WEEKLY CASE SUMMARY
09/29/2008 Shannek Young plead guilty to two counts of Delivery of a Controlled Substance and Possession of a Controlled Substance, Third Offense, in Polk County Criminal case numbers FE214613 and SRCR219701. After the defendant successfully completed substance abuse treatment at the Mt. Pleasant Residential Treatment program, the Court imposed a twenty year prison sentence, suspended that sentence, and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

09/30/2008 Douglas Rowe was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case FECR220541. Judgment was deferred and he was placed on probation for a two year term. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On August 13th, 2008, John Robert Stelmacher, FECR220698, pled guilty to Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in the Trial Information, in violation of Iowa Code Section 124.401(1)(d), a Class D Felony, without the sentencing enhancement. On September 30th, 2008, he came before the Court for sentencing. The Court granted him a deferred judgment and probation with the applicable $750.00 civil penalty. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Michelle Cunningham pled guilty to Obtaining or Attempting to Obtain a Prescription Drug by Fraud, Deceipt, Misrepresentation or Subterfuge in Polk County Criminal case number FECR218860. The Court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Brett Ferry pled guilty to Delivery of a Controlled Substance in Polk County Criminal case number FECR220722. The court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

John Cameron was sentenced to prison in Polk County Criminal Number FECR202985 for a period not to exceed 10 years for the crime of Possession of a Controlled Substance with Intent to Deliver - Cocaine Base "Crack". The Court revoked the probation previously granted to the defendant. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/01/2008 Mathew Bingaman pled guilty to Possession of a Controlled Substance with Intent to Deliver in Polk County Criminal case number FECR219960. The Court deferred judgment and placed the defendant on probation for two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

Alison Hutchens appeared for her Arraignment in FE219168 where she is charged with Theft in the Second Degree. Her PTC is set for 10-30-08 at 10 AM in Room 204 and her trial was set for 12-3-08 at 9 AM in Room 204.

Jessica Cashman appeared for her Arraignment in FE0222597 where she is charged with Neglect of a Dependent Person, Acquiring Possession over a Stolen Firearm, and 2 Counts of Possession of a Controlled Substance. Her PTC is set for 10-30-08 at 1:30 PM in Room 204 and her trial was set for 12-3-08 at 9 AM in Room 204.

Sherry Rynearson appeared for a Probation Revocation Hearing in FE199197. She stipulated to being in violation of probation and was ordered to serve 30 days in the Polk County Jail as contempt. Her probation was also extended one year.

Scott Edwards appeared for a Probation Revocation Hearing in FE213511 where he is on probation for the crime of Felon in Possession of a Firearm, and for a Guilty Plea and Sentencing in SR220546 where he has been charged with Escape – Voluntary Absence. The defendant stipulated to being in violation of his probation and pleaded guilty to the Escape charge. By agreement of the parties his probation was revoked and he was ordered to serve five (5) years in prison. He was also ordered to serve 15 days on the escape charge and the 15 days was ordered to be consecutive to the 5 years.

Gary Robert Boothroyd was sentenced to 15 years in prison as a habitual offender after having plead guilty to Burglary in the Third Degree, and Eluding the police.
The charges arose on January 3, 2008, when the defendant committed a burglary and then fled from the police.
Gary Robert Boothroyd was also sentenced in Case No. FECR218612 after having been charged with Burglary in the Third Degree as a habitual offender for events that occurred on October 2 or 3, 2007. In that case, a burglary occurred on October 3, 2007. In that burglary the defendant left blood at the scene. Gary Robert Boothroyd was identified as the burglar in that case when the DCI Criminalistics Laboratory matched the DNA found at the scene with the known DNA of the defendant.
The defendant was sentenced to 15 years on each count.

10/02/2008 Dionicio Ruiz plead guilty to and was sentenced for the crime of Conspiracy to Deliver a Controlled Substance, a Class B felony, in case FECR221512. He was sentenced to a maximum indeterminate term of twenty-five (25) years and will be required to serve a mandatory minimum term of one-third of this sentence before he is eligible for parole. He did receive a one-third reduction of this sentence for the entry of his plea. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Tia Parker plead guilty to and was sentenced for the crime of Conspiracy to Deliver a Controlled Substance, a Class B felony, in case FECR221510. She was sentenced to a maximum indeterminate term of twenty-five (25) years and will be required to serve a mandatory minimum term of one-third of this sentence before she is eligible for parole. She did receive a one-third reduction of this sentence for the entry of his plea. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

10/03/2008 Brian Struve FECR220755 pled guilty to Assault with Intent to Commit Sexual Abuse Causing Bodily Injury. The defendant asked for immediate sentencing. The Court sentenced him to a prison term for a period not to exceed 5 years. In addition, the defendant was sentenced to have No Contact with the victim, participate in sex offender treatment program, and register as a convicted sex offender. When the defendant is released from prison, he is committed to the custody of the director of the Iowa Department of Corrections for a ten year special sentence.
