WEEKLY CASE SUMMARY
09/02/2008 Chico Cham Baccam, FECR221116, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony without the firearm enhancement. The defendant waived time and notice and agreed to immediate sentencing. The Court granted him a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jordan Hardin plead guilty to Possession of a Controlled Substance with Intent to Deliver in Polk County Criminal Case number FECR221021. The Court deferred judgment and placed the defendant on probation for a period of two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Lonnie Thomas pled guilty to Possession of a Controlled Substance with Intent to Deliver in Polk County Criminal Case number FECR218361. The Court sentenced the defendant to an indeterminate term of incarceration in prison not to exceed five years, suspended that sentence, and placed the defendant on probation for a period of two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Shamar Newman pled guilty to Failure to Possess a Tax Stamp in Polk County Criminal Case number FECR218630. The Court sentenced the defendant to an indeterminate term of incarceration not to exceed five years, suspended that sentence, and placed the defendant on probation for a period of two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.



09/03/2008 On July 15th, 2008, Joshua James Shaw, FECR219485, pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation or Subterfuge-Hydrocodone/Vicodin, as alleged in Count II of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(8), 155A.23 and 155A.24, a Class C Felony. On September 3rd, 2008, he came before the Court for sentencing. The Court granted him a deferred judgment and two years probation with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Quintin Watley appeared on allegations that he violated the terms of his probation. He agreed that he had and was sentenced to a period not to exceed ten years in prison.

Charles Nicholes III plead guilty to second offense failure to register as a sex offender and escape. He was sentenced to a term not to exceed six years in prison.

Kaleb E. Holzheuser, FECR221438, pled guilty to Possession of a Controlled Substance with Intent to Deliver, as alleged in Count I, in violation of Iowa Code Section 124.401(1)( c )(8), a Class C Felony. The defendant waived time and notice and agreed to immediate sentencing. The Court granted him a deferred judgment and placed him on probation for two years with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On July 16th, 2008, Eric Michael Smith, FECR219855, entered an Alford plea to the charge of Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceit, Misrepresentation or Subterfuge-Hydromorphone/Dilaudid, as alleged in the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(8), 155A.23 and 155A.24, a Class C Felony. On September 3rd, 2008, this case came before the Court for sentencing. The Court granted him a deferred judgment and placed him on probation for two years with the applicable $1,000.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

09/04/2008 Ramiro Duran plead guilty to and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, marijuana, a Class D felony, in case FECR219710. He was sentenced to a maximum indeterminate term of five (5) years in prison. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Nicole Parker plead guilty to and was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, methamphetamine, a Class C felony, in case FECR218264. She was sentenced to a maximum indeterminate term of ten (10) years in prison and must serve a mandatory one-third term before she will become eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
