Felony Case Update (April 2019)

On April 1, 2019 Tristan James Thompson appeared for sentencing in Case No. FECR321980 for the crime of Possession of a Controlled Substance with Intent to Deliver, to wit:  Marijuana, a Class D Felony.  The Polk County District Court deferred judgment and placed the defendant on probation for a period of two years. This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau. 

On April 9, 2019 David Joseph Daughenbaugh appeared for a probation revocation in Polk County Case No. FECR309178.  The Polk County District Court revoked the defendant's deferred judgment and sentenced the defendant to a term of incarceration not to exceed five years for the crime of Possession of a Controlled Substance with Intent to Deliver, to wit:  Marijuana, a Class D felony.  This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau. 

On April 9, 2019 Corey Allen Brown appeared for sentencing in Polk County Case No. FECR323167 for the crime of Felon in Possession of a Firearm, as a Habitual Offender.  The Polk County District Court sentenced the defendant to a prison term not to exceed 15 years consecutive to his parole matters.  The defendant must serve a minimum of three years in prison prior to becoming eligible for parole.  This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 9, 2019 Edward Charles Walls appeared for sentencing in Polk County Case No. FECR323733 for the crime of Tax Stamp Violation as a Habitual Offender.  The Polk County District Court sentenced the defendant to a prison term not to exceed 15 years concurrent to the defendant's probation matters on unrelated matters.  The defendant must serve a minimum of three years in prison prior to becoming eligible for parole.  This case was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 11, 2019, Zachary Roy Simpson was sentenced in case number FE316684 for the crimes of Conspiracy to Deliver a Controlled Substance, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, and in case number FE309669 for the crimes of Criminal Mischief in the Third Degree, an Aggravated Misdemeanor, and Harassment in the Second Degree, a Serious Misdemeanor.  He was sentenced consecutively to a maximum term of incarceration not to exceed Eighteen (18) years to be served with the Iowa Department of Corrections.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 15, 2019 Shaun Michael Gienger appeared for sentencing in Case No. FECR324147 for the crime of Possession of a Controlled Substance, Third Offense, a Class D Felony, as a Habitual Offender.  The Polk County District Court sentenced the defendant to a prison term not to exceed 15 years concurrent to parole matters.  The defendant must serve at least three years in prison prior to becoming eligible for parole.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 15, 2019 Wichang Gach Chawech appeared for sentencing in Case No. FECR318323 for the crime of Tax Stamp Violation, a Class D Felony.  The Polk County District Court sentenced the defendant to a term of incarceration not to exceed five years but suspended the sentence and placed the defendant on probation.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau. 

On April 15, 2019, Daniel Mitchell was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, in case number FE321161.  He was sentenced to a maximum term of incarceration not to exceed twenty-five (25) years with a mandatory one-third term he must serve prior to becoming eligible for parole.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 18, 2019, Raytavius Ramone Horton was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, and Harassment in the First Degree, an Aggravated Misdemeanor, , in case number FE319539 and AG313618. The Court deferred judgment and granted the Defendant an opportunity on probation for a term of two years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

 

On April 18, 2019, David Ray Brooks was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver THC edibles, a Class D felony, and Possession of a Controlled Substance With Intent to Deliver Marijuana, a Class D felony, in case number FE322175.  He was sentenced to a maximum term of incarceration not to exceed five (5) years on each offense, consecutive to each other for a total term of incarceration not to exceed ten (10) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On 4/18/2019 Gerald Miller was sentenced after being found guilty by a jury of Sexual Abuse in the Second Degree and Assault With Intent to Commit Sexual Abuse Causing Bodily Injury.  Miller was sentenced to 25 years for Sexual Abuse in the Second Degree.  He will be required to serve 70% of the 25 year sentence before being eligible for parole.  Miller was sentenced to 5 years for Assault With Intent to Commit Sexual Abuse Causing Bodily Injury.  The Judge ran the sentences conseutive to each other for a total term of incarceration not to exceed 30 years.  The convictions stem from a violent sexual assault of a convenience store employee who was working at the time of the assault.  Miller will also be required to be supervised by the Department of Corrections upon his release and register with the Sex Offender Registry for the rest of his life.

On April 19, 2019, Robert Eugene Key, Jr. was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, as a habitual offender, in case number FE317199.  He was sentenced to a maximum term of incarceration not to exceed fifteen (15) years with a mandatory three-year term he must serve prior to becoming eligible for parole, the Court suspended this sentence and granted the Defendant an opportunity on probation for a term of five (5) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau

On April 16, 2019 Auston Dillon Sangxayarath appeared for sentencing in Polk County Case No. FECR321986 for the crime of Possession of a Controlled Substance with Intent to Deliver, to wit:  Marijuana, a Class D Felony.  The Polk County District Court deferred judgment and placed the defendant on probation for two years.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 16, 2019 Litisa Ann Walker appeared for sentencing in Polk County Case No. FECR321899 for the crime of Tax Stamp Violation, a Class D Felony.  The Polk County District Court deferred judgment and placed the defendant on probation for two years.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 18, 2019 Deon Lamar Mosley appeared for sentencing in Polk County Case No. AGCR322275 for the crime of Possession of a Controlled Substance, Third Offense, to wit:  Marijuana,  as a Habitual Offender.  The Polk County District Court sentenced the defendant to a term of incarceration not to exceed 15 years, but suspended the sentence and placed the defendant on probation for two years.  .  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 18, 2019 Ralph Edward Artis appeared for sentencing in Polk County Case No. FECR321966 for the crime of Possession of a Controlled Substance with Intent to Deliver, to wit:  Methamphetamine, a Class C Felony.  .  The Polk County District Court deferred judgment and placed the defendant on probation for two years.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 18, 2019 Randy Eugene Cason appeared for sentencing in Polk County Case No. FECR323168 for the crime of Possession of a Controlled Substance, Third Offense, to wit:  Marijuana, a Class D Felony.  The Polk County District Court sentenced the defendant to a term of incarceration not to exceed five years, but suspended the sentence and placed the defendant on probation for two years.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 22, 2019 Vanna Tim appeared for sentencing in Case No. FECR323548 for the crime of Possession of a Controlled Substance with Intent to Deliver, to wit:  Methamphetamine, a Class C Felony with application of the Second or Subsequent Offender Enhancement.  The Polk County District Court sentenced the defendant to prison for a term not to exceed 20 years.  This defendant was prosecuted by the Polk County Attorney's Office Drug and Gang Bureau.

On April 23, 2019, Haley Carrick was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE322996.  She was sentenced to a maximum term of incarceration not to exceed ten (10) years and five (5) years, consecutive, but these sentences were suspended and she was placed on probation.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 23, 2019, Zlatan Vukasinovic pled guilty in FECR323624 to Vehicular Homicide by Operating While Intoxicated. In the presence of Franklin Sylalom’s parents, sister and girlfriend, the defendant admitted he drank at a local bar on November 10, 2018 and became intoxicated. He got into his car and drove the wrong way up an off-ramp at the mix master of Interstate 80/Interstate 35 at which time he struck the vehicle Franklin Sylalom was driving.  Mr. Sylalom was killed on or immediately after impact as a result of the Defendant’s act of driving while intoxicated.  The defendant sustained multiple fractures to his lower extremities.  The Defendant denied remembering much of the accident. He agree the Court could rely on the minutes of testimony to support his factual basis for the plea.  The minutes of testimony indicate the defendant’s blood alcohol content was .118 five hours after the collision.  The delay in obtaining his blood was due to the need to use extraordinary measures to extract the defendant from his vehicle.  The Defendant will be sentenced on June 6, 2019.

On April 24, 2019, Christopher Joseph Long plead guilty to the crime of Failure to Possess a Tax Stamp, a Class D felony, in case number FE324509. The Defendant requested immediate sentencing and the Court sentenced the Defendant to an indeterminate term of incarceration not to exceed five (5) years to be served in prison with the Iowa Department of Corrections.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 24, 2019, Jose Antonio Pacheco-Rivera was sentenced for the crimes of Possession of a Controlled Substance, Third Offense, a Class D Felony, and Operating a Motor Vehicle Without the Owner’s Consent, an Aggravated Misdemeanor, in case numbers SR321372 and FE321373.  He was sentenced to a maximum term of incarceration not to exceed five (5) years in SR321372 and two (2) years in FE321373, consecutive to each other for a total term of seven (7) years. The Court suspended this sentence and granted the Defendant an opportunity on probation for a term of five (5) years where the Defendant must participate in and complete the Bridges of Iowa treatment program as a condition of probation.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 24, 2019, Jason Rand Petersen was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C Felony, in case number FE321136.  The Defendant was sentenced to a maximum term of incarceration not to exceed ten (10) years. The Court suspended the Defendant’s sentence and granted him an opportunity on probation for a term of two (2) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 24, 2019, Toby Austin Champalath was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case number FE322989. The Court deferred judgement and granted the Defendant an opportunity on probation for a term of two (2) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 24, 2019, Darrius Leroy Woods was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number SR322723. The Court deferred judgement and granted the Defendant an opportunity on probation for a term of two (2) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 29, 2019, Cody Duckworth was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, in case number FE322137.  He was sentenced to a maximum term of incarceration not to exceed ten (10) year, but this sentence was suspended and he was placed on probation.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 2, 2019, Austin James Hunter plead guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, and Possession of a Controlled Substance With Intent to Deliver, a Class D felony in case number FE323257.  He will be sentenced on June 17, 2019 and faces a maximum term of incarceration not to exceed fifteen (15) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 30, 2019, Zane Alexander Hehnke was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case number FE322731. The Court deferred judgement and granted the Defendant an opportunity on probation for a term of two (2) years.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 29, 2019, Charles Leonard Cain, II, was sentenced for the crimes of Conspiracy to Deliver a Controlled Substance while in the Immediate Possession of a Firearm, a Class B felony, Possession of a Controlled Substance With Intent to Deliver while in the Immediate Possession of a Firearm, a Class B felony, and Failure to Possess a Tax Stamp, a Class D felony, as a habitual offender, in case number FE323552.  He was sentenced to a maximum term of incarceration not to exceed fifty (50) years with a mandatory one-third term he must serve prior to becoming eligible for parole and a fifteen (15) year term with a mandatory three year term he must serve prior to becoming eligible for parole, concurrent.  This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
