to Deliver – Marijuana, and for a period not to exceed 5 years for the crime of Failure to Possess a Tax Stamp. The Court ordered the sentences to be served consecutively. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Robert Kluding pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud in Polk County Criminal Case number FECR212793. The Court deferred judgment and placed the defendant on probation for two years with the requirement that the defendant cooperate with all recommended substance abuse treatment. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

07/29/2008 Anthony Fierro a/k/a Rasco was sentenced to prison in Polk County Criminal Number FECR210291 for a period not to exceed 5 years for the crime of Criminal Gang Participation and for a period not to exceed 2 years for the crime of Harassment 1st. He was also sentenced to prison in Polk County Criminal Number FECR216770 for a period not to exceed 2 years for the crime of Criminal Mischief 3rd. Finally, the defendant was sentenced in Polk County Criminal Numer SRCR220707 for a period of 30 days for the crime of Escape. The Court ordered the sentences to be served consecutively. The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Mark Burtlow pled guilty to Disarming a Peace Officer and Possession of a Controlled Substance with Intent to deliver, both Class D felonies, in Polk County Criminal case number FECR219970 and was sentenced to an indeterminate term of incarceration not to exceed five years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Brandon Michael Marks, FECR213017, came before the Court for a probation revocation hearing. The defendant stipulated to the violations contained in the probation violation report and agreed to immediate disposition. The Court revoked his deferred judgment and sentenced him to 5 years in prison. The Court suspended the sentence and placed him on probation for two years with the applicable $750.00 fine and 180 day driver’s license revocation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

07/30/2008 On October 10th, 2007, Marion Alexander Brooks, FECR213878, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony. The case was originally scheduled for sentencing on November 27th, 2007, but was continued numerous times due to the defendant also having robbery charges in Fort Dodge, Iowa. On July 30th, 2008, this case came before the Court for sentencing. Both sides were in agreement that the defendant should be sentenced to 5 years in prison. The Court agreed with the recommendation and sentenced him to prison for 5 years. On August 11th, 2008, the defendant will enter a guilty plea to his felony charges in Webster County and agree to 22 years in prison. It will be up to the Webster County Judge to decide whether the 5 year prison sentence out of Polk County will run concurrent or consecutive to the 22 year sentence in their county. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Stacey Shanahan, FECR195419, stipulated that she violated the terms and conditions of her probation. She was found in contempt of court and ordered to serve 90 days in the Polk County Jail. She was further unsuccessfully discharged from her probation.

Hope Silver, FECR218677, appeared for sentencing. She was given a deferred judgment and placed on probation for a period not to exceed two (2) years. She was further ordered to participate in the Victim Offender Reconciliation Program and ordered to maintain full time employment and/or attend school full time.

Julie Grandstaff plead guilty to and was sentenced for the crimes of Conspiracy to Manufacture a Controlled Substance, methamphetamine, a Class C felony, Possession of Ephedrine or Pseudoephedrine With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, and Possession of Lithium With Intent It Be Used to Manufacture a Controlled Substance, a Class D felony, in case FECR216720. She was sentenced to a maximum indeterminate term of twenty (20) years and must serve a mandatory minimum term of one-third on the ten year sentence before she is eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
